        Background and Activities of the Samsung Ombudsperson Commission in Korea

        Objectives: The Samsung Ombudsperson Commission was launched as an independent third-party institution following an agreement among Samsung Electronics, Supporters for Health and Right of People in Semiconductor Industry (Banolim in Korean, an independent NGO), and the Family Compensation Committee, in accordance with the industry accident prevention measure required by the settlement committee to address the issues related to employees who allegedly died from leukemia and other diseases as a result of working at Samsung’s semiconductor production facilities. Methods: The Commission has carried out a comprehensive range of activities to review and evaluate the status of the company’s occupational accidents management system, as well as occupational safety and health risk management within its facilities. Results: Based on the results of this review, termed a comprehensive diagnosis, the Commission presented action plans for improvement to strengthen the company’s existing safety and health management system and to effectively address uncertain risks in this area going forward. Conclusions: The Commission will monitor the execution of the suggested tasks and provide advice and guidance to ensure that Samsung’s semiconductor and liquid crystal display production lines are safer.

      • Design an active antenna using an equivalent model

        In this paper, we designed an active dipole antenna having a low noise-figure and high gain as well as small size and wideband characteristics. Design and measurement methods using an equivalent model were also proposed. The designed antenna shows good gain and noise-figure performance in the 5:1 bandwidth, and the measurement results are agreed well with simulation results, which show that the proposed simulation method and the measurement method are worked well.

        시변동이 있는 근거리 음향신호의 시간영역 지음향학적 역산

        2006년 여름 New Jersey 대륙붕 근해에서 일련의 해상실험(Shallow Water 2006, SW06)이 수행되었다. 이 때 수직선배열에서 계측된 근거리 chirp 신호(1100~2900 Hz)에서 직접도달파와 해수면 반사파의 강한 시변동이 관찰되었다. 본 논문은 시변동성이 있는 근거리 음향신호의 지음향학적 역산기법과 실험 데이터에 대한 역산결과를 제시한다. 불규칙한 해수면 반사파가 역산에 미치는 영향을 최소화하기 위해 수직선배열에서 음원의 위치로 직접도달 경로와 해저면 반사경로를 통해 역전파된 신호의 에너지로써 목적함수를 정의하였다. 또한 VFSR(Very Fast Simulated Reannealing) 최적화기법을 활용한 다단계 역산기법을 실험데이터에 적용하였다. 역산 결과 음원은 주기적인 수직운동을 한 것으로 파악되었고 그 주기는 수면파의 주기와 일치하였다. 해저면의 음속은 1645 m/s로 추정되었고 이는 동일 해역의 다른 연구결과와 유사한 것으로 파악되었다. A set of experiments (Shallow Water 2006, SW06) was carried out in shallow water near the New Jersey shelf break in summer 2006. Significant fluctuations in direct and surface reflected arrivals were observed from the chirp data (1100~2900 Hz) measured on a vertical line array. This paper presents a geoacoustic inverssion technique for short-range acoustic data with fluctuating arrivals and inversion results of experimental data. In order to reduce effects of random sea surface on the inversion, the acoustic energy back-propagated from the array to the source through direct and bottom-reflected paths is defined as the objective function. A multi-step inversion scheme is applied to the data using VFSR (Very Fast Simulated Reannealing) optimization technique. The inversion results show a source depth oscillation period equal to the measured ocean surface wave period. The inverted bottom sound speed is 1645 m/s and is similar to that estimated by other work at the same site.

      • Fluctuating arrivals of short-range acoustic data.

        <P>Geoacoustic inversion using fluctuating signal observations can be challenging. The origin of these fluctuations needs to be understood so the signals can be used appropriately. A set of experiments [Tang et al., Oceanogr. 20(4), 156-167 (2007)] was carried out in shallow water near the New Jersey shelf break in summer 2006. Significant fluctuations in the direct path and surface-reflected arrivals of short-range chirp transmissions (1.1-2.9 kHz) were observed on a vertical line array. This paper explains the origin of these signal fluctuations through analysis of the arrival amplitudes. It is shown that the strong thermocline combined with an oscillating source motion due to ocean surface waves results in the signal fluctuations.</P>

