        디지털 증거 대상 임의제출물 압수의 문제점

        정보통신기술 및 기기의 발달로 디지털화가 촉진되면서 디지털 증거라는 새로운 유형의 증거가 등장했고, 이로 인해 무체물인 디지털 증거의 압수 대상성과 관련해 다양한 학설이 대립해왔다. 수사 실무에서는 디지털 증거가 자연스럽게 기존 증거 범주에 포함되었고, ‘무체물 압수방식에 대한 법적 근거를 명확히 하려는 것’을 이유로 형사소송법 제106조 제3항이 신설되면서 디지털 증거의 압수 적격성 논란은 사실상 일단락되었다. 디지털 증거의 보편화에 따라 디지털 증거를 포섭할 수 있는 수사 절차가 마련되어야 함에도 불구하고, 수사 절차는 여전히 유체물을 중심으로 운영되고 있다. 디지털 증거에는 종래의 유체물 증거와는 다른 다양한 특성들이 존재한다. 따라서 디지털 증거를 압수할 때는 이와 같은 특성들을 충분히 고려해야 한다. 우리 헌법은 기본권 보호를 위해 원칙적으로 영장주의를 채택하고 있으며, 그 예외는 형사소송법에 규정되어 있다. 영장주의의 예외는 임의수사에 해당하기 때문에 영장주의에 따른 강제수사 보다 엄격하게 적용되어야 한다. 영장주의의 예외 중 하나로 ‘임의제출물 압수’가 있다. 디지털 증거 대상 임의제출물의 압수에도 매체독립성이나 복제용이성과 같은 디지털 증거의 특성이 고려되어야 함은 당연하다. 디지털 증거의 특성을 고려치 않고 디지털 증거를 대상으로 임의제출물 압수를 수행할 경우, 정보저장매체의 이중 증거성에 따른 임의제출자 적격성 문제나 디지털 정보 선별을 통한 임의제출의 적법절차 준수 문제 등이 발생할 우려가 있다. Because of the digitalization trend, new types of evidence have emerged as digital evidence. As a results, various theories have been at odds over the subject of confiscation of digital evidence that is intangible. and the intangible digital evidence was naturally included the existing evidence category In investigative practice. Then, with the establishment of Article 106 (3) of the Criminal Procedure Act on the grounds of “clarification of the legal basis for the method of confiscation of intangible evidence” the controversy over the eligibility of digital evidence for seizure has virtually ended. However, the investigation practice still familiar with tangible evidence. so, the procedure can’t clearly include digital evidence. The digital evidence have different from ordinary tangible evidence. The digital evidence has a variety of characteristics that are different from traditional tangible evidence. So, when investigators want to seizing digital evidence, They should consider theses digital evidence’s variety of characteristics. The Constitution of the republic of Korea adopts warrant requirement for protect fundamental rights, and the exception is stipulated in the Criminal Procedure Act. The exception of warrant requirement is voluntary criminal investigation. So, It should be applied strictly compared to forced investigations under warrant requirement. One of the exceptions to warrant requirements stipulated in the Criminal Procedure Act is the seizure of voluntary submissions. It is natural that the nature of digital evidence should also be considered in the procedures and methods for the seizure of voluntary submissions of digital evidence. If the digital eivdence seized without considering special feature of digital evidence, there is a risk of the eligibility of inadequate arbitrary submitters due to feature of dual evidentiality and violation of due process with relevant evidence selection in voluntary submission.

        과학을 이용한 영어 통합수업 방법과 효과

        This study examined how to teach English using science contents in an elementary English classroom. This study first proposed an integrative teaching plan using science contents in the elementary English classroom. Then, this study examined this plan during the second semester in 2020. There were 90 participants, all 5<sup>th</sup> year elementary school students. They were divided into two groups, control and experimental. Both the control group and the experimental group were composed of 45 students each. All the participants in the experimental group were integratively taught using science contents. All the participants in the control group were taught based on the elementary English curriculum. All of the participants were also given a before and after-achievement test and a questionnaire on affective domains. It can be concluded that the experimental group achieved higher than the control group. Additionally, the experimental group showed a greater degree of interest than the control group. It is, therefore, recommended that teachers use contents from other subjects more often to teach elementary school students. As well, teachers should be given sufficient time to do research at their schools. It is also recommended that teachers be allowed to create teaching materials with no restrictions regarding the integrative English teaching plan.

