홍콩 민주화 시위에서 시민교육의 역할 - Liberal Studies를 중심으로 -

Liberal Studies is introduced in Hong Kong secondary curriculum around the return of Hong Kong to China. It tries to give civic education with social issue by discussion, consilence approach and personal project evaluation. On early stage, it suffered hard times with opposition by university and teachers. Designated as inevitable in NSS curriculum, Liberal Studies is on its way stable. But Umbrella Revolution of Hong Kong 2014 changed the situation. Some critisized that Liberal Studies gave bad inflence to young students to behave wrong, others support that it made students tell the truth from lies. This is a rare example of civic education that actally leads to social engagement. Liberal Studies can gives light to Integrated Social Studies and whole civic education of us. 홍콩의 중국 반환을 전후로 홍콩의 교육과정에 도입된 Liberal Studies 과목은 사회적 이슈를 중심으로 한 토론식 수업, 통섭적 접근, 개인 프로젝트 평가 등의 요소를 담은 새로운 시도였다. 도입 초기 현장의 반발로 정착에 어려움을 겪던 Liberal Studies는 2009년 신교육과정을 계기로 입시 필수과목으로 지정되면서 본격적으로 시행되었다. 그러나 2014년 우산혁명 시위를 계기로 Liberal Studies가 학생들에게 나쁜 영향을 미친다는 비판과, 반대로 이 과목을 통한 사회적 이슈의 학습이 잘못된 판단을 막아준다는 긍정적인 의견이 충돌하면서 과목의 개편이 논의되고 있다. 시민교육이 실제 사회참여로까지 이어진 드문 사례로서 Liberal Studies는 우리나라의 통합사회, 더 나아가 시민교육 전체에 많은 시사점을 줄 수 있다.

청소년 교정교육으로서 법교육의 가능성

청소년의 재범을 방지하고 사회 적응력을 높여 건전한 사회구성원으로 만들기 위한 하나의 작업인 교정교육은 궁극적으로 청소년들이 사회 공동체의 약속과 기준에 대해 인식하고 그것을 활용한 사회생활 능력을 높일 때 교정교육의 이념을 구현할 수 있다. 또한 청소년의 교정교육은 청소년의 특성으로 인하여 다면적이고 다양한 학문적 시각의 접근이 필요하며 현재 시행되고 있는 교정교육을 좀 더 보완하기 위한 하나의 수단으로 법교육을 제안한다. 법교육은 국내 외 선행연구를 통해 법에 대한 인식 및 신뢰, 법 준수에 대한 의지 등이 향상되고 사법기관의 절차에 대한 믿음과 법의 공정성을 인식하게 하는 유용한 교육임을 알 수 있다. 또한 청소년들을 둘러싼 환경들에 대해 관심을 높여 사회적 결속력을 높일 수 있는 방법으로 제시된다. 우리 사회의 미래 원동력인 청소년들은 사회와 분리되어 삶을 영위할 수 없고 사회는 공동체의 약속인 법과 분리될 수 없다. 따라서 청소년들이 개인적인 삶과 사회생활 모두를 형성해 나갈 때 필요 한 것이 법에 대한 지식을 활용할 수 있는 능력, 공동체 가치와 기준에 대한 내면화이며 이것은 교정교육의 보완적 수단인 법교육을 통해 달성할 수 있을 것이다. The purpose of Juvenile Correctional Education is to resolve social conflicts as decreasing recidivism of juvenile offenders. For this, Juvenile Correctional Education should be approached in diverse perspectives and by various educational programs. Law-Related Education(LRE) can be an educational complement for Juvenile Correctional Education. LRE has been a successful delinquency prevention programs in U.S. Also, It pervaded in Korea by means of Justice. Along with attending LRE class, youth can obtain potential to increase academic achievements and promote more favorable attitudes toward school. In addition, LRE develops positive beliefs and clear standards for healthy behavior. It can reduce the risk of violence and other delinquent behaviors. Furthermore, there's a close similarity between Juvenile Correctional Education' goal and LRE's educational objectives. By using Various LRE educational program, Juvenile Correctional Education can be more effective and successful through improving legal consciousness of deliquent youth

