한국 경찰의 범죄피해자보호에 관한 연구

국민이 범죄피해를 당했을 때 가장 먼저 생각하고 접하는 국가기관은 경찰이며, 실제 매년 많은 수의 국민들이 피해자로서, 또는 신고자로서 어떠한 도움을 기대하고 경찰을 찾고 있다. 하지만 경찰은 이들의 신고를 바탕으로 증거수집, 범죄자 색출 및 검거라고 하는 기본적인 수사로서 역할을 다 한것으로 보고, 그과정에서 범죄피해자들이 원하는 어떠한 도움을 충족시켜주지 못하였다. 이러한 경찰활동은 법률적으로 문제가 있는 것은 아니지만 국민들이 경찰에 기대하고 있는 바에는 미치지 못하며, 따라서 경찰에 대한 신뢰와 지지를 확보하지 못하는 요인으로 작용하기도 한다. 경찰은 국민을 보호하는 것이 기본임무이며, 경찰의 주요 임무 중 하나인 수사도 국민보호의 차원에서 이루어지고 있는 활동임에는 이론의 여지가 없으며 이러한 경찰의 활동은 피해자의 신뢰와 협력이 없으면 목적을 달성할 수 없으며, 이들 범죄피해자를 위하여 경찰에서도 적극적인 노력을 기울여야 한다. This article describes the reactions to the crime-victim protections by the police as mechanisms of Criminal Justice System for the purpose of protecting the victims. Even though the basic duty of the police is to protect the people from the crimes the police has usually emphasized not on the crime-victims but only on the assaulters. Although crime victims were given an unfair encroachment, they endure prejudice and blame of social. Owing to these situation, most of criminal victims don't reveal the truth honorably and be distressed. It is tried to find the countermeasure toward crime-victim protections in the police on the basis of the practical operation in the advanced countries.

Pupose: Domestic violence is not a problem only for those families who have experienced violence. The problem is now a need for systematic management in the nation. Article 36 (1) of the Constitution of the Republic of Korea stipulates that 'marriage and family life shall be established and maintained on the basis of individual dignity and equality of manners, and that the state shall guarantee this.'. Since domestic violence harms the dignity of individuals, so now the state should protect and the police should be at the forefront. It is time for the police to take a leading role in the collaboration of NGOs and agencies in active community-based prevention and response. The purpose of this research is to examine the problems in the role of police and to draw up strengthening plans accordingly. Methods: In 2016, police officers focused on the safety of women, such as women, senior citizens, and children, focusing on police force to prevent crimes against women. In our society, however, the domestic violence has increased rather than decreasing. Given this, one should not recognize the dangers of domestic violence and no more disregard or neglecting. Therefore, the research, aims to determine the role of police to safety home security through analyzing domestic violence through official statistical data. Conclusion: Police should first increase the awareness of the public and police about domestic violence and increase the number of domestic violence officers who have been strengthened and professionally educated about domestic violence. And the domestic violence perpetrator who violates the emergency interim measures should play a leading role in protecting the family safety through strengthening roles such as forcing. 연구목적: 가정폭력은 폭력이 일어난 그들 가족만의 문제가 아니다. 이제는 국가가 체계적으로 관리해야할 문제인 것이다. 대한민국 헌법 36조 1항을 보면 ‘혼인과 가족생활은 개인의 존엄과 양성의 평등을 기초로 성립되고 유지되어야 하며 국가는 이를 보장해야한다.’라고 명시되어 있다. 폭력이라는 행위를 통해 개인의 존엄을 무너뜨리는 가정 폭력을 이제는 국가가 나서서 보호해야하며 그 최일선에는 경찰이 있어야 할 것이다. 지역사회를 기반으로 하는 적극적인 예방활동과 대응에 있어서 각 기관 및 시민단체들과의 협업에 있어서 경찰의 주도적인 역할이 필요한 때이다. 이를 위하여 경찰 역할에서의 문제점을 살펴보고 그에 따른 강화방안을 도출하는데 연구의 목적이 있다. 연구방법: 실제 2016년에 여성과 노인, 아동 등과 같은 사회적 약자의 안전에 대한 경찰 활동이 집중되고, 여성범죄예방을 위해 경찰력을 집중 투입하였음에도 불구하고 가정폭력은 우리 사회에서 오히려 줄어들지 않고 증가하는 추세를 보이고 있음을 고려할 때, 가정폭력의 위험성을 다각적으로 인식하고 더 이상 방치하거나 외면해서는 안된다. 따라서 본 연구는 공식적인 통계자료를 통한 가정폭력의 현황 분석을 통해 가정안전을 지키기 위한 경찰의 역할 강화방안을 도출하기로 한다. 결론: 경찰은 우선적으로 가정폭력에 대한 국민과 경찰관의 인식개선, 강화된 전문 교육을 받은 가정폭력 전담경찰관 인원 증원, 긴급임지조치 위반 가정폭력 가해자에 대한 강제력 행사와 같은 역할 강화를 통해 가정안전을 지키기 위한 역할을 주도적으로 해나가야 한다.