        차량선형 유도형 가로등을 위한 제어시스템의 설계

        본 연구는 야간에 자동차전용도로에서 통행이 없는 시간대에는 가로등을 소등하고 차량이 통행시에는 운전자의 일정한 시거 확보를 위하여 가로등이 순차적으로 점등되는 방안에 대하여 설계하였다. 야간 주행에서 연속조명 및 국부조명의 경우에도 운전자의 안전운전을 위해서는 유도등은 시거를 확보해야한다. 시거는 연속된 도로의 진행방향과 정지를 위한 안전거리 확보 측면에서 필요하며 차량이 통행시 시거 구간내의 가로등은 항상 점등이 되어있어야 한다. 향후 LED가로등이 지속적으로 보급됨에 따라 야간에 차량통행이 없는 경우 LED 가로등을 소등함으로써 에너지 절감 방안을 구현하는 수리적 모델의 기초안을 제시하고자 한다. 차량의 위치는 압전 방식의 판넬을 제안하였으며 압전판넬은 향후 회수가능한 에너지, 교통량 정보 수집, 과적 차량 판별 등에 활용 가능하나 본 연구에서는 압전판넬로 차량의 위치만을 파악한다는 가정하에서 수리모델을 수립하였다. 본 연구를 통하여 향후 가로등의 점멸을 통한 에너지 절감방안을 수립하는데 기여하고자 한다. The study designed a solution with which street lights are sequentially turned on in order to turn off street lights during the time when there is no traffic at night on a drive way and to ensure a certain sight distance of a driver during the time when there is the passing traffic. For the safe driving of a driver, even for continuous lighting and local lighting during driving at night, a leading light must ensure a sight distance, A sight distance is necessary in terms of ensuring a direction of progress of continuous roads and a safe distance for stopping, and street lights within the sight distance section during the traffic of vehicles should be always turned on. Therefore turning on and turning off of street lights are determined by the location of vehicles, and the location of vehicles may be determined by the existence of electric current which occurs on a piezoelectric panel during the passing of a vehicle by installing the piezoelectric panel on the road. In this study, to determine the piezoelectric panel to identify the location of the vehicle only under the assumption that the mathematical model was established. Through this study, street light flashing through the establishment of energy-saving measures is to contribute to.

        시뮬레이션을 이용한 전기택시 충전가격 연구

        The study reviewed the electric taxi business with most sensitivity in the unit price computation of power charging business. Electric taxi has the longest daily mileage and is the first to face battery deterioration; therefore, the electric taxi business will need to spend a large amount of money for battery replacement and profit availability is very flexible in terms of the unit price of power charging. To apply costs according to battery replacement demand, we estimated annual battery prices. In addition, we conducted an analysis for the unit price of power charging that reaches the break-even point through an electric taxi simulation based on the daily mileage of taxi. This study compared fossil fuel cost of taxi, which has the longest daily driving distance, to set an ideal charging fee standard for EV(Electric Vehicle). It suggested that the ideal annual driving distance of EV should be at 100,000 km to reach break-even point of 403 KRW per 1kWh. In case of introducing EV taxi, additional paying method(subsidy or additional fee) should be considered for single charging fee system in existing charging station, if necessary.

        초등학생들의 영어 자신감 정도와 원어민 영어수업 평가와의 관계성 연구

        The primary purpose of this study was to investigate the relationship between elementary school students’ self-confidence in English as a foreign language and their assessment of English teaching taught by native speaker English teachers. A total of 126 elementary school students were asked on a 5-point Likert scale instrument to assess their native English teachers in terms of their teaching ability, provision of opportunity to use English, classroom management, and language assessment ability. In addition, the subjects were asked to rate how much they were confident with their English. All of the responses were submitted to the SPSS 22 version for statistical analyses. Firstly, the subjects were divided into 3 groups based on how much they felt confident with their English. Secondly, a MANOVA was run to investigate any group differences in how they perceive their native speaker teachers’ teaching ability, provision of opportunity, and language assessment ability. The results indicated that language confidence was indeed an important variable not only in subjects’ learning English but also how they perceived their English learning experience as a whole. Pedagogical implications for improving elementary school children were also discussed.

        플로팅 링 베어링으로 지지된 터보차저 로터의 안정성 해석

        The use of turbocharger in internal combustion engines has increased as it is a key components for improving system efficiency without increasing engine size. Because of increasing demand, many studies have evaluated rotordynamic performance so as to increase rotation speed. This paper presents a linear and nonlinear analysis model for a turbocharger rotor supported by a floating ring bearing. We constructed rotor model by using the finite element method and approximated bearings as being infinitely short. In the linear model, we considered fluid film force as stiffness and damping element. In nonlinear analysis, calculation of the fluid film force involved solving the time dependent Reynolds equation. We verified the developed model by comparing the results to those of previous research. The analysis results show that there are four unstable modes, which are rigid body modes combining ring and rotor motion. As the rotating speed increases, the logarithmic decrement shows that certain unstable modes goes into the stable area or the stable mode goes into the unstable area. These unstable modes appear as sub-synchronous vibrations in nonlinear analysis. In nonlinear analysis frequency jump phenomenon demonstrated in several experimental studies appears. The analysis results also showed that frequency jump phenomenon occurs when the vibration mode changes and the sequence of unstable mode matches the linear analysis result. However, the natural frequency predicted using linear analysis differs from those obtained using nonlinear analysis.
