예비군은 근대 국민국가의 산물로 징병제의 발전과 더불어 변천하였다. 특히, 200년이 넘는 역사적 전통을 지닌 독일 예비군은 독일 통일전쟁, 제1, 2차 세계대전, 냉전, 재통일 등의 역사적 격변 속에서 발전하였다. 독일은 체계적인 예비군 제도로 인해 마련된 병력으로 대규모 전쟁들을 치를 수 있었고, 냉전기에는 서독 연방군 소속 예비군이 자유진영의 최전방 전력 중 하나로서 중요한 역할을 담당하였다. 그러나 재통일 이후 군의 규모가 대폭 축소됨에 따라 독일 예비군은 자연스럽게 감축되었지만 연방군의 역할 변화와 함께 그 임무는 해외 파병 및 구조 활동에까지 확대되었다. 독일 예비군의 변천과정에 관한 고찰은 유사시 시행할 수 있는 전력 증감 방안과 통일 후 예비군의 활동에 관한 시사점을 제공한다. 독일 예비군은 재통일 이후 향토방어 및 국내 재난구조 활동은 물론, 국제적 지원 활동 등에도 참여하였으며 최근에는 심지어 사이버 영역에 관심을 가지기 시작했다. 이외에도 독일 예비군은 ‘사회의 일부(Teil der Gesellschaft)’인 ‘제복을 입은 시민(Staatsbürger in Uniform)’으로서 군과 사회를 증재하는 역할도 수행하였다. 각종 법률과 규정, 제도 등을 통해 오늘날의 모습을 갖춘 독일 예비군은 한국 예비군 발전을 위한 중요한 반면교사가 될 것이다. The military reserve force has changed with the conscription as a product of the modem nation-states. In particular, the German military reserve force has developed in the Wars of German Unification, die First and Second World War, the Cold War, and German reunification. Because of a strong military power based on the military reserve force, the Prussian army won in the Wars of German Unification and the german military reserve force contributed to preventing the expansion of communist forces during the Cold War, But it had been reduced in size after die German reunification. Today the german military reserve force is seeking new changes under the Guidelines of “Strategie der Reserve”. The study on the German military reserve force draws implications for the future role of the military reserve force. After reunification, the German reserve force, which is participating in domestic rescue activities, international support activities, is extending its scope of activities to the cyber domain. Even it plays a role in mediating between the society and the military. In addition, the development of the German military reserve force is due to the strategic guidelines, laws, regulations and systems for the reserve force.

독일 국방감독관 제도의 운영실태와 그 함의 : 국방감독관 연례 보고서 분석을 중심으로

내적지휘의 산증인인 독일 국방감독관은 장병들의 인권 실태를 확인 및 감독하는 의회 보조기관이다. 민주주의 국가의 군대로 창설된 서독 연방군은 민주주의의 가치들이 군에서도 뿌리내릴 수 있도록 ‘내적지휘’와 ‘제복 입은 시민’이라는 전형을 고안하였다. 서독 연방군 창설 초기에 국방감독관은 연방군 지휘철학인 내적지휘의 이행 상태를 중점적으로 고찰하였고, 이로 말미암아 장병 인권 수호자로서의 역할을 수행할 수 있었다. 재통일 이후 국방감독관은 연방군의 역할 변화에 주목하면서 각종 제도 및 정책까지 면밀하게 살펴보았으며 심지어 연방군의 든든한 정책 후원자로서 군의 활동사항을 적극적으로 홍보하였다. 하지만 2011년 이후 국방감독관은 징병제의 중지와 지원병제의 도입이라는 변화 속에서 다시 장병들의 제반사항에 관심을 기울였고, 나아가 연방군의 현안 문제 및 미래 발전 방안들도 함께 숙고하였다. 오늘날의 국방감독관은 연방군 내 내적지휘의 이행실태를 점검하는 역할은 물론, 연방군의 미래를 함께 구상하는 기관으로 발전하였으며 이 역할과 기능은 향후에도 계속 이어질 것으로 보인다. The Wehrbeauftragte des Deutschen Bundestages is a parliamentary organization that guarantees the human rights of soldiers and supervises the settlement of democratic values in the Bundeswehr. The Bundeswehr, founded as a democratic nation's military, devised the concepts of the ‘Innere Führung’ and ‘Staatsbürger in Uniform’ so that democratic values could take root in the military. At its beginning, the Wehrbeauftragte des Deutschen Bundestages has focused on the implementation of the Innere Führung and has played a roll as a guardian of the human rights. After German reunification it has dealt with the conditions of dispatched soldiers. However, after the suspension of the conscription system in 2011, the life of the soldiers and the future of the Bundeswehr have been carefully considered by them. It has played the role to promote Bundeswehr's policies in the Bundestag. Thus it has established itself as an indispensable organ that contributes to the development of the Bundeswehr. The analysis of the Wehrbeauftragte's annual report shows that it is an institution for implementing the Innere Führung, sometimes supporting administrative and judicial actions for the Bundeswehr. It cannot be considered separately without the ‘Innere Führung’. And in order to introduce this system, the legal foundation and social consensus are important.