아동학대의 통합적 접근방법에 따른 경찰 역할 강화방안

우리나라는 2000년 아동복지법의 전면개정으로 아동학대 보호체계에 관한 법률적 근거를 마련하였지만, 현재까지 아동학대는 근절되지 않고 지속적으로 증가하였을 뿐만 아니라 중요한 사회문제로 간주되어지고 있다. 이에 정부는 2014년 우리사회 아동학대 예방과 피해아동 보호체계를 정책과제로 설정하여 아동학대에 대한 예방․홍보강화, 조기발견 및 신속한 대응체계 구축, 지역사회 복지자원과의 연계를 통한 아동학대 사후관리서비스 강화와 같이 구체적으로 방안을 제시한 아동학대 종합대책을 발표하였고, 2016년 계속되는 아동학대범죄를 계기로 종합대책에서 제대로 시행되지 않고 있던 아동학대에 대한 신속한 대응과 처벌의 강화, 피해아동에 대한 보호와 지원 및 재학대방지, 생애주기별 아동학대 예방체제강화 등과 같은 아동학대방지 대책을 발표하였다. 정부의 종합대책은 아동학대 대응방식에 관한 접근방법 중 아동학대는 조기개입과 예방사업의 활성화, 가정에 대한 지원을 포함하여 모든 지원은 연속선상에서 있어야 한다고 주장하는 통합적 시스템과 그 맥락을 같이 하는 것으로, 아동과 위험에 초점을 맞추고 아동학대가 발생한 상황에서 아동을 위험으로부터 구출하는 것에 초점을 맞추고 있는 이분법적 시스템과는 차이가 있다. 종합대책과 방지대책을 수립하기 전에는 아동학대 관련기관별 이분법적 시스템과 유사한 대응 방식을 취하였으나, 통합적 시스템을 적용하는 것으로 아동보호체계가 전환되었음도 불구하고, 아동보호체계가 신고조사를 기반으로 한 시스템을 벗어나지 못함으로 인하여 여전히 각 기관별 아동학대 수행체계는 이분법적 시스템을 유지하고 있으며, 특히 경찰의 경우 사전 예방이나 조기개입에 대하여 제한적일 수 밖에 없고, 아동학대 발생시 현장에서도 여러 가지 제약들 때문에 적극적으로 대응하지 못하고 있어 아동학대에 소극적 대응을 할 수 밖에 없는 실정이다. 따라서 현재 우리나라 아동학대보호체계의 통합적 시스템에 따라 경찰에서는 아동학대에 대한 인식전환이 반드시 필요하며, 홍보, 교육, 사전인지를 위한 지역사회경찰활동과 같은 적극적인 아동학대 예방활동 참여, 그리고 반복적이고 고위험성 학대행위에 대한 적극적 대응이 필요하다. In Korea, the Act provided a legal basis for the protection of children's abuse of child abuse by revising the Child Welfare Act in 2000, but child abuse is not eradicated, and is considered to be an important social issue. In 2014, the government announced comprehensive measures to prevent child abuse and child abuse by setting the protection system for abused children as a policy task. Which focuses on children and risk, and differs from a dichotomy system that focuses on rescuing children from danger in the event of child abuse. Prior to establishing comprehensive measures and preventive measures, we took a similar approach to child abuse and related bipartite systems. However, despite the change of the child protection system by applying the integrated system, The child abuse system still maintains a dichotomy system for each institution. In particular, the police are limited in terms of prevention and early intervention, and in the case of child abuse, they are still unable to actively respond to various restrictions in the field, so they are still responding to the dichotomous system. Therefore, according to the integrated system of child abuse, the police must change the awareness of child abuse, participate actively in child abuse prevention activities such as community policing for publicity, education, and prior recognition, We need an active response.

