        테러범죄에 대한 수사 관련 입법방향

        테러의 위협이 전 세계적으로 심각해짐에 따라 오래 전부터 테러에 대비하기 위한 다양한 방안을 마련해 오고 있다. 최근 국내에서도 테러 대비의 필요성이 점차 대중적으로 인식되어 가고 있고 아울러 테러대응 입법에 대한 관심도 날로 증가하고 있다. 향후 테러대응법이 제정된다면 수사 관련 제도와 절차들은 테러범죄와 그 수사방법의 특성을 감안하였을 때, 기존의 일반범죄 수사에서 인정되거나 준수되어야 하는 각종 원칙이나 요건들을 완화하는 수준에서 결정될 수밖에 없을 것이다. 이에 실제 법 시행과정에서 인권침해 논란이 제기될 가능성도 농후하여 향후 많은 갈등의 소지가 있다. 우리나라에서는 종합적이고 체계적인 테러대응법제가 마련되어 있지 않고, 테러에 대비하기 위한 기반조차 조성되어 있지 않다는 문제가 있어 왔다. 이러한 현실을 반영하여 테러에 대비하기 위한 기본법을 마련하기 위한 논의가 활발히 이루어지고 있으며, 특히 수사절차와 관련된 부분에 주목하여 한다. 이와 관련하여 이미 발생한 테러상황을 신속하고 효과적으로 대처하고 진압하기 위해서는 기존 형사소송법 등이 정하고 있는 일반적 수사절차와는 별도로 테러범죄의 특성을 감안한 효율적인 수사절차를 마련할 필요가 있다. 테러범죄에 대한 수사는 대상의 특수성을 감안하여 테러범죄에 대한 효과적인 대응과 국민의 인권보장 사이의 어느 지점에 조화로운 절충의 여지가 있는지 고민할 필요가 있다. 이 연구에서는 테러범죄에 대한 수사와 관련된 입법사항에 대해 연구하고자 한다. 효과적인 테러범죄수사를 위해서는 합동수사본부 설치, 불심검문 제도 보완, 통신제한조치 절차 보완, 압수수색 절차 보완, 체포·구속 절차 보완, 공소시효 배제 방안, DNA 신원확인정보 수집 방안, 플리바기닝 제도 도입, 비밀수사관 제도 도입 방안 등이 논의되어야만 한다. We prepared various counter-measures to protect against terrorism depending on the threat of terrorism around the world for a long time. In recent, domestic terrorism popularly recognized the need to go gradually, and the legislative response to terrorism as well as interest has been growing. Criminal investigation and terrorism-related systems and procedures that shall take into account the nature of investigative methods if Terrorism Response Act enacted in the future. In this way general criminal investigation or other principles or requirements that must be observed at the level of mitigation would have to be determined. It also, the process of actual law enforcement be going to raised the possibility of a controversial human rights violations and the possibility of many conflicts. Comprehensive and systematic counter-measures movements work abnormally to terrorism in our country and prepare for terrorism is not based, even nurtured, there has been a problem. This reflects the reality of terrorism and to prepare for discussions to prepare the Basic Law has been active. In particular, the investigation should focus on procedures. In this regard, generally Criminal Procedure Law separate from the nature of terrorism, taking into consideration the need to develop effective investigation procedure in order to quickly and effectively deal with terrorism that already occurred the situation. The investigation of terrorist crimes necessary to consider by considering the characteristics of a target for terrorism and the rights of its citizens to ensure an effective response. In this study, legislation for investigation related to terrorist crimes is to study for establishment of joint investigation center, supplement of stop and question, procedure improvement of communication minimize, improvement of search and seizure and arrest, exclusion of statute of limitations, identity collection of DNA, introduction of plea bargaining and undercover investigator.

