This study carried out a self-growth group counseling program for children in a group home, and verified the effects of the program. The result of this study is as follows. First, the sociability of the children in the group home that participated in the program became higher than another control group. Second, as a group session, the counseling program children improved their unity and frequency of participation as they took part in the program. Third, individually the counseling program children improved in understanding and acceptance of others. At the same time, their impulses and offensive characteristics became lower causing less troubled behavior.
형사절차상 압수·수색에서 디지털 증거수집의 적정성 확보 방안

생활환경이 디지털 방식으로 전환되면서 범죄 현상 역시 디지털을 기반으로 변경되고 있다. 디지털 증거는 그 증거가치가 높아 과거에 해결하지 못한 사건을 과학적 수사의 힘을 빌려 사건의 진실을 밝히고 있다. 따라서 수사의 불가피성이나 효율성을 위해 디지털 증거의 수집은 점점 증가할 것으로 예측된다. 형사소송법도 2011년과 2016년 개정을 통하여 압수와 전문법칙에 디지털 증거 시대를 맞이하고 있다. 그러나 디지털 증거의 수집에 수반하는 사생활 침해나 정보의 자기결정권 등 기본권 침해의 가능성도 내포하고 있다. 한 디지털 증거는 쉽게 변경·조작될 수 있으며 증거가 법정에 제출될 때까지 동일성이 유지되면서 보존되어야 하며, 디지털 증거는 대량성의 특징을 가지고 있어 정보저장매체를 압수하는 경우에 있어서 압수의 목적이 되는 범죄혐의와 유관한 정보뿐만 아니라 그와 전혀 관련성이 없는 무관정보까지 대량으로 함께 압수될 우려가 있다. 그러므로 피압수자에 대한 프라이버시의 침해와 과잉압수를 제한할 수 있는 방안이 필요하다. 따라서 이러한 문제를 해결하기 위해 영장집행 전체 과정을 통하여 피압수·수색 당사자나 그 변호인에게 계속적인 참여권을 보장하고, 피압수자가 배제된 상태에서의 정보저장매체에 대한 열람·복사를 금지해야 하며, 나아가 복사대상 전자정보 목록을 작성·교부할 해야 할 것이다. 만약 수사기관이 그러한 조치를 취하지 않았다면 특별한 사정이 없는 이상 정보저장매체 또는 그 복사물에 대한 압수·수색은 적법하다고 평가할 수 없으며, 정보저장매체에 수록된 전자정보는 위법수집증거로서 증거능력이 없다고 보아야 한다. Digital evidence reveals the truth of a case that has not been solved in the past because of its high value. As a result, the collection of digital evidence is expected to increase for the ineffectiveness or efficiency of investigations. The Criminal Procedure Act also marks an era of digital evidence in the seizure and professional law through revisions in 2011 and 2016. However, there is also the possibility of infringement of basic rights, such as privacy and the right to self-discovery of information that accompanies the collection of digital evidence. In addition, digital evidence is easily altered and manipulated, and must remain the same until the evidence is submitted to court, and digital evidence has the characteristics of mass information stored Thus, measures are needed to limit the invasion of privacy and excessive seizure of the oppressed.

Arrest-detention system symbolizes the standard of human rights and national elegance. Existing urgent arrest system was made better than before, but it leaves room for improvement. The urgent arrest system is pre-arrest warrant, like the post as well as the act does not warrant requirement. A system for realizing the finality of the investigation as if the exception is applicable only in case of an emergency warrant attention can miss the offender committed a serious crime. Much of criminal charges and arrest warrants in relation to the urgent arrested on criminal charges in the same degree of reason much be substantial. But it can not see each other as equal. Another arrest warrant issued by the examination papers or in the case of an arrest warrant is a direct examination. This must be determined individually. Therefore, a significant reason why criminal charges in a different dimension is bound to be judged separately. According to existing Criminal Procedure Act, the object of urgent arrest is the suspected has committed crime which fulfill over 3 years imprisonment. 87% of whole crimes of crimina law is fulfilled the object of urgent arrest. Therefore urgent arrest which is exception of exception should be decreased the scope. If the urgent arrested system should be introduced arrested after arrest warrants for the post-control then arrested. I think it appropriate to reduce the charge time limit of detention within 48 hours of the current and arrested within 12 hours. For a thorough human rights abolished the system of inspection and approval, we should adopt a system of judicial approval. Further, Systematic improvements of Urgent Arrest necessary, like having more specific criteria and strengthening court’s control in arresting suspects.

Nowadays, in our society there are increasing number of crimes such as “no reason murder” and “child murder.” Therefore, the use of the Stop and Question System has increased in the police. The system is an important and effective method that can be used for crime prevention. But it also has the potential danger of infringing on human rights. In other words, the compulsory use of police’s physical power poses a potential danger to the invasion of individual’s rights. Under article 3 of the Act on the Performance of Duties by Police Officers, a police man is permitted to stop anyone to an inquisition for investigative purposes if the officer believes that the individual is engaged in criminal activity based on a reasonable suspicion. So, the Police Stop and Question inspection system has the following problems. First, the police questioning include the confirmation of identification card such as a driver’s license with no legal grounds. This can be viewed as violating the constitutional rights to privacy. Second, the National Human Right Commission’s position on police questioning says that police questioning is illegal if police officers do not present a police ID. Although the supreme court has recently ruled that a police uniform itself is acceptable as a form of ID, I disagree with this statement due to the fact that a person can easily obtain a police uniform and use this to question whoever they want. In order to improve this system to protect human rights, policeman should always believe that human rights should come first before crime prevention or suspect arrest. The police needs to recover people’s trust on police questioning. In order to do so, in case of police questioning, human right should be superior to crime prevention or suspect arrest.
