        가설건축물 제도의 문제점 및 개선방안 연구

        최근 가설건축물 허가 및 신고건수가 지속적으로 증가하고 있지만 명확한 법적 기준이 부재하여 가설건축물 관련 민원은 지속적으로 발생하고 있다. 이러한 문제를 해결하기 위하여 본 연구는 국토교통부에 접수된 민원과 관원질의, 지자체 담당자 건의사항 등을 분석하여 제도 운영상의 한계를 파악하고 제도 개선사항을 제안하였다. 민원·관원분석과 지자체 담당자들이 제시한 건의사항 분석을 통해서 본 연구에서는 정의 및 범위 관련, 존치기간 관련, 불법 가설건축물 관리 3가지 차원의 쟁점을 도출하였다. 첫째, 가설건축물에 대한 정의가 명확하지 않아 가설건축물 관련 법령해석에 대한 질의 성격의 민원이 다수 발생하고 있으며, 지자체마다 가설건축물을 허용하는 기준이 달라 국민의 불편을 야기하고 있다. 둘째, 대부분의 가설건축물은 존치 기간 내 연장 신청을 하면 횟수 제한 없이 영구 사용이 가능하여 대부분의 가설건축물을 영구적으로 사용하고 있다. 마지막은 불법 가설건축물 관리의 한계이다. 허가 또는 신고 없이 무단으로 사용하거나 존치기간이 만료된 가설건축물에 대한 문제제기가 지속적으로 이루어지고 있지만 지자체의 인력 부족으로 적극적인 불법 가설건축물 관리가 어려운 상황이다. 이러한 제도적 한계를 개선하기 위해서는 쟁점별로 다음과 같이 제도개선이 이루어져야 할 것이다. 첫째, 건축법상에 가설건축물을 구분하는 원칙과 기준을 명확히 해야 한다. 둘째, 가설건축물의 존치기간을 설정하고 시설 유형 특성을 고려하여 존치기간 설정 원칙을 마련해야 한다. 셋째, 불법 가설건축물에 대한 처벌 규정 강화와 같은 제도 차원의 대응과 함께 가설건축물을 효율적으로 관리할 수 있는 행정 시스템의 보완과 관련 절차에 대한 자세한 안내와 교육이 지속적으로 추진되어야 할 것이다. While the issuance of permits and reports for temporary buildings has been steadily rising in recent years, complaints linked to them persistdue to the absence of well-defined legal benchmarks. To address these issues, this study scrutinizes civil grievances directed at the Ministryof Land, Infrastructure and Transport, along with inquiries from officials and suggestions originating from local government representatives. By examining these inputs, the analysis pinpoints shortcomings within the system’s operation and proposes improvements. Through anexploration of both civil complaints and official perspectives, this study delineates three critical dimensions of concern: definition and scope,retention period, and the management of unauthorized temporary buildings. First, ambiguity envelops the definition of temporary buildings,leading to numerous disputes concerning the interpretation of pertinent laws and regulations. Second, a vast majority of temporary buildingscan essentially be employed indefinitely through successive extension requests within the stipulated validity period, thus effectively enablingpermanent utilization. Lastly, constraints are evident in the oversight of unauthorized temporary constructions. Although issues arise regardingstructures lacking proper permissions for those exceeding their permissible duration, actively managing these illegal structures proveschallenging due to the manpower constraints faced by local governments. To mitigate these institutional limitations, specific enhancements arerecommended for each concern. The first entails clarifying principles and standards for categorizing temporary buildings within the BuildingAct. Next, establishing retention periods for temporary buildings should be guided by the features of facility type. Finally, continued effortsin institutional responses are essential. This involves bolstering punitive regulations for unauthorized temporary structures, fortifyingadministrative systems for efficient management, and sustaining comprehensive guidance and education on relevant procedures in tandem withsystemic reforms.