        인라인 스케이트 활주속력에 따른 T-Stop의 운동학적 분석

        The purpose of this study was to investigate the kinematical analysis of T-stop motion by inline skate rolling speed. Six subjects were participated in the experiment(age: 35.0±3.3 yrs, weight: 72.7±5.1 kg, height: 176.3±3.1 cm, career: 10.0±2.5 yrs). The study method adopted 3-dimensional analysis and 2 cameras for filming to analyze the required displacement of center of mass, displacement of right and left hip joint, displacement of right and left knee joint, displacement of trunk tilt using by APAS. The results were as follows; In anterior-posterior displacement of COM, the faster rolling speed, the longer displacement at phase 2. In vertical displacement of COM, the faster rolling speed, the lower displacement. In medial-lateral displacement of COM, there was no significant on rolling speed. In angular displacement of right thigh segment, the faster rolling speed, the bigger displacement in X and Z axis. In angular displacement of left thigh segment, the faster rolling speed, the lower displacement in X axis. In angular displacement of right shank segment, the faster rolling speed, the bigger displacement in Z axis. In angular displacement of left shank segment, the faster rolling speed, the bigger displacement in X and Y axis. In angular displacement of trunk segment, the faster rolling speed, the bigger displacement in Z axis.

        혈중알콜농도 상승기와 관련한 음주운전 사건 판례의 동향

        음주운전 일제단속 현장이 아니라 교통사고 등에 수반하여 우연히 발견된 음주운전 행위의 경우 대개 운전시점에 즉시 음주측정이 되지 않고 상당한 정도의 시간이 경과한 후 음주측정이 이루어진다. 그런데 이 중 음주시점과 운전시점 사이의 시간적 간격이 짧아 혈중알콜농도의 상승기 내지 불명기 이내에 운전을 한 경우에는 한참 후에 측정된 혈중알콜농도를 토대로 운전 당시의 실제 혈중알콜농도를 산정하거나 입증하기 곤란하게 될 수 있다. 우리 대법원은 운전시점과 측정시점 사이에 시간적 간격이 있고 운전시점이 혈중알콜 농도의 상승기 내지 불명기로 보이는 경우라고 하여 운전시점의 혈중알콜농도가 처벌기준치를 초과한다는 점에 대한 입증이 불가능하다고 볼 수는 없고, 이를 입증하기 위해서는 운전시점과 측정시점 사이의 시간적 간격, 측정된 혈중알콜농도의 수치와 처벌기준치의 차이, 음주를 지속한 시간 및 음주량, 단속 및 측정 당시 운전자의 행동양상, 교통사고가 있었다면 그 사고의 경위 및 정황 등 여러 사정을 종합하여야 한다는 입장이다. 음주운전 범죄에 대한 지속적인 단속과 엄정한 처벌이 더욱 요구되는 요즘 상황에서, 단속실무상 음주측정에 소요될 수밖에 없는 시간적 간격, 그리고 시간 경과에 따라 체내 알콜의 농도가 변화한다는 우연한 사정을 기화로 형사사법제도의 공백이 발생하는 것을 막을 필요가 있다. 이를 위해, 향후 단속현장에서의 신속한 단속과 음주측정, 운전자의 음주사실 자체에 대한 철저한 증거 수집, 그리고 예비적 공소제기와 예비적 공소장변경 등 적절한 공소유지 방안 등이 요망된다. A drunk driving is prohibited, the nationwide crackdown on drunk drivers is always being launched, and the concentration of alcohol in the blood exceeding a certain reference will be punished. If the operation is begun as soon as a drink and the crackdown is launched after flowing a lot of time to the operation, it is not easy to prove the accurate blood alcohol concentration at that time of the operation. Since the blood alcohol concentration is being on the rise at the time of the operation. In such a case, the Korean Supreme Court gave decisions that it is not impossible to prove the blood alcohol concentration at the time of the operation despite the time interval between the times of an operation and a crackdown. And it also decided that it is possible to prove the blood alcohol concentration at the time of the operation by the difference between the measured alcohol concentration with a reference alcohol concentration to be punished, the time and the amount of the driver’s drinking alcohol, the driver’s any action and attitude at the time of the crackdown, (if there was any traffic accident) the appearance of the accident. There is a need to heavily punish the act of drunk driving. For this, quickly crackdown at the place of the crime, thoroughly investigating the facts of the crime, thoroughly equipped in the trial.

