      • 경성 비내시경을 이용한 기관이물 및 육아조직 제거 2례

        Previously, we used a rigid bronchoscope in removal of endotracheal granulation tissue and foreign body. But these method has poor visual field and difficulty in handling of the instruments, therefore there were restriction in removing the endotracheal granulation tissue and foreign body. Recently we underwent one case each of endotracheal granulation tissue and foreign body causing dyspnea and removed them by right angled forceps under visualization via nasal rigid endoscope inserted through the tracheal stoma. We suggest this method for removal of tracheal foreign body, granulation tissue and excision of tumorous condition in patients with tracheocutaneous fistula.

        특허 라이선스 계약에서 라이선시 보호의 검토시 고려사항 - 라이선서의 파산 또는 특허권 양도의 경우 -

        비밀유지 의무, 고비용, 절차 번잡, 라이선서의 등록협력 의무의 부존재 등의 원인으로 인하여 우리나라의 라이선스(통상실시권) 등록 제도가 활용되기 어려운 상황에 있고, 라이선스의 등록률 또한 저조하다. 따라서 사실상 대부분의 라이선스가 미등록이라 볼 수 있고, 이러한 미등록 라이선시는 등록이라는 대항요건을 구비하고 있지 못하기 때문에, 라이선서의 특허권 양도의 경우에는 제3자 양수인에게 대항하지 못하고, 또한 라이선서의 파산의 경우에는 파산관재인의 해제권을 제한하지 못하거나 파산관재인의 특허권 양도의 경우에 양수인에게 대항하지 못하게 되어, 라이선시의 지위가 매우 불안정한 상태에 있게 되는 문제점이 있다. 이러한 라이선시 보호의 문제점으로 인한 라이선시 지위의 불안정은 라이선시 개인의 불이익일 뿐만 아니라 사회경제적으로도 불이익이므로, 라이선시 보호의 필요성이 있다고 볼 수 있다. 그러므로 라이선시 보호의 방안을 제도적으로 마련할 필요가 있는데, 라이선시 보호를 위해 어떠한 방안을 강구할 것인가라는 논제에 대한 접근을 위해서는 선행적으로 라이선시 보호의 검토시 고려해야 할 사항이 무엇인지에 대한 연구가 전제되어야 한다. 이러한 고려사항으로 일본에서의 논의를 근거로 하여 본 논문에서는 ① 대립되는 이해관계의 균형의 관점, ② 타법과의 조화의 관점, 그리고 ③ 절차의 효율의 관점을 구체적으로 제시하였다. The duty of confidentiality, high costs, complicated procedure and the absence of licensor’s duty of cooperation for the registration all contributed to the under-utilization of the license registration system in Korea, which in turn resulted in the ratio of registration of licenses. Therefore, practically most of the licenses are unregistered, which render the status of the licensee extremely unstable because of the lack of perfection of license through registration: It makes the licensee impossible to resist the assignee upon assignment of patents by licensor to a third party, to restrict, upon bankruptcy of the licensor, the exercise of the power of termination of license of the bankruptcy trustee, or to challenge the assignee upon assignment of patents by the bankruptcy trustee. These problems of the protection of the status of the licensee are not only disadvantageous for individual licensees but also greatly hamper the social and economical sense of justice, making the task of protecting the licensee more urgent and necessary. Therefore, the methods and strategies of protecting the rights of the licensee must be institutionalized systematically, but the issue of the most desirable method of the protection of the licensee must be approached only after properly investigating and answering matters that require serious consideration when devising methods of protection of the licensees. As parts of these considerations, this thesis presents, based on researches in Japan, the following three perspectives in detail: ① balancing of conflicting interests, ② harmony with other laws and regulations and ③ procedural efficiency.

