FCC의 무선통신서비스분야 간접적 외국인투자 규제 변화의 특징과 정책적 시사점

우리나라는 미국과 EU와의 FTA에서 기간통신서비스에 대한 외국인투자 제한을 일부 완화하여 국내법인을 통한 간접적 투자의 경우 공익성심사를 통과하면 투자한도를 현행 49%에서 100%까지 확대하기로 약속하였고 이에 따라 올해 6월말까지 관련 법령을 개정할 예정이다. 한편 미국은 무선통신서비스분야의 간접적 투자와 관련하여 외국인투자자와 무선국 허가자에게 초래되었던 지연, 불확실성, 비용 등의 문제점을 개선하기 위하여 2011년부터 FCC 관련 규칙의 개정을 추진하고 필요한 결정을 내리고 있다. 이러한 맥락에서 이 글은 간접적 투자 규제와 관련된 여러 가지 요소들을 살펴보고 보고 현재 진행 중인 FCC의 관련 제도 개선 작업이 우리에게 제시해 줄 수 있는 여러 시사점들을 도출해 보았다. 우선 간접적 직접투자관계에서 외국인직접투자(FDI)를 인정하는 세 가지 방식들, 즉 ‘직접투자관계체계 방식’(FDIR), ‘참여 지분 곱셈 방식’(PMM), ‘직접 영향력/간접 지배력 방식’(DIIC) 등을 비교한 후 우리나라 전기통신사업법의 기간통신서비스분야 간접 FDI 규제 방식과 미국 1934년 방송통신법의 무선통신서비스분야 간접FDI 규제 방식의 특징과 규제 수준을 파악하였다. FCC는 무선국 허가에 대하여 ‘지배력 있는 간접 FDI 사안’에는 1934년 방송통신법 310(b)(4)조를 적용하고 ‘지배력 없는 간접 FDI 사안’에는 310(b)(3)조를 적용해 왔는데, 매개회사의 무선국 허가자에 대한 지배력 유무에 따라 간접 FDI 사안에 적용되는 규정이 상이한 문제점을 해소하기 위하여 ‘지배력 없는 간접 FDI 사안’에 310(b)(4)조에서와 유사한 공익성심사 통과를 조건으로 310(b)(3)조의 적용을 보류하기로 한 FCC의 결정에 주목하였다. FCC의 간접 FDI 규제 방식이 개선됨에 따라 우리의 간접 FDI 규제 완화도 예측가능성과 투명성을 높이는 방식으로 진행될 필요가 있을 것이다. 이러한 미국의 제도 개선 방향을 벤치마크 삼아 우리도 간접적 투자 확대를 위한 세부 요건을 엄격하게 마련하고 집행함으로써 새로운 제도가 공공의 이익을 보호하고 외국인투자자에게 우회적으로 악용되지 않는 방식으로 운영될 수 있도록 노력해야 할 것이다. To implement the commitments under the Korea ? EU FTA and the Korea ? US FTA, Korea should raise the ceiling for indirect foreign investment in facilities-based public telecommunications services from 49% up to 100% under the terms, conditions and limitations. In the meantime, since 2011 the FCC has reviewed its policies and procedures that apply to indirect foreign ownership of common carrier radio licensees under sections 310(b)(3) and 310(b)(4) of the Communications Act of 1934 so as to ensure consistency in treating indirect foreign ownership in the licensees. In this context this article introduces three methods for identifying the extent and type of indirect foreign investment relationships such as the Framework for Direct Investment Relationships (FDIR), the Participation Multiplication Method (PMM) and the Direct Influence/Indirect Control Method (DIIC), envisages the features and policy implications of the changes in the FCC’s regulations on indirect foreign investment in the licensees, and discusses how Korea’s regulatory changes should be made in order to ensure greater transparency and more predictability and facilitate investment from new sources of capital, while continuing to protect important public interests.