선진국의 법교육 사례 연구 - 범죄예방교육으로써 법교육의 효과와 사례 -

법교육은 사회통합교육에서 시작되어 시민성교육, 범죄예방교육으로 그 범위가 확장되어 왔다. 범죄예방의 차원에서 법교육의 효과는 교육대상자의 사회적 유대를 복원하여 재범 의 가능성을 줄인다는 사회통제이론으로 설명될 수 있다. 미국을 중심으로 이루어진 우 회교육으로서 법교육 프로그램들은 대상자들의 법적 권위체에 대한 신뢰를 높이고 자존 감과 규범에 대한 존중을 갖도록 하여 재범을 크게 줄이는 효과를 거두고 있다. 우리나 라의 보호관찰영역에도 이와 같은 법교육 프로그램들이 적극적으로 도입될 필요가 있다. Law-Related Education which started from social unification has been developed to citizenship and delinquency prevention education. The effects of LRE in delinquency prevention can be explained by social control theory in the view of restoring the social bondage. LRE as diversion programs implemented mainly in America, have been successful in improving the trust to legal authorities, self confidence, respect for rules and reducing the recidivism. LRE diversion education programs should be brought to probation process in Korea.

홍콩 민주시민교육 교과서 분석연구 - Liberal Studies를 중심으로 -

본 연구에서는 홍콩의 민주시민교육 교과인 Liberal Studies의 교육과정과 교과서를 분석하여 우리나라 민주시민교육에 대한 시사점을 찾는 것을 목적으로 한다. 이를 위해 홍콩 교육청에서 개발한 Liberal Studies 교육과정과 이를 바탕으로 만들어진 2020년 제4 개정판 교과서를 양적, 질적인 차원에서 분석하였다. 분석결과 Liberal Studies는 기존의 학문분과를 기준으로 한 교과들과 달리 사회문제의 분야를 중심으로 6개의 모듈로 개발되어 사회적 이슈의 주제와 탐구문제들을 기본단위로 구성되었으며 토론수업을 핵심적인 수업방식으로 제시했고, 학교 밖에서 학생 스스로 연구프로젝트를 수행하는 자율연구(IES) 항목이 추가되었다는 특징이 확인되었다. 특히 이 과목을 입시 필수 과목으로 지정하고 학교 수업에서 상당한 비중을 할당한 것은 민주시민교육의 강화에 큰 역할을 한 것으로 보인다. 교과서 역시 이러한 교육과정의 목표를 달성하기 위해 사회적 이슈의 내용을 다양하게 소개하고 대립하는 당사자들 간의 의견 충돌을 대비하여 보여주는 다양한 학습요소를 포함하고 있었다. 또한 학생들을 논술평가에 적응하도록 하기 위해 본문 중에는 이슈 분석 및 논술 연습문제도 단계적으로 제시되어 있었다. 하지만 Liberal Studies가 사회적 이슈를 직접 다루는 교과의 특성 상 홍콩의 정치적 변화에 민감하게 영향을 받아 내용이 지속적으로 개정되다가 결국 교과 자체가 사라지게 된 것은 민주시민교육에 사회적 합의와 지지가 필수적인 역할을 한다는 점을 시사한다.