The purpose of this research is to establish ways and means needs to improve the police disaster management system in Korea. Our country is suffering natural disaster by sudden change of natural environment and weather surrounding, and danger of disaster that is social danger factor by after this economy development plan and large size anger of equipment construction by propulsion of industrialization policy, population congestion anger and economic growth in the 1960s is ever-present. When a disaster happens, it dose so in local jurisdiction. Police agency should develop and maintain a program of disaster management to meet their responsibilities to provide the protection and safe of the public. The disaster administration must convert and minimize damage by disaster to police disaster system for preliminary provision in past rehabilitation balance. This research improve for the specialzation of police disaster management and reduces possibility of disaster occurrence and attemper the degree before disaster happens, and there is the purpose to grope that solidify police activity laying stress on present police's disaster connection complete charge countersignature and prevention of crimes activity of role, collection of disaster information, disaster education and training, disaster education program, security of equipment, police role of disaster place to do to minimize damage through quick confrontation that disaster happens after. 현재 재난은 우리나라에서만 발생하는 것이 아님에도 불구하고, 우리사회에서는 1990년대 중반이후 재난이 중요한 사회적 이슈로 자리잡아 오고 있을 만큼 재난은 생활의 안전을 위협하는 여러 가지 요소들 중에서 그 중심에 자리잡고 있으며 국민들에게 재난의 발생은 더 이상 새롭거나 놀라운 사건으로 인식되어지지 않고 있다. 하지만 재난은 국가의 관리노력에 의하여 예방되어질 수 있거나 그 피해를 최소화할 수 있다고 생각하기 때문에 재난의 피해규모가 크고 광범위할수록 국민이 느끼는 좌절과 공포는 과거에 비해 더욱 더 크다고 할 수 있다.최근 국민의 안전의식을 고취하고 높은 안전을 보장받기 위하여 경찰의 적극적인 활동이 요구되는 추세에 따라 경찰은 좁은 의미의 소극적인 위험방지를 위한 명령강제나 범인의 체포수사와 같은 법집행적인 임무뿐만 아니라, 적극적인 서비스 활동을 통해 국민에게 봉사하는 역할을 강화하고 있다.이 연구는 재난이 발생하기 이전에 재난발생의 가능성을 줄이고 그 정도를 완화시키며, 재난이 발생한 이후에는 신속한 대응을 통해 그 피해를 최소화시키기 위하여 현재 경찰의 역할 중 재난관련 전담부서와 경찰의 재난관련 방범활동, 재난관련 교육훈련과 장비의 확보, 재난발생시 현장중심의 경찰역할을 중심으로 경찰활동을 강화하는 것을 모색하는데 그 목적이 있다.

학교폭력에 대한 경찰역할 강화방안

Although school violence is not a newly happened problem, these days we pay a lot of attention to school violence, nowadays occurred in and around a school, owing to its occurrence frequency and seriousness in quality. This study based on yield problems, the preventive measures of school violence with main focus on legal and systematical complementing areas and educational system and means for maximizing the function of police control.
