잘 아는 바와 같이 崛山寺梵日에 대한 선종 자료로서 祖堂集 17, ‘梵日傳’과, 淨土宗관련으로는 三國遺事 3, ‘洛山寺正趣’조가 매우 중요하다. 그러나 이들 자료에 등장하는 사찰의 명칭이나 승려 또는 開山說話의 내용은 사실관계에 대한 검증을 요하는 부분들이 적지 않다. 본고에서 검증하여 바로잡은 내용을 개술하면 대개 다음과 같다. 첫째 범일이 入唐하여 처음 찾은 明州‘開國寺’는 ‘開元寺’의 誤記이며, 거기서 만난 ‘고향 출신 사미승’은 ‘襄陽洛山寺에 거주하는 正趣菩薩의 化身’으로 보아야 한다. 둘째 범일이 귀국하여 주석한 ‘崛山’은 영취산(靈鷲山)을 의미하는 것으로 그것은 釋迦가 일찍이 法華經과 無量壽經을 강론하였다는 범어 Grdhra-Kuta의 音譯이다. 이는 범일이 주석하면서 부르기 시작한 것으로 추측된다. 셋째 범일이 구법한 浙江沿海지역(天台山과 普陀山등)은 고래로 法華經的觀音信仰이 성행하였으며, 그가 正趣菩薩의 安置로 인한 낙산사 重創한 것 역시 법화경적 관음신앙의 영향아래 이루어 진 것이다. 그러나 이러한 法華經的영향 역시 義湘大師에서 비롯한 華嚴經的觀音信仰과 결부하여 이루어졌다는 사실을 간과해서는 안 된다. 넷째 이 밖에도 범일이 禪宗의 眞歸祖師說을 주장했다거나 또는 범일에게 國師라는 호칭이 있었다고 하지만 이들은 실제 하였던 일은 아니다. 그것은 범일에 대한 존경심이 강하였던 嶺東지방의 사회분위기에 기인한 것으로 보아야 할 것이다. As is well established, Chodangjip 17 and ‘Pŏm Il Chŏn,’ are very important as Zen sect documents regarding Kulsansa Pŏm Il, as are Samgungnyusa 3, and ‘Naksansa Chŏngch'wi’ regarding Chŏng T'ochong. However, the names of the temples and monks that emerge in these documents, as well as the veracity of the Kaesansŏrhwa are in considerable need of verification. This article intends to verify and rectify the following summarized contents: First, the Myŏngchu ‘Kaegukshi’ that Pŏm Il first finds upon his initiation can be attributed to a mistaken record in ‘Kaewŏnsa’, and the ‘acolyte from his hometown’ should be understood as an incarnation of the Chŏngch'wi Bodhisattva dwelling at ‘Yangyang Naksansa.’ Second, the ‘Kulsan’ that Pŏm Il annotated upon his return to his home country signifies Yŏngch'wisan and serves as a transliteration of the Sankrit Grdhra-Kuta sermon of Pŏp'wagyŏng and Muryangsugyŏng preached by Buddha. It is estimated that Pŏm Il began to recite this during his annotations. Third, Buddhist faith in the style of the Pŏp'wagyŏng has historically prevailed in the Chŏlgang coastal regions (such as Ch'ŏnt'aesan and Pot'asan) where Pŏm Il sought his learnings. Thus his rebuilding of Naksansa for the enshrinement of Chŏngch'wi Bodhisattva was carried out under the influence of the Buddhist faith of Pŏp'wagyŏng. Yet we cannot overlook the fact that this Pŏp'wagyŏng influence was associated and enacted with the Buddhist faith of Hwaŏmgyŏng that originated from Ŭisangt'aesa. Fourth, certain claims that Pŏm Il supported the Chin'gwijosa theory of the Zen sect or that he was bestowed with the title of Great Teacher are untrue. These claims most likely originated from the Yeongdong region where the social atmosphere was particularly reverent of Pŏm Il.
한반도 농산물 유통을 위한 법적 과제 ― 북한 지역 내 정가·수의매매 제도 적용가능성 검토를 중심으로 ―

This article notes the changes in North Korea's agricultural structure is intertwined to the changes in distribution structure following the development of the North's market system. Specifically, the purpose of this study is to lay the foundation for integrated legislation of agricultural wholesale markets between two Koreas. The significance of the study was analyzed as follows. First, the distribution structure of agricultural products in North Korea is analyzed from a physical, human and institutional perspective, revealing that the wholesale market-oriented institutional approach was valid. Second, comparing the wholesale market corporation system centered on the auction system and the market wholesale system centered on the free transactions system at a fixed price, and examining the integration of agricultural markets into the free transactions system at a fixed price was valid. Third, examine South Korea's Agricultural Law which stipulates “transparency,” “fairness,” and “stability of payment,” for the free transactions system at a fixed price to make a integrated legislation. Finally, we present the effects that can be expected if the free transactions system at a fixed price is successfully applied to the exchange and integration process of the agricultural distribution market. And propose a paradigm change and follow-up study of the agricultural exchange and cooperation project.
플라톤의 『법률』이 오늘날 법조계(法曹界)에 던지는 메시지 - 적도를 갖춘 ‘자유-우애-지성’의 현대적 해석 -

It seems difficult to compromise with Plato's national system, which presupposes the absolute reality of truth, and the present-day political system, which presupposes the relativity of truth. However, Plato's ideology of the rule of law, which insists that all members of the community obey the law, and our rule of law, which checks extrajudicial power, have something in common in that they give authority to the substance of the law, not the form of the law. In short, from the point of view of ‘the rule of law’, we can confirm the intersection of the two systems. Dating back about 2500 years, This article attempts to examine the meaning of the ideological elements that operate the rule of law from ancient Plato's thought, and how they can be interpreted and applied today. Chapter I examines the reason Plato wrote a book titled ‘laws’ and the significance of the rule of law thought as a practical alternative that he suggested after giving up the idea of the rule of iron man. Chapter II analyzes the principle of ‘to metrion and agathon' as a methodology adopted by Plato, and uses the examples of Persia and Athens to apply this as a requirement to operate the rule of law. indicate that they are in a relationship. Chapter III examines whether the three-sided relationship of liberty-fraternity-intelligence discussed earlier can be applied to today's lawyers. Among them, freedom, fraternity, and intelligence are reinterpreted and applied in a modern sense to lawyers in the judicial field, especially in line with Plato's method of electing public office. Plato's idea that restrictions on civil liberty is a substitution of public liberty rather than the imposition of public obligations applies to lawyers today. Lawyers need a public sphere which is a space of public liberty to discuss their own public duties. The article concludes by pointing out that this should be prepared.
