디자인 툴킷 개발을 위한 이미지 점화 기반의 아이디어 방법 및 프로세스에 관한 연구

The objective of this study is to derive the direction of image - based idea generation method which is optimized for new innovation and idea development which is the subject of the fourth industrial revolution era. The research method is divided into case study and literature study, and then analyzed and compared in terms of image priming theory. It is organized so that the contents can be summarized in a table and a comprehensive conclusion can be drawn. In the case study, we collected and analyzed various ideas used in the design field. In the literature study, we analyzed the methods of image derivation as a way of deriving ideas based on David E. Meyer and Roger W. Schwaneveldt's priming effect theory. This resulted in a rational conclusion that the use of images rather than the use of words to derive ideas is advantageous in terms of the number of ideas and depth of originality. In the idea method where new ideas are created by the collision of different related words, it is found that the utilization of images is advantageous both in terms of quality and quantity. As a result of this study, we confirmed that existing idea methods are whether maximize the priming effect or not. And we proposed an image priming method that can maximize the effect of idea generation using images and priming effects. Finally, through this study suggested that image - based idea methodology and toolkit should be repositioned as a universal and easy - to - use innovation methodology in design industry. 본 논문은 4차 산업혁명 시대에 화두인 새로운 혁신과 아이디어 개발에 최적화 될 수 있는 이미지를 활용한 아이디어 발상 방법의 방향성을 도출하는 것을 목적으로 하고 있다. 연구방법은 디자인 및 제품서비스 분야에서 사용되고 있는 다양한 아이디어 개발 방법론들을 사례연구와 문헌 연구로 분류 한 후, 이미지 점화 이론의 관점에서 비교 분석하고 그 내용을 표로 정리하여 종합적인 결론을 도출할 수 있도록 구성 되어있다. 사례연구를 위해 디자인 분야에서 사용하고 있는 다양한 아이디어 방법들을 수집하여 분석하였으며, 문헌 연구에서는 선행하는 내용이 뒤에 오는 내용의 판단에 영향을 준다는 이론을 주장한 데이비드 마이어(David E. Meyer 1943~) 와 로저 쉬바네벨트(Roger W.Schvaneveldt 1941~)의 점화효과(Priming Effect)이론을 활용하여 아이디어도출의 방법으로써 이미지도출 방법들을 분석하였다. 이를 통해 아이디어 도출이 서로 다른 개념이 충돌에서 만들어는 것을 전제로, 아이디어 발상시 단어를 제시했을 때 보다 이미지를 제시했을 때 도출된 연관어의 숫자나, 연관어의 독창성에서 유리하다는 합리적 결론을 도출하였고 서로 다른 연관어의 충돌로 새로운 아이디어가 만들어지는 아이디어 방법에서는 이미지를 활용하는 것이 질적 측면과 양적 측면에서 모두에서 유리하다는 결과를 도출하였다. 본 논문의 결론으로 기존 아이디어 방법이 점화 효과를 극대화할 프로세스로 되어 있는지를 확인하고, 이미지와 점화효과를 활용하여 아이디어 도출 효과를 극대화 할 수 있는 이미지 점화 방법을 제안하였다. 마지막으로 본 연구를 통해서 이미지 기반의 디자인 아이디어 방법론 및 툴킷이 우리 산업현장의 보편적이고 쉽게 사용 가능한 혁신 방법론으로 리포지셔닝(Repositioning)하기를 제언하였다.

연구논문(硏究論文) : 이탈리아 해상법에 관한 연구 -그 입법 형태와 내용상 특색을 중심으로-

본 논문은 이탈리아 해상법을 한국에 소개하는 것을 목적으로 한다. 특히 이탈리아 해상법의 입법형태와 내용상 특색을 살펴보고 그 비교법적 고찰을 중심으로 우리나라 상법과 비교하여 그 특색을 살피고자 한다. 그리고 이러한 고찰의 전제로 이탈리아 민사법이 갖는 전반적인 체계도 살피고자 한다. 이탈리아는 근대 대륙법의 근간을 이루고 있는 로마법을 제정한 국가이지만 이탈리아 법은 우리나라에 그 분야를 가리지 아니하고 전반적으로 전혀 소개되지 아니하였다. 이탈리아는 민상법이 통일된 국가이고 해상법이 항공법과 함께 별도 입법 형태로 유지되고 있으며 해상법이 해상 행정법과도 같이 규정되어 있다. 이러한 복잡하고 난해한 이탈리아 해상법을 독자들이 잘 이해할 수 있도록 우리 상법 해상법과 편제를 맞추어 정리하여 소개하는데 주력하였다. 이러한 과정 속에서 우리나라법을 해석하고 입법하는 데에도 참고할 만한 많은 부분을 발견하였다. 그렇다고 이러한 거대한 작업을 제한된 시간 내에 할 수는 없기 때문에 이를 보완하기 위하여 이탈리아 항행법(航行法) 원문을 번역하여 첨부하였다. The article is intended to introduce Italian maritime law into Korea. Italian law in general has not been known to Korea so far. This is the first attempt to look into Italian maritime law. But it turned out that it is not easy to introduce Italian maritime law without addressing on Italian Civil Law in general. The author therefore attempted to align it in line with what Korean maritime law tries to do so that readers easily understand it without fully understanding Italian Civil Law in general. It turned that there are many areas of Italian maritime law which are innovative and therefore conducive to our future better legislation. With time constraint due to a short time allowed to present this paper, the article has to be satisfied with a short overview on Italian maritime law. In particular it has to rely on the Italian Navigation Act in which the provisions equivalent to our maritime law is contained. Knowing shortcomings and imperfection in the research, the author attaches at the end of this article a translation of the relevant part of the Italian Navigation Act so that the reader who are in doubt can have access to the material direct.