        바이오플락 및 일반 해수에서 질산염의 넙치 (Paralichthys olivaceus)에 미치는 급성 독 성 및 혈액학적 성상의 변화

        Juvenile Paralichthys olivaceus (mean length 19.8±2.6 cm, mean weight 97.8±15.8 g) were exposed for 96 hours to different nitrate concentrations of 0, 62.5, 125, 250, 500, 1,000, and 1,500 mg L-1 in biofloc and 0, 62.5, 125, 250, 500, and 1,000 mg L-1 in seawater. Median lethal concentration values (LC50, the concentration at which 50% of mortality occurred after 96 hours of exposure) of nitrate to P. olivaceus in biofloc and seawater were 1,226 and 597 mg NO3 L-1 (P<0.05), respectively, revealing a higher toxicity of nitrate to P. olivaceus in seawater than in biofloc. In hematological parameters, hematocrit level in P. olivaceus exposed to nitrate was significantly increased only at a concentration of 1,000 mg L-1 in biofloc and at concentrations higher than 250 mg L-1 in seawater, but no significant changes in hemoglobin were found in biofloc and seawater. In plasma parameters, aspartate aminotransferase (AST) and alanine aminotransminase (ALT) were significantly increased by nitrate exposure in biofloc and seawater, but no significant changes in alkaline phosphatase (ALP) were found in biofloc and seawater. Results of this study indicate that nitrate exposure to P. olivaceus have a lethal toxic effect and alter hematological and plasma constituents of flatfish P. olivaceus. Given relatively lower toxicity of nitrate in biofloc than in seawater, the use of biofloc in aquaculture may reduce potential toxic effect caused by nitrate in feces and feed residue.

        동네 가게의 사회 기능과 역할 변화에 관한 연구 - 서울 해방촌의 소규모 판매점을 중심으로

        This study is based on a qualitative research about the social functions and roles of the neighborhood small shops in Hae-bang-chon. Employing basic qualitative data collection tools such as interviews and participant observations, the study attempts to illustrate the new, additional social activities that the small shops carry out besides the old ones. The research findings are as follows : First, roles of small stores as a ‘hub’ for social interactions and fostering community activities in the neighborhood have been remarkably reduced. On the other hand, the stores were still being used as a community gate for the newcomers and as a place to offer important sources of information. Second, roles of shops as an essential infrastructure of the neighborhood have also been weakened. However, small stores serve a particularly valuable role in meeting the needs of disadvantaged groups of elderly and disabled consumers. In other words, they support selections of goods for the community and provide accessibility within reach. Also, the elderly groups have been using the store as a public place to make contact with community. 본 연구는 일반적으로 동네나 골목에서 중요한 장소로 지목되어 왔던 소규모 판매점의 사회기능과 역할을 공동체간 사회 활동의 변화와 가게 주인의 생애사를 매개로 조망한 질적 연구이다. 연구의 핵심 자료는 현장관찰과 심층 인터뷰를 통하여 수집하고 분석하였으며, 이북 실향민을 중심으로 한 지연(地緣) 공동체를 포함하여 외국인이나 대안적 삶을 지향하는 젋은이들과 같은 다양한 공동체가 구축되어 있는 서울 해방촌의 소규모 판매점을 대상으로 연구를 수행하였다. 연구 결과, 해방촌 가게의 사회기능과 역할은 두 가지 측면에서 변화된 것으로 나타났다. 첫째, 가게의 근린 내 사회활동 구심점으로서의 역할은 약화되었다. 그렇지만 가게는 여전히 새로운 구성원이 공동체로 접근할 수 있는 커뮤니티 게이트로 작동하고 있으며 구성원에게는 다양한 정보를 제공하는 역할을 수행하고 있다. 둘째, 근린 내 여러 가지 서비스를 복합적으로 지원하던 해방촌 가게는 단순 소매상점으로 그 기능을 단순화하면서부터 복합 생활거점의 지위를 상실하였다. 그럼에도 불구하고 동네 가게는 근린 내 사회, 경제적 약자들의 상품 선택과 접근을 지원하고 있으며, 특정 구성원들에게는 여전히 중요한 공공장소로 활용되고 있다.