본고는 현재까지의 군부대 내 문화재 현황과 군사 문화재에 대한 처리 및 관련 법령의 개선사항을 다루고 있다. 대표적인 군부대 문화재 조사에는 문화재청의 지원을 받아 2006년부터 2010년까지 진행된 조사사업이 있다. 최전방 군부대 및 군사보호시설 내의 군사문화재를 조사대상으로 한 이 사업은 군부대 내 문화재 현황을 일목요연하게 정리하여 전 군부대 내 문화재 조사를 위한 토대를 마련하였다. 향후 지속적으로 군부대 내 문화재 목록이 최신화되어야 하며 군사문화재 발견에도 관심을 기울여야 할 것이다. 새로운 문화재가 발견된다면, 일반 문화재일 경우 발견자는 문화재청장과 해당 지방자치단체장에게 보고해야 하며 군부대 내 문화재 발견 시에는 발견자를 비롯해 발견한 부대의 장은 문화재청장 및 국방부장관에게 해당 사실을 보고하여야 한다. 보고된 문화재에 대해서는 국방관련 문화재로 등록 신청 후 군사재로 지정받을 수 있다. 군문화재보호 훈령에 따르면, 이 과정에서 등록문화재 또는 군사재로서의 가치 여부는 부대의 장에게 위임되어 있다. 또한 부대의 장이 문화재 관리 및 보존의 책임까지 지고 있는데, 이런 문제점들은 제도적 보완이 요구되는 사항들이다. 이외에도 군문화재보호 훈령의 문제점으로 문화재라는 대상을 중심으로 규범을 제정하면서 모든 경우를 포괄하다 보니 실제로 실행 간의 혼선이 발생할 여지가 남아 있다. 요컨대, 현실에 맞게 문화재에 대한 구체적인 처리절차가 모색되어야 한다. 또한 부대활동 간 매장문화재 발견 시 해당 경찰서장에게 7일 이내에 신고하도록 하고 국방부장관에게 즉각적으로 보고하도록 한 법규도 재고의 여지가 있다. 본고는 군부대 및 군 활동간 발견된 문화재 처리 절차에 대한 실질적인 연구가 없는 현실에서 군사문화재에 관한 활발한 연구의 단초일 뿐 아니라 문화재 보존 및 처리에 대한 현실적인 시사점을 제공한다. 특히, 통일 이후 문화재 처리 절차가 반드시 필요할 것을 대비하여 군사문화재 처리에 대한 길잡이의 역할을 할 것이다. This paper reviews current situation of the cultural properties located in the military camps as well as the rules or regulations concerned which deal with caring of the cultural properties. During 2006 through 2010, Cultural Heritage Administration(CHA) supported the research of the cultural properties in the military camps or sectors. Through this research, even approximate one could understand current situation of the cultural properties. If military person discovered cultural property or thing expected such kind of, the person and his or her commander who is responsible for such area should report it to Minister of Defense as well as Head of CHA. Such a reported property can designate as ‘military cultural legacy’ after registering it as military cultural property. According to the rules and regulations concerned, during such a process, it depends on the commander whether or not the discovery is cultural property or such kind of. In addition, the commander should preserve or protect such a cultural property in his or her area. Current rules and regulations concerning cultural properties are some defects. For example the regulations are too broad to cause confusions with each provision. Thus such regulations should be revised. This paper may suggest the managerial implication concerned with preserving or protecting the military cultural properties which located military region. There is no such research dealt with this kind of problem, thus this paper will be the beginning of preserving or protecting the military cultural properties and suggest the direction how to manage the process if he or she found cultural properties or such kind of. Especially, after Unification of Korea peninsular, the measures of caring of cultural properties in North Korea area will be indispensible and this paper may help deal with such kind of problems.