        개정 일본민법상의 채권자취소권과 한국민법 개정에의 시사

        본고는 2020년 4월 1일부터 시행되고 있는 개정 일본민법 가운데 채권자취소권에 관한 규정들을 검토하고, 이를 통하여 얻은 시사점을 기초로 하여 우리 민법의 채권자취소권에 관한 규정의 개정에 대하여 몇 가지의 제언을 하였다. 이를 요약하면 다음과 같다. 첫째, 우리 민법의 채권자취소권에 관한 규정은 현행 민법전의 체제를 기본적으로 유지하면서, 다른 한편으로는 이미 확립된 판례나 해석론에 의한 기본적인 원칙을 적극적으로 민법전에 받아들여 명문화하는 방향으로 개정하여야 한다. 2014년 민법개정시안은 종래의 학설과 판례를 통하여 확립된 내용을 비교적 충실하게 반영하고 있지만, 이것으로 충분하다고 할 수는 없다. 일부 규정의 개정 또는 추가적인 신설이 필요하다. 둘째, 우리 민법개정에 있어서는 채권자취소권의 기능이나 법적 성질과 관련하여 책임설, 취소효과설과 같은 새로운 학설을 채용하는 것은 취하기 어려울 것이다. 따라서 법적 성질에 관한 종래의 통설과 판례이론은 기본적으로 유지되어야 한다. 다만 민법개정에 있어서는 이것을 그대로 받아들일 것이 아니라, 그동안 지적되었던 문제점을 해결하기 위한 노력을 계속하여야 한다. 셋째, 채권자취소권의 요건과 관련하여, 피보전채권이 사해행위 후에 발생한 것인 경우에도 그것이 사해행위 전의 원인에 기초하여 발생한 것인 때에는, 사해행위취소권의 행사를 인정해야 한다는 규정을 명문화하여야 한다. 또한 사해행위의 유형화와 관련하여 이른바 편파행위 등과 같이 최근 학설상 논의되고 있는 유형에 관한 규정의 신설을 적극적으로 검토하여야 한다. 넷째, 채권자취소권의 행사의 효과로서 사실상의 우선변제를 인정할 것인가의 문제와 관련하여 민법개정시안에서는 사실상의 우선변제를 원칙적으로 인정하면서, 또한 일정한 경우에는 상계를 금지함으로써 이것을 제한하고 있다. 그러나 사실상의 우선변제의 효과가 부정되거나 또는 제한된다고 하면, 채권자취소권을 행사하여 채권회수를 하고자 하는 채권자는 그 권리의 행사를 주저하게 될 것이다. 따라서 우리 민법개정에서는 종래의 통설 · 판례와 같이 사실상의 우선변제를 인정하는 방향으로 개정하여야 한다. This paper reviews the provisions on the obligee’s right of revocation in the revised Japanese Civil Code, which has been in force since April 1, 2020, and makes several suggestions on the revision of the provisions on the obligee’s right of revocation in the Korean Civil Code based on the implications obtained through this. The summary of these are as follows. First, the provisions of Korean Civil Code on the obligee’s right of revocation should be revised by actively accepting the basic principles of the existing precedents or interpretations while maintaining the current civil law system. The Amendment of Korean Civil Code 2014 reflects the contents established through the existing theories and precedents relatively faithfully, but in addition, some regulations should be reviewed, such as the provision on the typology of the fraudulent act. Second, in the revision of Korean Civil Code, it will be difficult to adopt new theories such as accountability theory and revocation effect theory in relation to the function or legal nature of the obligee’s right of revocation. Therefore, general theories and precedents on legal nature should be maintained basically. However, it is not necessary to follow in full the general theories and precedents, but efforts to solve the problems that have been pointed out in the meantime should be continued. Third, in relation to the requirement of the obligee’s right of revocation, it is necessary to stipulate that the exercise of the right to revoke the fraudulent act should be recognized in case that the claim protected by the obligee’s right of revocation is generated after the fraudulent act, if it is based on the cause before the fraudulent act. In addition, regarding the typology of the fraudulent act, it is necessary to actively review the establishment of regulations on the types that are being discussed in academic theories such as so-called biased acts. Forth, there is a question of whether to recognize the actual preferential reimbursement as the effect of exercising the obligee’s right of revocation. In relation to this problem, the Amendment of Korean Civil Code recognizes the actual preferential reimbursement, and in certain cases it restricts by prohibiting the countermeasure. But, if the effect of the actual preferential reimbursement is denied or limited, the obligee who intends to recover his claims by exercising his right to revoke the fraudulent act will hesitate to exercise the rights. Therefore, the revision of Korean Civil Code should be revised in the direction of recognizing the actual preferential reimbursement, such as the conventional general theory and precedents.
