대학교수 발명의 특허 소유권 및 인센티브 제도에 관한 비판적 검토

이 연구는 대학교수의 발명에 대해 직무발명 해당여부, 특허권리 귀속관계 및 금전적인센티브의 쟁점사항을 중심으로 검토하였으며 그 결과는 다음과 같다. 첫째, 종래 대학교수의 통상·일상적인 연구 성과로 발생된 특허는 교수개인의 자유발명으로 보아 교수개인이 소유하여야 한다는 견해가 통설적이었으나, 이 연구의 견해로 이들 특허권은 대학교수의 자유발명으로 취급되어 교수개인이 소유하는 것이 아니라 대학의 직무발명으로 취급되어 대학의 산학협력단이 소유해야 한다는 것을 입증하였다. 둘째, 연구개발비를 국가, 기업 등이 단독·공동으로 지원하여 연구개발한 대학교수의 발명은 대학의 직무발명에 해당되므로 대학의 산학협력단이 그 특허권을 단독 또는 공동 소유하는 것이 바람직한 방향으로 검토되었다. 셋째, 대학교수, 연구기관 연구원, 공무원 등의 직무발명에 대한 인센티브 지급금액을 비교·검토해 본 결과 대학교수, 공무원, 연구기관 연구원순으로 더 많았으며, 일부 대학에서 교수의 인센티브 지급비율은 선진국에 비해 제도상으로 거의 2배 수준에 이르는 것으로 파악되었다. 이에 인센티브의 지급비율을 선진국 수준으로 조정·검토하는 것이 바람직하다고 하겠다. This study reviews the system of employees’ inventions by university professors focusing on the boundary of employees’ inventions (i.e., whether an invention can be regarded as an employee’s invention), the reversion of the rights, and the financial incentives. The results are as follows: First, traditionally, university professors’ inventions has been considered as free inventions, while this study suggests that university professors’ research results should be taken as employees’ inventions. Second, the industry-university cooperation foundation should have the intellectual property rights of the inventions since university professors’ inventions fall under the employees’ inventions when the funding of their research comes from the government or enterprises individually or cooperatively. Third, the comparisons show that professors, civil servants and researchers at research institutes are ranked in order of the amount of incentive paid to them and that the ratio of the incentive paid to professors is almost up to double than that of advanced countries. It suggests that the ratio should be readjusted to the level of those other countries.

There are a lot of different types of noise from construction site and it depends on construction stage, equipment type and number of operating equipments. The problem is almost noise from construction site is high level and some kinds of noise levels are over 100dB. In addition, if construction site is located in downtown, there are a few options to reduce noise level. Therefore several site mitigation plans are developed to reduce different types of construction noises and it is applied in site and evaluated noise reduction performance in this study.

The noise by the construction activities is one of the main issues in Korea. To prevent the noise from construction site, construction company installs temporary noise barriers along the construction site boundary. Normally sound insulation performance ($R_w$) of the temporary noise barriers made by metal or plastic is between 18 and 31 dB and metallic noise barriers are around 5 dB higher than plastic noise barriers. Sound absorption performance (NRC) of the temporary noise barriers are between 0.20 and 0.59 so it's difficult to characterize their acoustic performance. In this study, it has founded that sound insulation performance of the temporary noise barrier has been improved about 3dB by stick the high density acoustic sheet and insertion loss of noise barrier is getting increased as the source and receiver approached the temporary noise barriers.
공동주택 승강기 운행시 인접세대에서의 소음 및 진동 특성

This study aimed to evaluation the noise and vibration with elevator operation in apartment houses. The main flat shape of the apartment house is supplied in the form of an overhead type rather than a corridor plan type. When the elevator hall and the main building are adjacent to each other, many complaints are generated. In this study, the noise and vibration characteristics during the elevator operation were evaluated. As a result of measurement of vibration and noise level in the inside of the elevator passageway, the maximum vibration acceleration levels at the floor and side walls were 51.5 dB and 42.5 dB, respectively, and the maximum noise level in the room was 35.9 dB (A) . The noise level of 40dB (A), which is the design standard of apartment house, was found to be acceptable. However, the noise level of 10dB (A) was more than 10dB (A).

The measurement of ionization current (IC) in internal combustion engine (ICE) cylinder is one of perspective methods of combustion control. There are a number of researches utilizing the ionization probe as a sensor for the burning quality measurement and knocking regime detection in spark ignition engine (SIE) and diesel engine (DE). The spark plug and glow plug as ionization probe can be used for spark ignition engine and diesel engine. It is known that the peak of chemical ionization of combustion products occurs immediately behind front flame when front flame propagates through fuel-air mixture. The electrical conductivity of combustion products sharply increases in the range of peak. The combustion processes and the moving of combustion products in cylinder are accompanied as a rule by oscillation phenomena. In this paper, the nature of these oscillation is analyzed by comparing of pressure and IC measurements. It is shown that the principle oscillation of regular type as entropy waves. acoustic oscillation and relaxation oscillation when gas flows from half-closed volume(for example from DE prechamber) can exit in cylinder.