        지적재산 라이센스 계약에서 라이센시 보호에 관한 연구: 법정실시권 제도의 활용을 중심으로

        Perfection of a (non-exclusive) license of a patent requires registration. Therefore, if a license is registered at the time of assignment of the rights of the licensor (or the patent holder), then the registered licensee may claim his/her rights against the assignee of the assignment. Also, if the license is registered, it is postulated in accordance with the insolvency law, that the registered licensee may maintain the license even upon the bankruptcy of the licensor. However,the license registration system is not used widely because of various reasons and circumstances (such as the burden of cost, complicated procedures, and denial of the duty of cooperation for the registration,etc.). As a result, most of the licenses remain unregistered. The rights of the licensees of such unregistered licenses are not perfected against third parties, and remain vuluable to termination upon assignment of rights of, or bankruptcy of licensor. Therefore, such licensees’ position remain extremely unstable, because they may have to discontinue their businesses upon termination of the licenses for reasons that are not the result of their fault or negligence. Meanwhile, technology transfer is mostly carried out by way of transfer or licensing of patents or other intellectual property rights on the technology. License is more popular than rights transfer, implying that the license plays a more important role in technology transfer. Thus, the facilitation of the licensing is critical for promoting the technology transfer, and the facilitation of the licensing in turn requires stronger protection of holders of unregistered licensees. Despite such needs, the current laws and regulations provide insufficient level of protections for the unregistered licensees. In this paper, I have reviewed discussions in foreign jurisdictions and trends for institutional changes and legislations, have discussed the need for protection of unregistered licensees and issues that need to be addressed when designing a new system for such protection, have proposed the system of the statutory (non-exclusive) license as a new system for the protection of such unregistered licensees, and, finally, have reviewed the legal requirements and effects of such system from the legal perspective. Under this statutory (non-exclusive) license system proposed here for the protection of the unregistered licensees, unregistered licensees will be granted the statutory (non-exclusive) licenses even if the licenses were terminated upon assignment of the rights of, or the bankruptcy of the licensor, and will be able to claim their rights as against the assignee or the bankruptcy trustee. Accordingly, the exercise of the rights of the assignee or the bankruptcy trustee will be necessarily restricted. As a result, the licensees may continue their businesses that are covered by the licenses without any fear or interruption. This paper proposes but one of many possible alternative systems for the protection of the unregistered licensees. In the future, we need to review if the proposed statutory (non-exclusive) license system is consistent with the existing patent law, and its relationship with the registration/perfection system. Furthermore, we need to research if the registration system itself may need to be improved or reconsidered at a more fundamental level, and,more importantly, if there exist any better alternative for the protection of the unregistered licensees. 특허권의 라이센스(통상실시권)는 등록이 제3자 대항 요건이므로, 라이센서(특허권자)의 권리 이전시 라이센스가 등록되어 있는 경우에는 이러한 등록 라이센시는 신권리자에게 대항할 수 있다. 또 라이센서가 파산시 라이센스가 등록되어 있는 경우에는 등록 라이센시는 라이센스를 계속 유지할 수 있다고 도산법상 유추된다. 그러나 라이센스 등록 제도는 여러 가지 사정(비용 부담, 절차 번잡, 등록 협력 의무 불인정 등)으로 활발하게 활용되고 있지 않아, 라이센스 중 대부분이 미등록 라이센스이다. 이러한 미등록 라이센스를 갖는 라이센시는 라이센서의 권리이전 또는 파산시 해제권 행사에 대항할 수 없기 때문에 자신의 귀책에 의하지 않은 사유로 라이센스가 종료되어 실시 사업을 중단해야 하는 매우 불안한 지위에있게 된다. 한편, 기술이전은 해당 기술이 권리화된 특허권 등의 지적재산권의 이전 또는라이센스에 의해 실현된다. 특히 라이센스는 권리 이전보다 더 일반적이기 때문에라이센스가 기술이전에서 담당하는 역할 또한 더 중요할 것이다. 따라서 라이센스의 활성화가 기술이전 촉진의 핵심이고 이러한 라이센스의 활성화를 위해서는 불안한 지위에 있는 미등록 라이센시를 보호할 필요성이 높다. 그럼에도 불구하고현행 법제상 이러한 미등록 라이센시의 보호를 위한 제도적 장치는 매우 미흡하다고 할 수 있다. 본 논문에서는 제외국의 논의, 제도 및 입법 동향을 참고하여 미등록 라이센시보호의 필요성, 제도 설계시 고려사항 및 보호를 위한 새로운 제도로서 법정실시권 제도를 제안하고, 그 요건 및 효과에 관한 법률적인 관점에서의 검토를 하였다. 제안된 미등록 라이센시 보호를 위한 법정실시권 제도에 의하면, 라이센서의권리 이전 또는 파산시 해제의 경우에도 미등록 라이센시는 법정실시권을 부여 받아, 이를 신권지라와 파산관재인에게 주장할 수 있다. 그에 따라 신권리자 또는파산관재인의 라이센시에 대한 권리 행사는 제한되게 된다. 결과적으로, 라이센시는 안심하고 중단없이 라이센스의 대상인 실시 사업을 지속할 수 있다. 본 논문은 미등록 라이센시 보호를 위한 여러 제도 중 하나의 선택사항을 제시한 것에 불과하므로, 향후에는 제안된 법정실시권 제도의 현행 특허법과의 정합성이나 등록 대항 제도와의 관계를 추가로 검토해야 한다. 더 나아가 등록 제도 자체의 개량 또는 근본적인 재검토 그리고 미등록 라이센시 보호의 또 다른 방안도 연구할 필요가 있다.