        1) 프랑스 검사의 지위와 기능 : 최근 동향을 중심으로

        The fact that there is a trial judge in the French criminal procedure makes it difficult to compare it with the criminal procedure in Korea. Since the trial judge plays a role similar to prosecutor of our country, it is difficult to directly compare the prosecutor of Korea and France. For example, in Korea, there is a misconception that the French prosecutor does not have the authority to investigate, but the French prosecutor is in charge of prosecution and has the authority to investigate in accordance with the provisions of the Criminal Procedure Act. France is fighting crimes such as international terrorist crimes, large financial and economic crimes, multinational organized crime and drug crimes. It is steadily strengthening measures to prevent crime, punish criminals promptly and secure social safety. According to this social situation, the role of prosecutors is considered to be important, the authority of prosecutors is increasing and people have great expectations about prosecutors. While the scope of prosecutors is expanded to protect the society against crime, countermeasures are also being prepared to strengthen the political neutrality, objectivity and fairness of prosecutors. However, it is not yet clear whether attempts to do both will succeed.

        인라인하키 스위프 샷 시 퍽의 위치에 따른 운동학적 분석

        The purpose of this study was to analyze kinematic variables on position of puck during sweep shot in In-line hockey. Six elite university of both ice-hockey and in-line hockey players were participated in this study for the comparison. The 3D kinematic data were collected for each puck position during sweep shot. Conclusion is as following. In displacement of left hip joint, RP group was more extended at event 1. In displacement of right hip joint was no difference at each event. In displacement of left knee joint, RP group was more extended at event 1, CP group was more flexed at event 3, and RP group was more extended at event 4. In displacement of right knee joint was no difference at each event. In displacement of left shoulder joint, LP group was more flexed at event 1, and CP group was more flexed at event 2. In displacement of right shoulder joint, LP group was more flexed at event 1. In displacement of left elbow joint, LP group was more flexed at event 1, and LP group was more extended at event 2. In displacement of right elbow joint, LP group was more flexed at event 1. In displacement of hockey stick head, moving on the list were RP, CP and LP. In velocity of hockey stick head, RP group was the fastest at event 2.

        인라인하키 슈팅방식에 따른 슬랩 샷 동작의 운동학적 분석

        The purpose of this study was to analyze kinematic variables on three swing shot during slap shot in In-line hockey. Six elite in-line hockey players were participated in this study. The 3D kinematic data were collected for each swing shot(standing shot, dribble shot, skating shot) during slap shot. The results were as follows; In medial-lateral displacement of COM, standing shot was the lower displacement during both top-swing and impact event. In vertical displacement of COM, dribble shot was the lower displacement during top-swing. In anterior-posterior displacement of COM, there was no significant on shot types. In stick head velocity, skating shot was the fastest during impact. In angular displacement of left knee joint, skating shot was the bigger extension during top-swing, in those of right knee joint, dribble shot was bigger flexion during impact. In angular displacement of right hip joint, dribble shot was the bigger flexion during top-swing. In angular displacement of left shoulder joint, dribble shot was the bigger flexion during impact. In angular displacement of elbow joint, there was no significant on shot types.

      • 헤드-디스크 인터페이스에 주입되는 입자의 영향에 대한 연구

        Particles in the HDD can cause serious damages such as scratches and thermal asperity(T A) at the head/disk interface(HDI). Accordingly, particles cause data loss including physical and electrical damages. To improve the reliability of head-disk interface, understanding the damage characteristics at the HDI due to particle interactions is required. The materials such as Ab03, TiC and aluminum were used in this experiment. The size and hardness of particles injected into the HDI are closely relevant to surface damage caused the data loss on the disk and head. In this paper, a variety of scratches were analyzed using scanning electron microscope(SEM) and atomic force microscope(AFM). In order to analyze defects of very small size on the disk, optical surface analyzer(OSA) was also used.

        체간의 운동연쇄 형태에 따른 운동역학적 분석

        The purpose of this study was to investigate the trunk rotation type by wheel and axle. In order to analysis, 3D-motion analysis and electromyography were conducted on kinematic variables, impulse, average-EMG and integrated-EMG. Twelve healthy (age: 21.8±2.2 yrs, height: 175.4±5.0 cm, weight: 66.7±6.4 kg) participated in the experiment. The results were as follows; in hand`s velocity and acceleration, wheel and axial rotating movement using kinematic chain(type 3) were much faster. In impulse, type 3 was much stronger. In average-EMG, right and left, latissimus dorsi muscles was much stronger. In integrated-EMG, left erector spinae, right/left latissimus dorsi, and left external oblique muscles was much stronger. These results considered that, in the trunk rotation utilizing the kinematic chains action, latissimus dorsi muscles highly contribute to the muscle utilization that makes the rotating movement maximally effective.
