본 논문은 경쟁정책 다자규범화에 대한 국제적 논의를 바탕으로 WTO에서의 경쟁정책에 관한 다자규범이 나아갈 방향을 제시하고자 한다. 우선 경쟁정책 다자규범화의 논의가 있게 된 배경으로서 경쟁정책과 무역정책의 상호작용의 이론적, 역사적 측면을 살펴본다. 보다 구체적으로, WTO를 비롯한 여러 국제 기구에서의 경쟁정책 다자규범화에 대한 논의와 이에 대한 각국의 입장을 검토해봄으로써 경쟁제한적 행위에 대한 대응방안으로서 경쟁정책 다자규범의 필요성을 강조한다. 나아가, 실제 다자규범이 어떠한 방식으로 추구될 수 있는지에 관한 논의를 바탕으로 하여 현재 상황에서 다자차원에서 수용 가능한 다자규범화 방식과 장기적으로 추구되어야 할 이상적인 규범화방식을 제시한다. 그리고 경쟁정책 다자규범의 구성요소로서 현재 수용 가능한 공통분모에 해당하는 WTO Doha 각료선언문에 포함된 개별 의제들을 논의하면서 어떠한 형태로 규범화될 수 있는지 그 방향을 제시한다. 비록 Cancun 각료회의에서 싱가포르 이슈 전반에 관한 협상방식에 대한 합의 실패로 현재 경쟁정책의 다자규범화 논의는 당분간 정지되어 있지만, 궁극적으로 다자규범 또는 복수국가간 협정으로 발전될 것이라는 전제하에 향후 출범해야 할 경쟁정책 다자규범의 바람직한 방향과 그 구체적 내용을 제시하고자 한다. With regard to a possible multilateral framework on competition policy, discussions have been underway at various international organizations including the WTO. This issue has been one of the main issues at the WTO for it is believed that anti-competitive practices undermine the gains of trade liberalization. Opinions exchanged at the WTO Working Group on the Interaction between Trade and Competition Policy show that a multilateral framework is necessary to deal with competition policy-related trade concerns and for the contribution of competition policy to international trade and development. However, discussions have not been developed into a formal negotiation stage, due to the lack of consensus on the modalities for the the multilateral framework agreement. While evaluating various approaches to a possible multilateral framework and looking into the WTO’s work on the basic elements of the multilateral framework under the Doha Mandate, this paper envisons what should be a right direction to pursue for the future negotiations on a multilateral framework on interaction between trade and competition policy. Although the Cancun Ministerial Conference failed to reach an agreement on the modalities of a multilateral framework on competition policy, there is no doubt that negotiations will continue in the future. This paper is aimed at contributing to such progress.
반덤핑/상계관세법상 “불리한 가용 정보 적용”의 WTO 합치성

미국 상무부는 2015년 무역특혜확장법(TPEA)을 통한 반덤핑/상계관세법 개정 이후 불리한 가용 정보(AFA)의 이용을 적극적으로 확대하고 있다. 그 결과 작년부터 우리나라 대표적인 수출기업들에게도 전면적 또는 부분적 AFA의 적용을 통해 종가세 기준 60%에 이르는 고율의 반덤핑/상계관세를 부과하고 있다. 현대중공업 대형변압기에 대한 반덤핑관세와 포스코 냉연/열연철강에 대한 상계관세가 그 단적인 예이다. 이 논문에서는 AFA 적용 관련 규정인 WTO 반덤핑협정 제6.8조(부속서 2) 및 보조금협정 제12.7조의 적용 요건과 기준을 기존의 WTO 상소기구 판례법에 비추어 제시한 다음 위 포스코와 현대중공업에 대한 상계/반덤핑관세 부과조치가 위 협정 규정 위반임을 분석하여 밝힌다. 그리고 그 조치들의 법적 근거 규정인 TPEA 그 자체를 WTO에 제소할 수 있는지도 분석해 본다. 마지막으로 우리나라 정부에 대한 정책적 조언을 하면서 이글을 마친다. The Commerce Department of the United States has aggressively applied ‘adverse facts available’ in the context of antidumping/countervailing duty investigations since it enacted the Trade Preference Expansion Act of 2015. As a result, since last year, major Korean exporting enterprises have become subject to antidumping/countervailing duties as high as 60% ad valorem. Representative examples are antidumping measures against Hyundai Heavy Industry(HHI)’s large transmitters and countervailing measures against POSCO’s cold/hot-rolled steel. This paper aims to interpret the requirements and legal standards for applications of adverse facts available under Article 6.8(Annex 2) of Antidumping Agreement and Article 12.7 of the Subsidies Agreement in light of the WTO Appellate Body’s jurisprudence. Then, this paper demonstrates why and how the U.S. antidumping and countervailing measures against HHI and POSCO, respectively, constitute violations of the above WTO provisions. Also, this paper analyzes whether the TPEA, which provides for legal basis of such aggressive resort to AFA provisions, may be challnged as such in the WTO dispute settlement. This paper closes with some trade policy suggestions for the Korean government.

DSU 17.6 provides that the Appellate Body has jurisdiction over “issues of law covered in the panel report and legal interpretations developed by the panel.” Nevertheless, the two types of disputes arising in the course of implementation are not subject to the panel proceedings and thus escape from the scrutiny of the Appellate Body. The first of those two is an arbitration procedure for determining the reasonable period of time for implementation of the recommendations made by the Dispute Settlement Body. The other is an arbitration procedure under which the level of trade retaliation is to be determined. Those two procedures provide for “binding arbitration”, and thus no further judicial review is allowed. There are diverging views on whether it is desirable not to allow any judicial review of those arbitral awards. However, no one denies the importance of those procedures in light of their relatedness to the core of the WTO dispute settlement procedures, i.e., implementation. This paper is designed to critically analyze the jurisprudence having been developed under the relevant WTO arbitration procedures and their resulting awards. This paper closes which some suggestions and observations to amend the current DSU provisions that are the legal backbone of these arbitration procedures.
