영국과 UNIDROIT 협약의 금융리스법에 관한 비교 연구

금융리스의 국제적, 국내적 활용을 증대시키기 위해서 사법통일국제연구소(UNIDROIT)는 국제금융리스에 관한 UNIDROIT 협약(1988) 및 리스에 관한 UNIDROIT 기본법(2008)을 통하여 금융리스거래에 관한 국제규칙을 제정하였다. 하지만 이러한 국제금융리스의 체계 및 법적해석의 통일을 위한 UNIDROIT의 노력에도 불구하고 영국은 UNIDROIT 협약과 기본법의 법적체계와는 다른 방식으로 금융리스거래에 관한 법리를 발전시켜 왔다. 본 연구는 국제금융리스의 이론적인 분석과 함께 영국과 UNIDROIT 협약의 금융리스에 관한 차이점에 관하여 논의하고자 한다. 그리고 이러한 논의를 바탕으로 영국의 금융리스법 개정을 위한 시사점을 도출하고자 하였다. 이를 위해 본 연구는 크게 3부분으로 나뉘었으며, 첫 번째 장에서는 금융리스의 이론적 배경을 살펴보고 본질적인 특성에 관하여 논의하였다. 그리고 둘째 장에서는 영국과 UNIDROIT 협약의 금융리스의 차이점을 살펴보고 법적 특성에 관하여 논의하였다. 세 번째 장에서는 금융리스계약에서의 각 당사자들의 권리와 의무 및 계약위반의 구제에 대해서 논의하고 이에 대한 영국법과 UNIDROIT 협약의 법적해석 및 차이점을 살펴보았다. 그리고 이를 기반으로 하여 영국의 금융리스법에 관한 개정을 위한 시사점을 도출하고자 하였다. In order to encourage the international and national utilization of financial leasing, the International Institute for the Unification of Private Law (Unidroit) has established the international rules dealing with financial leasing transactions through the Unidroit Convention on International Financial Leasing 1998 and the Unidroit Model Law on Leasing 2008. However, despite the efforts of the Unidroit to unify the system and the legal interpretation of international financial leasing, the UK has developed financial leasing in a different way from the legal framework of the Unidroit. This paper aims at providing a theoretical analysis of international financial leasing and discusses differences between financial leasing in the UK and the Unidroit Convention. On the basis of this analysis, this study will look into some ways to reform the law of financial leasing in the UK. Accordingly, it is divided into three main parts. The first part of the study introduces theoretical backgrounds and fundamental features of financial Leasing. Then the second part focuses on differences between financial leasing in the UK and the Unidroit Convention and looks into legal characteristics of them. The third part mainly discusses rights and obligations of each party of financial leasing contract and the concepts of a triangular relationship in English law and the Unidroit Convention. Then, the conclusion suggests some ways to reform the law of financial leasing in the UK.

지구온난화로 인한 기온의 상승은 지구환경에 장기적으로 커다란 위험을 초래하고 있다. 이로 인해 전 세계의 국가 및 지역에서 기후변화의 원인인 GHG의 배출량을 줄이기 위해 힘쓰고 있다. 환경의 개선. 금융산업의 발전, 경제성장을 함께 추구하는 녹색금융은 2015년 파리협정의 체결과 코로나19로 인해 더욱 주목받게 되었는데, 한국이 속한 아시아 지역은 녹색금융의 활성화를 꾀하고 있으며 녹색투자에 대한 수요 또한 매우 높다. 본 연구는 문헌 및 사례연구를 활용해 아시아 지역의 녹색금융 및 녹색투자의 동향을 살펴보고자 하였다. 연구 결과 아시아 지역의 녹색금융은 확산일로를 걷고 있었으며 녹색투자 또한 국가에 따라 정도는 다르지만 대체로 증가하였다. 확산하는 녹색금융에 대응하고 원활한 녹색투자를 위해서는 정부의 배출량 삭감 계획에 맞추어 법규제를 정비하고 녹색금융의 대상을 명확히 해야 할 것이다. 또한 환경규제의 강화와 기후변화 리스크의 금융규제에 대한 반영이 필요하며 기업의 정보공개에 환경적인 요인을 명시하고, 금융기관의 환경관련 전문성을 제고할 필요가 있을 것이다. The increase in temperature due to global warming incurs environmental risk, which triggers the countries keen to reduce GHG emissions that cause climate change. Green finance that aims to improve environment condition, financial development and economic growth has drawn attention under the Paris Agreement and COVID-19 circumstance. Especially Asia shows the incremental stimulation of green finance as well as demand for green investment. This study employed a systematic literature review and case analysis to explore the movement of green finance and investment. The results demonstrate that green finance and investment have been extended and increased depending on the countries. The response for the proliferation of green finance includes the appropriate investment for green policy, regulating the legal limits based on government proposal, and clarifying the targets of green finance. Furthermore, adequate financial and environmental legislation, disclosure of environmental information for organizations, and financial institution expertise are required in Asia.

CT-TDLAS를 이용한 고온 배기가스의 3차원 온도분포 측정

3-dimensional temperature distribution of the exhaust gas of a fire flame of LPG have been measured by the constructed CT-TDLAS system. 3-Dimensional temperature distributions are measured by 2 layers of CT-TDLAS. Each layer has $8{\times}8$ laser beams implying the temperatures of 64 meshes are measured. SMART algorithm has been adopted for reconstructing the absorption coefficients on the meshes. The line strengths at 6 representative wave lengths of $H_2O$ have been used for obtaining the absorption spectra of the exhaust gas. The temperature distributions measured by the constructed CT-TDLAS have been compared with those by the thermocouples. The relative errors measured between by thermocouple and CT-TDLAS were 13% in average and 33% at maximum. The similarity of temperature distribution between by thermocouples and by CT-TDLAS has been shown at the lower layer than the upper layer implying an unstability of combustions.