      • 가설건축물 제도의 문제점 및 개선방안 연구

        Recently, the number of temporary building permits has been continuously increasing. However, complaints related to temporary buildings continue to occur due to the absence of clear legal standards. In order to improve these problems, this study analyzed complaints related to temporary buildings and suggestions from local government officials to identify limitations in system operation and discover system improvements. As a result of the analysis, there are three issues derived: definition and scope dimension, installation period dimension, and illegal temporary building management dimension. The improvement directions for each issue are as follows. First, it is necessary to clarify the principles and standards for distinguishing temporary buildings in the Building Act. Second, it is necessary to clarify the regulations on the period of use of temporary buildings and to present the principle of establishing the period of existence in the law in consideration of the characteristics of the type of facility. Third, the punishment regulations for illegal temporary buildings should be strengthened.

        ‘아파트지구’ 초기 계획 지침 분석을 통한 1970년대 단지계획 기법 연구 - 영동아파트지구종합개발계획의 사례분석을 중심으로

        ‘아파트지구’ 제도 도입 이후 ‘아파트지구개발기본계획’ 수립이 의무화되었으며, 서울시가 영동아파트지구 종합개발계획을 수립하는 과정을 통하여 주거지계획 수립의 기초를 마련한 의의가 있으나, 선행연구들은 단순히 현재의 자족적, 폐쇄적 아파트 단지계획의 관행화에 일조했다는 결과를 기반으로 비판해왔다. 이에 본 연구는 우리나라 대단위 공동주택 주거지개발과정에서 ‘아파트지구’ 제도를 통해 실현된 계획기법이 가지는 의미를 새롭게 조명하기 위하여, ‘아파트지구’의 개발 방향을 설정을 위해 서울시가 수립한 영동아파트지구 종합개발계획의 계획 다이어그램과 내용을 심층적으로 분석하였다. 영동아파트지구종합개발계획은 상업시설 중심의 근린주구 중심 제안, 고밀한 생활환경 조성을 위한 보행자몰 조성, 효율적 공간 활용을 위한 공원녹지 배치 기준 마련, 주거단지 경관 관리 계획 도입, 주거동 배치 다양화를 위한 배치 유형과 원칙 제시 등 5가지 차원에서 구체적인 계획 내용과 이를 설명하기 위한 다이어그램을 함께 제안하였다. With the introduction of the ‘apartment district’, the Seoul Metropolitan Government decided to produce the Comprehensive Development Plan for the Yeongdong Apartment District to set the Master Plan directions. However, most experts have been critical of the ‘apartment district’s introduction and outcome across the country, arguing ‘apartment district’ system has contributed to promoting the country’s current self-sufficient, and exclusive apartment complex plan. Hence, this study has attempted to shed new light on the roles and significance of the ‘apartment district’ system by analyzing the planning diagram. The Yeongdong apartment district masterplan proposed detailed plans for five aspects : the proposal for neighborhood unit focused on commercial facilities centered on commercial facilities, the detailed providing guidelines for creating pedestrian malls, the establishing standards for efficient layout of park and green space, the presentation of a district-wide skyline management scheme and the suggestion of the types and principles of layout for the diversification of residential buildings.