2005년 商法 제5편 海商編 改正案에 대한 小考

Maritime Law section of the Korean Commercial Code(KCC) was revised in 1991 since it has been came into force in 1962. However, current provisions has several problems in the perspective of the Hague-Visby regime which is most widely adopted international convention regulating the carriage of goods by sea. The basic structure of the KCC is also out-of-date in that the voyage charter party is the main subject in the carriage of goods by sea. The contract for carriage of particular goods became the main carriage method. The proposed maritime law section includes (1) the systematic change in the structure of the carriage and charter party; (2) increase the level of the package limitation of the carrier; (3) basic provisions on the sea waybill, electronic bill of lading and combined transport. However, it is regretful that the proposal of the Korea Maritime Law Association on the revision of Art. 803 concerning delivery of goods was not adopted. 한국상법의 해상편은 1962년 제정된 다음 1991년 개정을 거쳤다. 그러나 현재의 규정들은, 운송계약을 규율하는 가장 보편적으로 사용되는 헤이그비스비규칙의 입장에서 볼 때 문제점이 있다. 운송계약의 중심이 항해용선에 있다는 점에서 개품운송계약이 주를 이루는 현대의 운송 실무와 유리되어 있다. 이리하여 상법 해상편의 개정에 대한 논의가 시작되었다. 개정시안에서는 운송법의 체제를 변경하고, 운송인의 책임제한액을 상향조정한 점 그리고 해상화물운송장, 전자선하증권, 복합운송에 대한 기본적인 규정을 제안하게 된 것이 가장 큰 특징이다. 다만, 운송인의 운송물인도 간주규정을 개정안에 추가하지 못한 점은 아쉬운 점이다.

학습이론적 해석을 통한 디자인 툴킷 개발에 관한 연구

본 논문은 학습이론을 바탕으로 디자인 분야의 현황과 사례를 분석하여 구성주의 중심의 디자인 툴킷을 개발하기 위한 방향성을 제안하는 것에 그 목적이 있다. 연구의 수행방법은 사례 연구와 문헌연구의 분석으로 나누어지며, 이를 바탕으로 비교 분석표를 도출하고 종합하여 결론을 도출할 수 있도록 하였다. 사례연구는 디자인 실무자 및 전문가 인터뷰 및 인터넷 검색을 통해서 디자인 및 디자인 유관 분야의 툴킷을 수집하고 분석하였으며, 문헌연구는 학습이론 중 개인의 창의성과 차별성을 중시하는 구성주의 학습이론의 필요성을 주장한 시모어 페퍼트(Seymour Papert)의 이론을 중심으로 창조적 도구로서 툴킷의 역할을 분석하였다. 분석을 통한 결과로 툴킷의 종류는 기존의 지식을 전달하는데 초점을 맞춘 매뉴얼 툴킷 (Manual toolkit), 연구자 스스로 아이디어나 지식을 재구성 할 수 있는 창조적 툴킷(Manipulative toolkit)으로 나눠짐을 확인하였다. 그리고 새로운 디자인 툴킷의 개발 에 있어 참여자들이 직접 만지고 경험할 수 있는 창조적 툴킷 (Manipulative toolkit)이 보다 더 필요하다는 합리적 결과를 도출하였다. 본 논문의 결과로는 디자인 툴킷의 제작을 위한 4가지의 주요 요소로서, 디자인 방법론의 깊은 이해의 필요성, 손으로 직접 만지며 경험하도록 하는 특징의 매체 적용, 디자인 현장의 실무 시뮬레이션을 통한 컨텐츠와 매체의 요소에 대한 결정력, 교육전문가 뿐만 아니라 다양한 분야의 전문가와 협력능력을 도출하여 제안하였다. 이를 통해 디자인 툴킷이 산업 혁신과 차별화의 핵심적인 도구로서 리포지셔닝 (repositioning)되기를 기대한다. The objective of this paper is to analyze the present situation and case examples of the design field based on the learning theory and to provide the direction for developing the design tool kit at the center of constructivism. The method of the research was divided into a case study and an analysis of the literature research, and a comparative analysis table was derived based on this, so that a conclusion can be drawn out by comprehension. The case study collected and analyzed toolkits used in the field of design. The literature study was Analyzed on the theory of Seymour Papert who insisted on the necessity of the learning theory of constructivist, And the role of toolkit as a creative tool. As a result of the analysis, the type of toolkit is divided into a manual toolkit focused on conveying knowledge to the others and a manipulative toolkit that allows users to reconstruct their ideas and knowledge. Through research, it derived a rational result that Manipulative toolkit, which can be directly touched and experienced, is advantageous for developing new design toolkit. As a result of this study, four major elements for the design toolkit developments are the need for deep understanding of design methodology, the application of manipulative features to be touched and experienced by hand, the decision on content and manipulative elements through simulation of design field, And the ability to collaborate with professionals in various fields as well as educational experts. It is hoped that this will lead to the development of a design toolkit that can play a role of repositioning as a key tool for industrial innovation and differentiation.