      • 유산소 운동이 비만 남자 중학생의 신체구성 및 혈중 지질에 미치는 효과

        The purpose of this investigation was to determine the effects of aerobic training on the changes of body composition and lipiprotein in obese middle school boys. Thirty-five obese middle school boys were ramdomly assigned into two training groups and control group: (1) 60%Hrmax (n=13), (2)80%Hrmax(n=12), (3) control group (n=10), respectively. The participants in the training group trained 40-minute per day for three times per week for twelve weeks. The results were as follows: 1.After twelve-week 1.6km aerobic, there was a significant change in body composition. a.After twelve-week 1.6km aerobic training, there was a significant difference in boby composition between the training groups (E-60%HRmax, E-80% HRmax) and control group. b.After twelve-week 1.6km arobic training, there was no significant difference in body composition between the 60%Hrmax and 80%Hrmax. 2.After twelve-week 1.6km arobic training, there was a significant chage of lipiprotein TC, HDL-C, LDL-C, TC/HDL-C, LDL-C/HDL-C in the training groups(60%HRmax, 80%HRmax). a.After twelve-week 1.6km aerobic training, there was a significant difference in lipiprotein TC, HDL-C, LDL-C, TG, TC/HDL-C, LDL-C/HDL-D between the training groups (60%HRmax, 80%HRmax) and control group. b.After twelve-week 1.6km aerobic training, there was no significant difference in lipiprotein TC, HDL-C, LDL-D, TG, TC/HDL-C, LDL-C/HDL-C between the 60%HRmax and 80%HRmax. It is generally believed that, he obese middle school boys were not able to adapt to exercise, because of their avoidance from exercise. However, the results of the present study showed that the continuous participation in aerobic exercise resulted in the positive changes in body composition and lipiprotein. It is suggested that the aerobic training have a possible values as programs for obesity prevention and remediation and may decrease the risks of chronic health problems

      • 회분식 증류공정의 Rigorous Modeling과 End-point Collocation Method를 이용한 최적화

        Batch distillation is one of the most important separation processes used in many chemical industries. The continuous distillation process used in a general chemical industry was suitable for a past large quantity production body plan. However, recent interest on batch distillation which is suitable for the necessities of various consumers is growing fast. This is due to the flexibility of batch processes. Most importantly, multicomponent mixtures may be separated in a single batch distillation column whereas a number of interconnected columns would be required to separate the same mixture in a continuous distillation process. In this paper the batch distillation for the separation of the binary mixtures of MeOH / Water and the ternary mixtures of Cyclohexane / n-Heptane / Toluene is formulated in a rigorous dynamic mathmatical modeling. The large scale Differential-Algebraic Equation(DAE) was solved using the End-point Collocation Method. The objective function in this formulation is to find out the optimal reflux ratio for maximum products The commercial optimization program GAMS/MINOS was used to find out the optimal solution that is widely used for Non-linear optimization problems.

        Th1, Th2형 Cytokine이 인간 비점막섬유아세포의 Eotaxin, RANTES 단백과 mRNA 발현에 미치는 영향

        Background and Objectives:Fibroblasts interact with eosinophils and play a key role in the pathogenesis of airway dise-ases. The aims of this study were to investigate whether Th1 or Th2 type cytokines can induce mRNA and protein expresion of eotaxin and RANTES in human nasal fibroblast (HNF) and to verify the corelation betwen the stimulation of different cytokines and chemokines in HNF. Materials and Methods:Cultured HNF were stimulated by IL-13, TNF-α, IFN-γ, IL-13 with TNF-α, IL-13 with IFN-γ, TNF-α with IFN-γ >?F??(??(?F)?? (0.2, 2, 20, 200 ng/ml). MRNA expression of eotaxin and RANTES were revealed by RT-PCR and protein of eotaxin and RANTES were revealed by ELISA. Results:TNF-α and IFN-γ induced mRNA and protein expr-esion of RANTES in HNF and they synergisticaly induced protein expresion of RANTES. RANTES expresion increased in a time dependent manner. IL-13 induced mRNA and protein expresion of eotaxin in HNF and it synergisticaly reacted with TNF-α or IFN-γmanner. Conclusion:Th1 or Th2 type cytokines induce mRNA and protein expresion of eotaxin and RANTES in human nasal fibroblasts. TNF-α or IFN-γ induce more RANTES than eotaxin but IL-13 induces more eotaxin than RANTES. There may be some synergic effects of cytokines for mRNA and protein expresion of chemokines.       • 두경부 편평상피세포암과 절제연에서 Human Telomerase Reverse Transcriptase의 발현

        Background and Objectives: The expression of telomerase, a ribonucleoprotein complex, has been detected in tissues from many human cancers, but not in the majority of normal tissues except germ cell. It is believed that the activation of telomerase is linked to celluar immortality and may playa role in tumorigenesis. Human telomerase reverse transcriptase (hTERT) has been identified as a putative catalytic subunit of human telomerase and its expression is closely correlated with telomease activity. We studied the expression of hTERT in head and neck squamous cell carcinoma (HNSCC) and resection margin by immunohistochemistry for hTERT and evaluate the correlation between hTERT expression and clinical data in HNSCC. Materials and Methods: We performed a immunohistochemistry in 17 cases of HNSCC and 10 cases of resection margins, histologically normal. The correlations between the hTERT expression and the clinical data in HNSCC were analyzed. Result: hTERT immunoreactivities were detected in 14 of 17 (82.4%) HNSCC, 1 of 10 (10%) resection margin. No correlation was observed between clinical data and hTERT expression in HNSCC. Conclusion: hTERT is activated in HNSCC and its expression is independent from clinical data of patients.