이 글은 한-미 FTA 통신서비스 기술·표준조치 조항(제14.21조)을 해석하여 양 당사국이 보유하는 통신서비스 기술·표준조치 권한의 내용과 그 한계를 수단-목적 심사의 관점에서 풀이하였다. 또한 한-미 FTA 제14.21조의 특징을 도출하기 위하여, NAFTA와 GATS(통신부속서와 통신참조문서) 그리고 2015년 7월 현재 한국이 체결한 총 14건의 FTA 통신협정문에서 규정된 통신장비·통신서비스 관련 기술요건 조항을 간략히 비교 ·분석하였다. 한-미 FTA 제14.21조는 당사국의 기술·표준조치 권한에 "불필요한 장애를 초래하지 않을 요건"을 부과하고, 규칙제정과 연계하여 사전·사후적 투명성 의무를 부과함으로써 상대적으로 "통신사업자의 기술 선택의 유연성"에 더 큰 비중을 부여한 것으로 평가될 수 있다. 반면에 한-호주 FTA의 통신서비스 기술·표준조치 조항(제9.22조)은 1) 기술·표준조치의 채택에 관한 사전·사후적 투명성 의무를 부과하지 않으며 2) 당사국이 정당한 공공정책 목적을 정의할 권리를 제한 없이 인정하고 3) 기술·표준조치가 관련 국제표준에 기초하는 경우에는 무역에 불필요한 장애를 초래하지 않는다는 반박가능한 추정을 부여한다는 점에서 볼 때 "기술·표준조치 권한"과 "기술 선택의 유연성"을 한-미 FTA 제14.21조보다 더 균형 있게 보장하고 있다. 따라서 더욱더 조화로운 기술·표준조치 조항이 WTO/FTA 포럼을 통해 개발될 수 있도록 하기 위해서는 한-호주 FTA型 통신서비스 기술·표준조치 조항이 미국式 FTA 통신챕터의 "기술 선택의 유연성 조항"에 대한 적절한 대안으로서 활발히 논의될 필요가 있다. The purpose of this article is to examine the balance between the sovereign right to regulate technologies for legitimate public policy objectives and the value of allowing telecom operators flexibility in choosing the technologies that they use to supply their services. To this end, the article attempts to anlayze Article 14.21 of the KORUS FTA entitled "Measures Concerning Technologies and Standards" and compare it with Article 9.22 of the Australia-Korea FTA with respect to 1) the means-and-ends tests(including the necessity test) developed by the U.S. Supreme Court, the Court of Justice of the EU and the WTO Appellate Body; 2) the right to define its own legitimate public policy objectives; 3) the legat consequences of using relevant international standards as a basis for a measure concerning technologies or standards; and 4) whether a rulemaking proceeding must be initiated before and after adopting such a measure. This comparative analysis suggests that Article 9.22 of the Australia-Korea FTA strikes a balance between the regulatory right and the choice of technologies in a more desirable and appropriate way that Article 14.21 of the KORUS FTA. The article envisages a gradual advancement and expansion of the type of Article 9.22 of the Australia-Korea FTA in the future.

최근 필라멘트 전구를 대체할 광원으로 주목받고 있는 LED 전구에 대한 광학특성을 평가하여 그 결과 값을 광학설계 Software에 입력하고, LED 전구의 실제 측정값과 Simulation 값을 비교한 후 LED 전구의 배광분포를 변화시키기 위한 2차 광학계를 설계하였다. 이 때 2차 광학계는 LED 전구의 높이를 최소화하기 위해 평면 Lens인 Fresnel Lens로 설계하였으며, 재질을 투명한 재질과 확산재질을 적용하여 배광분포와 전광선속 등의 광학특성을 비교 분석하였다.

In this paper, we studied general sound characteristics of each HVAC components. We set up the experimental method of sound characteristics by the variance of air flow volume. According to this experiment we found the relationship of air flow volume and HVAC noise. Also we found contribution portion of each HVAC component for the whole HVAC system air rush noise and effects of air path cross section area.

Inter-floor noise in an apartment building is a serious problem that causes conflicts between tenants. Accordingly, there are various attempts to solve this problem, but it is not easy to find a clear solution. Therefore, in this study, a soundproofing material between floors was developed that can improve the sagging that occurs after construction. And as a result of testing the developed interlayer soundproofing material, both light weight and weight were grade 1. And it was analyzed that maintenance performance could be improved with integrated structural characteristics.

In this paper, we present the hitting noise generation mechanism of discharge valve on swash-plate type compressor. Also we found primary parameters which affect the hitting noise of discharge valve. Main factors of operating noise were identified by both FEA of internal component and acoustic cavity resonance of discharge chamber as well as experimental validation. According to this study, operating noise of swash-plate type compressor could be improved obviously by optimal design of discharge valve system and the hardness of disc rubber. Finally, based on this study, we could reduce clearly operating noise of compressor and hitting noise mechanism of swash-plate type compressor was studied.