        목동신시가지 아파트 단지의 공간 분리 특성

        The objective of this study was to determine the reason behind the phenomenon of Mok-dong New Town, an area developed with large-scale complex. It is divided from its surrounding area although it is not following the space grammar of a gated community. In-depth interviews with residents of Mok-dong New Town were performed. Information obtained from these interviews was used to identify main elements that caused residents to divide the residential territory. Results are as follows. First and foremost, visible and invisible boundaries of the Mok-dong New Town were formed on the basis of basic units in the planning and spatial operating system used to develop the large complex. Homogeneous territories and similar landscapes assumed the role of a physical fence. Administrative system including uniformed address system, the same apartment complex name, and separate management of school districts operated as non-physical aspects of a gate. Second, invisible boundaries such as community consciousness and neighborhood relations were stronger than visual boundaries such as gates and fences in Mok-dong New Town. Lastly, the concept and elements of the large-scale complex development plan were directly bound to the Mok-dong New Town. It also formed a boundary in a secondary way through limiting the range of daily life and neighborhood relations. The significance of this study is as follows. First, collection and analysis of data of this study were based on perceptions of actual residents. Second, actual condition and operation of Korean space separation were interpreted in connection with planning elements of large apartment complexes as well as social, cultural, and institutional contexts.

        The structural changes of pharyngeal airway contributing to snoring after orthognathic surgery in skeletal class III patients

        Background Two-jaw surgery including mandibular and maxillary backward movement procedures are commonly performed to correct class III malocclusion. Bimaxillary surgery can reposition the maxillofacial bone together with soft tissue, such as the soft palate and the tongue base. We analyzed changes of pharyngeal airway narrowing to ascertain clinical correlations with the prevalence of snoring after two-jaw surgery. Methods A prospective clinical study was designed including a survey on snoring and three-dimensional (3D) computed tomography (CT) in class III malocclusion subjects before and after bimaxillary surgery. We conducted an analysis on changes of the posterior pharyngeal space find out clinical correlations with the prevalence of snoring. Results Among 67 subjects, 12 subjects complained about snoring 5 weeks after the surgical correction, and examining the 12 subjects after 6 months, 6 patients complained about the snoring. The current findings demonstrated the attenuation of the largest transverse width (LTW), anteroposterior length (APL), and cross-sectional area (CSA) following bimaxillary surgery given to class III malocclusion patients, particularly at the retropalatal level. The average distance of maxillary posterior movements were measured to be relatively higher (horizontal distance 3.9 mm, vertical distance 2.6 mm) in case of new snorers. Conclusions This study found that bimaxillary surgery could lead to the narrowing of upper airway at the retropalatal or retroglossal level as well as triggering snoring in subjects with class III malocclusion. Based on the current clinical findings, we also found that upper airway narrowing at retropalatal level may contribute to increasing the probability of snoring and that polysonography may need to be performed before orthognathic surgery in subjects with class III malocclusion.

        암모니아 급성노출에 의한 바이오플락 사육 넙치(Paralichthys olivaceus)의 혈액학적 성상 및 항산화반응의 변화

        Flatfish Paralichthys olivaceus raised in biofloc system (mean length 27.6±3.1 cm, mean weight 280.4±26.5 g) wereexposed for to different concentrations of ammonia (0, 8, 16, 32, and 64 mg NH4+/L) for 7 days. Following ammoniaexposure, hematological parameters such as hemoglobin and hematocrit were significantly reduced. Plasma componentssuch as magnesium, glucose, aspartate aminotransferase (AST), and alanine aminotransaminase (ALT) weresignificantly altered by ammonia exposure, whereas there were no significant changes in calcium, cholesterol, or totalprotein. Antioxidant responses, such as superoxide dismutase (SOD) and catalase (CAT) levels were significantlyelevated following ammonia exposure. The results of this study indicate that ammonia exposure induces significantchanges in hematological parameters and antioxidant responses in biofloc-reared Paralichthys olivaceus as a toxicresponse.

        The purpose of this study is to understand the accessibility of residents in external areas by confirming the composition of the boundary of the special architecture district. The special architecture district has the institutional characteristics of a plan to grant freedom of design and secure publicity by easing regulations of the building act. To ease regulations, apartment complexes in Seoul were designated as special architecture district. As a reward for the incentives, the apartment complex has promised to open community facilities in the complex to local residents. However, the promise is often not kept well. In this study, the composition of the boundary is confirmed as a dimension of physical accessibility verification.
