독일의 동반자적 노사문화를 통한 일자리 창출과 한국사회에의 함의 : 독일 폴크스바겐(Volkswagen) 모델을 중심으로

This study examines a job-creating-model of volkswagen model, a German cooperative relations between Labor and Capital, and it's meaning for korea. We are interested in how the volkswagen model's characters have affected an practice of the work-sharing or job-sharing, in particular. The volkswagen model has been made through agreement between Labor and Capital to avoid mass dismissal. In fact, the volkswagen model could prevent thirty thousand men from dismissal. Although the model is a German model, which has such different political, economic and social environment as the cooperative relations between labor and capital, it can give much meaningful message and issue to our society.

임금결정을 둘러싼 쟁점과 산업평화의 달성

In our economic social situation we have experienced increasing conflicts between entrepreneurs and workers. Here we're looking for the causes of these conflicts in the aspect of social disputes over wage negotiation today. Of course, the wage agreement is the very center of this disputes between entrepreneurs and workers. With this regard, the sociological discussions of wage agreement are very related to the realization of industrial peace on the dimension of the whole society. In this paper, we examine the theoretical perspectives of wage agreement. Also we deal with the contradictions of so called this natural salary. And we analyze how possible the practice of income justice as the important criteria of wage agreement is. Also we suggest dynamic achievement wage as the criteria of wage agreement. In conclusion, we want to contribute to the industrial peace by pointing out a few essential reference of the right wage agreement. 오늘날 경제사회적 상황에서 우리는 임금협상을 둘러싼 사회적 논쟁이 거듭되면서 점증하는 노사갈등을 경험한다. 물론 이러한 노사갈등의 핵심에는 임금결정을 둘러싼 논쟁이 자리잡고 있다. 이런 점에서 임금결정에 대한 사회학적 논의는 사회 전반적인 산업민주화의 실현과 밀접한 관련을 맺는다. 이 논문에서는 임금결정을 둘러싼 몇 가지 이론적 관점들에 대해서 검토하며, 그리고 소위 말하는 자연임금관이 갖는 모순에 대해서도 다루어본다. 아울러 우리시대에 적합한 임금결정의 중요한 기준으로 임금정의의 실행은 어떻게 가능할 것인지에 대해서 살펴보며, 또 임금결정의 중요한 기준으로 동적인 성과급을 제시한다. 마지막으로, 올바른 임금결정의 몇 가지 준거를 제시함으로써 산업평화의 길을 모색해보고자 한다.

공동체 윤리의 구성원리: 권위행사를 중심으로

오늘날 우리는 개인적 욕망이 극대로 분출되는 세상에 살아간다. 이런 사회문화적 상황에서 우리는 가치혼동, 물질주의 확산, 아노미 현상 등에 노출된다. 동시에 우리 사회는 곳곳에서 공동체 해체현상이 심각하게 나타난다. 이 글은 최근 사회 전반에 걸쳐 일어나는 공동체의 약화 내지 와해현상에 주목하면서 권위문제를 사회윤리(가톨릭 윤리) 차원에서 본격적으로 검토하여 공동체 윤리의 준거로 재조명하는 데 그 중요한 목적을 둔다. 이를 위해 우리는 가톨릭 사회윤리의 핵심에 권위개념이 자리잡고 있음을 밝히고 권위행사의 구체적 양상을 다각도로 살펴본다. 먼저, 권위개념을 검토하여 사회윤리의 준거점으로 설정한다. 다음으로, 권위행사의 구체적 방법, 곧 직무에 입각한 권위, 권위행사의 자격, 대표자의 권위위임 문제, 권위위임의 방법 등을 논의하여 권위행사의 정당성 문제를 타진한다. 마지막으로, 공익실천에 적합한 권위행사와 권위의 정당한 수용문제를 검토하여 권위와 공익실천 간의 바람직한 관계에 대해 집중적으로 다룬다. 이런 제반 논의를 통해 권위는 공동체 윤리의 구성원리에서 핵심적 준거가 됨을 밝히고 사회윤리의 중요한 근거가 됨을 해명한다. We are living in a world dominated by individual desires today. In this social-cultural situation, we have experienced the confusion of value, proliferation of materialism, phenomenon of anomie. Simultaneously, our society have been faced with the serious disorganization of community (society). In this paper, we are trying to review the problem of authority in the aspect of social ethics (Catholic ethics). Through this review, we are trying to establish an authority concept as standard of community ethics based on Catholic value. First, we propose an authority concept as the frame of reference of social ethics. And we deal with about the concrete methods of authority exercise. Simultaneously, we explore about the legitimacy of authority excercise. Finally, we reexemine the relationship between authority and practice of common goods, by focusing on the legitimacy of the authority excercise which is suitable in the common goods. Through these trials, we are trying to suggest the problem of authority as the core principle of the community order and also a ground of social ethics. As a result, in this study we could be revealed the right meaning about community ethics, by examining the concept of authority.

자본주의, 공동선, 경제윤리: 질서윤리의 측면에서

Man should participate in economic activities for their survival, at the same time, they have to live with the others by composing of economic community. The individual goals of economic activity depend on the personal interest for increasing theirs own private benefits, and then it is morally neutral. However, the effective function of the economic community should be based on the ``framework`` of economic system. At this point, the ethical dimension for the economy is established. The economic ``framework`` should be based on the certain structure for the welfare of all men beyond the personal needs in terms of economic ethics. That is why economy should contribute to the private interests of particular individuals as well as the social common good. This paper reviews the importance and necessity of economic ethics based on structural, institutional dimension rather than the personal, conscious level. On the basis of such an economic ``framework``, we recognize human beings as the core of economic activity in the aspect of a philosophy of order. Firstly, we explore the reason of the economic ethics on the basis of common good operated according to the ``invisible hand``. Secondly, we deal with the necessity of the economic ethics from the standpoint of a ``framework`` philosophy in the capitalism, and through this attempts, we could point out the possible economic activity which can be quaranteed the universal human dignity for all. Finally, on the basis of these discussions, we examine the practical perspectives of the economic ethics by establishing ``framework`` in modern market economic system. As a result, in this study we try to reveal the right meaning about economic ethics, by establishing a certain economic ``framework`` in the capitalism.

