        마황 에틸아세테이트 분획물이 고지방 식이로 유발된 생쥐의 지질대사에 미치는 영향

        Objective : Ephedra Herba has been widely used for patients with common cold, asthma in eastern countries, especially china japan and korea. Recently it has been also used for obesity in clinic with high frequency. This study was designed to investigate the effects of Ephedra Herba ethyl-acetate fraction (EEAF) on hyperlipidemic mice. Method : Effects on total cholesterol, HDL-cholesterol, triglyceride, AST, ALT, fasting blood glucose in serum were measured in this experiment, and in addition, histopathological and gene expression changes in liver tissue was also observed. Results : In our study, EEAF did not affect weight gain in hyperlipidemic mice. Oral administration of EEAF lowered levels of total cholesterol which were elevated by induction of hyperlipidemia. And administration of EEAF lowered fasting blood glucose significantly. By carrying out ontological analysis, large numbers of genes were identified in up or down regulated genes. The expression of the genes that were altered in response to high-fat diet was restored to normal levels in EEAF treated mice, with a recovery rate of 49%. And it was considered that fatty acid metabolism was one of important key pathway of the recovery. Conclusion : Results in our study suggest that EEAF can prevent obese and through regulation of dyslipidemia and hyperglycaemia.

        한국형사법학회 형사소송법 개정안에 대한 논평

        이 논문은 한국형사법학회의 형사소송법 개정특별위원회가 마련한 형사소송법 개정안 중 수사 일반과 강제처분 부분에 대한 간략한 논평을 그 내용으로 하여 한국형사법학회 2010년 동계학술회의에서 발표한 발표문을 수정, 보완한 것이다. 연구회 개정안은 2007년 형사소송법 개정 당시 검토과제에 포함되지 않았던 문제들을 주로 다루고 있다. 예컨대 수사 일반에서 ① 내사제도, ② 지명수배영장제도, ③ 검시제도, ④ 출국금지처분 등이 여기에 해당한다. 더 나아가 연구회 개정안은 개정 형사소송법의 시행과정에서 나타난 개정요구를 받아들여 ① 변호인의 피의자신문참여권의 제한사유 구체화와 대인적 강제처분에서는 ② 긴급체포 피의자의 인권보호를 강화하기 위하여 긴급체포 후 6시간 이내의 체포영장 청구를 명문화하였고, ③ 준현행범인의 범위를 제한하는 한편, ④ 보증금납입조건부 피의자석방제도를 피의자보석제도로 전환하는 방안 등을 제시하였다. 대물적 강제처분에 있어서 불필요한 논란을 피하기 위하여 ⑤ 디지털 증거도 압수의 대상에 포함시켰으며, ⑥ 긴급 압수·수색의 대상 범위를 체포된 자가 소지 또는 보관하는 물건으로 한정하였고 그 허용시간을 12시간 이내로 제한하였다. 연구회 개정안은 법치국가이념의 실현과 민주화라는 개정방향에서 보면 전체적으로 바람직한 개정안이라고 평가할 수 있겠다. 다만 내사의 형사소송법 규정화와 지명수배영장제도의 도입에 대해서는 반대하며, 연구회 개정안은 개정작업에 앞서 지금까지의 형사소송법의 개정역사와 방향을 분석하여 형사소송법 개정작업의 원칙과 방향을 설정했어야 한다는 점도 보완점으로 지적한다. This article is the revised version of the manuscript presented at the winter academic conference of The Korean Criminal Law Association(2010), which especially deals with the issues of Investigation and Compulsory Measures of the new Criminal Procedure Act drafted by the special committee of the Association. The Committee's draft mainly tackles the issues which were not covered by the 2007 Amendment of Criminal Procedure Act, e.g. ① Inquiry, ② Wanted Poster, ③ post-mortem Examination, ④ Exit Ban. Furthermore, the draft adopted demands for reform arisen in the course of enforcing the 2007's Amendment : ① to clarify the grounds for limitations on Participation of the Defense Counsel in Interrogation of Suspect. Regarding Compulsory Measures on People, ② to stipulate that it is required to request a Warrant of Arrest within 6 hours after an Emergency Arrest to protect the rights of suspect, ③ to limit the scope of Quasi-Flagrant Offender, and ④ to suggest a way to change the institution of releasing the detained suspect under the condition of payment of bail money to general bail for suspect. To avoid unnecessary controversy regarding Compulsory Measures on Objects, ⑤ To state that Digital Evidence is also seizable, ⑥ To limit the urgent search and seizure without a warrant within 12 hours to the items possessed or kept by a person arrested. The Committee's draft can be evaluated as a desirable one in terms of general direction towards the rule of law and democratization. However, it can be also pointed out that the general principles and direction of the Reform should have been established before the actual reform-operation, based on the analysis of genealogy of the previous amendments.

        현행 검시제도(檢視制度)의 문제점과 개선방안

        Introduce a Medical Examiner System Korean death investigation system centered on prosecutor and judicature who are not a specialist in pathology or forensic medicine. Lacking in porfessional understanding cause less accuracy and rapidness of death investigation. To overcome limitations and problems of our death investigation system is suggested to introduce a Medical Examiner system. The Medical Examiner must be a forensically trained physician to investigate violent, suspicious or unnatural deaths. The Medical Examiner has a duty to determine objectively the cause and manner of death in such cases. The Medical Examiner can uncover hidden evidence of injury to explain a sudden death or can document natural diseases to show that no foul play was involved in the death. The prosecutor and private attorneys rely on the Medical Examiner`s determination to resolve issues of guilty or innocence. All persons rely on the Medical Examiner`s determination in the pursuit of justice on behalf of the deceased person.

        Die Lekture von Gerichtsentscheidungen ist in immer zunehmendem Maße ein selbstverstandlicher Bestandteil der juristischen Ausbildungen geworden. Die selbstandige und systematische Durcharbeitung der strafgerichtlichen Entscheidungen des Obersten Gerichtshofes ist eine unerlaßliche Voraussetzung zum Verstandnis des Strafrechts. Denn das Strafrecht lebt in den Urteilen der Strafgerichte. Sie lehren die Anwendung der abstrakten Normen und zeigen, welche Probleme sich in der Praxis vorzugsweise stellen. Aus Raumgrunden sind ausgewahlte Entscheidungen mit erlauternden Anmerkungen erlaubt, die Ansatze zu einer Disskusion der im Urteil vertretenen Auffassung liefern und Anhaltspunkte fur eine selbstandige Auseinandersetzung mit den Problemen bieten. In den ausgewahlten Entscheidungen geht es vor allem um die folgenden Fragen: (i) ob es dem Richter die Auslegung unter Berucksichtigung der Vorstellung des historischen Gesetzgebers und des gesetzessystematischen Zusammenhanges nach dem Zweck des Gesetzes erlaubt, wenn auch der mogliche umgangssprachliche Wortsinn als Auslegungsgrenze mit zweifelsausschließender Deutlichkeit zu bestimmen ist; (ii) ob das Prinzip der funktionellen Tatherrschaft auf dem Fall passt, in dem A und B sich die Ausfuhrung der Vergewaltigung in der Weise teilen, daß A eine Frau vergewaltigt, wahrend B ihre Freundin vergewaltigt; (iii) wie die strafrechtliche Verantwortungsteilung zwischen Arzte und nichtarztlichen Personals(sog. vertikale Arbeitsteilung) in sinnvoller Weise durch zwei Kriterien erreicht: Zum einen durch das Prinzip der strikten Arbeitsteilung und zum anderen durch den Vertrauensgrundsatz.