초등 사회 교과서 국제 비교 연구

An International Comparative Study on Elementary Social Studies Textbook: Focused on Politics-Related Parts Lee, Jung woo (Korea Institute of Curriculum & Evaluation) Kwak, Han young (Korea Law-Related Education Center) This study is international comparative study on elementary social studies textbooks. We analyzed textbooks of USA, Japan, France, Canada, Singapore and Korea, especially focused on politics-related parts. The finding of this study are as follows: 1) There are differences between countries in time that supply politics-related contents, the way of editing and the way of showing learning materials. 2) There is a difference between countries in recognizing what is politics and why political education should be supplied; Most countries deal with politics as a individual right and social integration. The facts we found would be helpful to develop new elementary social studies textbook. 이 연구는 해외의 초등학교 사회 교과서를 비교분석함으로써, 개정된 사회과 교육과정에 따라 새로이 개발될 초등학교 사회과 교과서 개발에 시사점을 제공하기 위한 목적으로 수행되었다. 한국, 미국, 일본, 프랑스, 캐나다, 싱가폴의 초등학교 사회과 교과서의 정치관련 부분을 체제, 내용구성, 학습방식의 조직 면에서 비교분석한 결과, 각국은 정치관련 내용이 다루어지는 시기, 편집 방식 및 자료 제시 방식에 차이가 있었으며, 특히 ‘정치’가 무엇이며 ‘정치교육’을 왜 하는가에 대한 인식 면에서 차이가 나타났다. 우리나라와는 달리 비교 대상이 되었던 대부분의 국가에서는 정치를 개인의 권리 보장과 사회 통합의 문제로 보고 제도와 기구는 철저하게 이러한 목적에 봉사하는 도구라는 관점에서 접근하는 경향이 나타났다. 다른 나라 교과서의 이와 같은 경향은 우리 정치교육의 모습을 되돌아보고 바른 정치교육의 상을 잡아나가는데 참고자료로 활용될 수 있을 것이다.

법의식 연구의 경향에 관한 연구 -법의식의 개념을 중심으로-

Legal consciousness is the key factor of LRE. But the result of the studies on this theme lacks integrity because this word has many meanings inside. In this study, to analyse the tendency of legal consciousness studies, former studies classified to three categories : legal culture, law-abiding spirit, law-related attitude. Started with the study of legal culture, studies about law-abiding spirit and legal attitude increased. Especially the dimension of legal attitude expanded because it's useful for finding the minute changes in mind. As a result, three suggestions are made : 1.the exact meaning of legal consciousness should be defined in advance 2.optimized method should be chosen for the definition 3.quantitative method for the study should be more elaborated. 법의식은 법교육의 핵심적인 요소이지만 다양한 의미를 담고 있는 개념이라서 연구결과들이 일관성을 보이지 못하는 문제가 있다. 본 연구에서는 법의식의 개념을 법문화, 준법의식, 법태도의 차원으로 구분하여 기존의 법의식 연구들을 메타적 방법으로 분석하였다. 법의식 연구는 초기 법문화에 대한 연구로 시작하여 점차 준법의식과 법태도에 관한 연구로 확장되고 있으며 최근엔 법태도에 관한 연구가 증가하고 있다. 연구결과 향후 법의식 연구에서는 연구에서 목적하는 법의식의 개념을 분명히 하고 이에 걸맞는 연구방법이 선택되어야 하며 양적 연구의 차원에서는 개념의 조작적 정의와 측정방식이 보다 정교해질 필요가 있음이 확인되었다.

놀이와 법의식의 관계에 관한 연구 - 법교육에의 시사점을 중심으로 -

본 연구는 놀이가 법교육에 주는 시사점을 시론적 차원에서 탐색해보는 것을 목적으로 한다. 이를 위해 문화인류학적 차원과 유아교육의 차원에서 전개되어온 놀이 교육에 관한 기존의 연구 성과들을 법의식의 문제와 접목시켜 다양한 쟁점들을 드러내려 시도했다. 놀이가 초기 사회화 과정에서 유용한 교육적 수단이라는 점은 오래 전부터 주목되어 왔다. 하지만 최근엔 놀이 자체가 삶의 한 측면으로서 그 가치를 인정받아야 한다는 주장들이 힘을 얻고 있다. 법교육의 차원에서 놀이는 규범을 학습하는 훌륭한 매개체로 활용될 가능성이 있지만 동시에 놀이와 현실의 차이점, 놀이가 규범을 맹목적으로 받아들이도록만드는 부정적인 효과에도 충분한 주의가 기울여질 필요가 있다. This study tries to searching for the relationship between 'play' and 'law-related education' on conceptualizing level. Anthropological and Early-childhood Educational approaches are adopted to the matter of legal mind to reveal the various issues. Play has been considered as useful educational method to early socialization. But some scholars insist recently that play should be valued as itself. In the view of Law-related Education, Play could be a effective tool for rule learning. On the other hand, difference between play and real life, and negative effect of blind belief for law should also be considered.