인간존재의 이중주: 개체성과 공동체성을 중심으로

오늘날 우리는 가치혼란의 상황, 물질주의의 만연, 각종 아노미 현상 등등을 경험하며 삶을 영위한다. 아울러 우리는 사회의 도처에서 공동체(사회) 해체현상에 직면하고 있다. 이런 사회적 상황에서 개인과 사회 간의 바람직한 관계 설정은 우리 시대의 중요한 과제라 할 수 있다. 인간은 이중적 본성을 띠고 살아간다. 한편에서 인간은 개체적 존재이며, 다른 한편에서 인간은 공동체적 존재이기도 하다. 인간존재에 대한 이런 이중적 파악은 다음의 두 가지 잘못된 생각, 곧 극단적 집단주의와 개인주의에서 벗어나게 해준다. 인간은 자신만의 고유한 삶을 살아가는 것을 보장받음으로써 집단주의에서 벗어날 수 있으며, 동시에 공동체 안에서 자기정돈의 필요성과 타인을 위한 공동책임을 수용함으로써 개인주의에서 벗어날 수 있다. 이 논문은 사회윤리학의 근본토대로써 인간존재의 이중성을 다룬다. 우리는 인간존재의 이중성에 초점을 두어 사회윤리학의 출발과 성격 그리고 근본전제에 대해 살펴본다. 나아가 사회윤리학 성립의 핵심내용에 해당되는 사회윤리의 기초적 인간관, 곧 인간 삶의 공동체적 속성과 그의 인격성(개체성)에 대해서 검토한다. 마지막으로, 사회적 존재로서 공동체적 삶을 살아갈 수밖에 없는 인간존재의 불가피성에 대해서 다각도로 논의하여 개인과 공동체 간의 조화로운 관계를 설정하려 한다. 이런 논의를 통해 우리는 점증하는 유동적이며 불확실한 사회적 상황에서 윤리적 연대 공동체의 실현이 중요함을 제시하고자 한다. Today we have experienced the value confusion, proliferation of materialism, phenomenon of anomie, etc. At the same time, our society has been faced with a serious disorganization of community(society). The desirable establishment of relationship between individual and society is very important in this social situation. The existence of human beings have dual facets: individuality and communality. On the one hand, human beings are individual existence, on the other hand, human beings are communistic existence. An understanding of this duality of human existence will liberate us from the lifestyle of an extreme collectivism and extreme individualism. Human beings are free from (extreme) collectivism in the area of living his own unique life. Spontaneously, human beings are free from (extreme) individualism in the area of accepting common responsibility for others In this paper, we deal with the duality of human existence as basic foundation of social ethics. We examine the beginning, character and fundamental premise of social ethics on the basis of the duality of human existence. Also, we review the core contents of social ethics in the aspect of the basic human image which is represented by both communality of human life and personality(individuality) of human life. Finally, through this trial, we are trying to establish the ethical solidarity community in the increasingly fluid and uncertain political, economic and social situation.

기업내 공동결정권을 둘러싼 쟁점과 핵심내용 - 독일의 사업장평의회를 중심으로 -

오늘날 우리의 경제사회적 상황에서 대립적 노사관계 대신에 동반자적 노사 문화의 정립은 중요한 사회적 현안으로 등장하고 있다. 이 글에서는 노사 동반자적 협력관계 형성에 중요한 기반이 되는 공동결정권의 역사적 전개와 발달, 그리고 주요 쟁점에 대해 살펴보기로 한다. 특히 독일적인 기업 상황에서 법으로 규정되어 있는 기업 내 공동결정권의 핵심내용을 검토함으로써 노사 간의 바람직한 노동문화 창출에 이바지하고자 한다. 말하자면 독일사회에서 공동결정이 중요한 경제사회적 현안으로 등장해 발전하였는지를 검토해보고, 그런 토대 위에서 단위 기업 내에서 행사되는 공동 결정의 제도인 사업장평의회의 목표와 과제 그리고 구체적 내용 등을 밝혀보고자 한다. 이런 시도를 통해 우리는 한국적 상황에서 노사분규가 발생할 때 어떻게 대처하여 해결책에 이를 것인가에 대한 중요한 시사점을 얻을 수 있으며, 동시에 치열한 경쟁적 자본주의 상황에서 노동인간화 내지 경제민주화를 실현 할 수 있는 바람직한 노동관계의 설정에도 많은 함의를 받을 것이다. Nowadays our economic-social structures are showing antagonistic relations between entrepreneur and workers. But we can say that this contending relation is about to be replaced by a partnership. We want to show in this article that codetermination is the very fundamental of such a partnership relation. We will investigate especially the German model of codetermination on the factory level which is obligatory by law in that country. We want to introduce the codetermination on the level of the factories by setting up a so-called "Betriebsrat". This can provide us a concrete example of codetermination. We hope also to show a proper way to overcome labor disputes happening on the level of the factories. Finally, we propose that "Betriebsrat" could contribute to the humanization of labor and economic democratization in the world of extreme competition within capitalism. By doing so we hope that we can contribute to the establishment of good labor relations in Korean society.
