입체권리공간 도입에 관한 연구

민법은 토지소유권의 범위를 정당한 이익이 있는 토지의 상·하에 미친다고 규정하고 있다. 그러나 토지의 경계를 등록하는 지적제도는 이러한 입체권리공간을 등록·관리하고 못하고 있는 실정이다. 따라서 입체권리공간 등록을 위한 환경분석과 등록대상물을 구분하였고 해외 사례와 관련 법령을 조사하였다. 연구결과 입체권리공간의 등록방법과 구분지상권 설정 표준안을 마련하였다. 또한 입체권리공간의 도입을 부동산등기법, 부동산등기규칙, 구분지상권에 관한 등기처리요령, 공간정보 구축 및 관리 등에 관한 법률, 공간정보 구축 및 관리 등에 관한 법률 시행규칙의 개정안을 제시하였다. 향후 연구로는 구분지상권 등록부 작성, 입체권리공간의 측량방법, 효율적 관리방안에 관한 연구가 필요하다.

연속지적도와 국토정보기본도 통합을 위한 활용지적도 도입 제안 연구

2008년 정부의 조직개편에 따라 지적업무가 행정안전부에서 국토교통부로 이관 되었고 2009년 지적도, 지형도, 해도가 서로 불일치하여 국가지리정보산업의 발전에 지장을 초래하는 문제를 해소하기 위해 ｢측량･수로조사 및 지적에 관한 법률｣이 제정되어 현재는 ｢공간정보의 구축 및 관리 등에 관한 법률｣로 명칭이 변경되어 시행되고 있다. 지적도면은 한국토지정보시스템 구축사업의 일환으로 구축 완료되어 현재 연속지적도 형태로 제작되어 지형정보와 융합되어 운영되고 있으나 여전히 지형과 지적이 불일치하여 운영되고 있다. 최근 한국국토정보공사는 정사영상과 지적측량 정보를 활용하여 국토정보기본도를 구축하였다. 연구결과 국토정보기본도가 정사영상, 수치지형도와 상당히 일치함을 확인할 수 있었으며 연속지적도와 국토정보기본도를 통합할 수 있는 도면으로 활용지적도를 정의하고 도입 필요성에 대하여 연구하였다. 활용지적도가 도입된다면 지형과 지적이 불일치하는 부분이 상당히 해결되는 것으로 분석되었다. With the reorganization of the government in 2008, cadastral work was transferred from the Ministry of Public Administration and Security to the Ministry of Land, Infrastructure and Transport. In 2009, Hydrography and Cadastral Act Survey was enacted to solve problems that interfere with the development of the national geographic information industry due to inconsistency in cadastral maps, and charts, and is currently being renamed the Spatial Information Construction and Management Act. The cadastral map was constructed as part of the Korea Land Information System construction project and is currently produced in the form of a continuous cadastral map and is operated in fusion with topographic information, but the topography and cadastral are still operated inconsistent. Recently, LX Corporation established a basic national land information map built using Ortho Photograph and cadastral survey information. As a result of the study, it was confirmed that the basic map of national land information was quite consistent with the Ortho Photograph and digital map. the utilization cadastral map that can integrate the continuous cadastral map and the basic map of natio1. nal land information was defined and the necessity of introduction was studied. It was analyzed that if the utilization cadastral map is introduced, the inconsistency between the topography and the cadastral map is significantly solved.

지방자치단체의 공간정보 조례에 관한 연구

공간정보 업무는 「국가공간정보 기본법」을 근거로 하여 중앙행정기관, 관리기관, 공공기관, 민간기관에서 운영하고 있다. 지방자치단체는 관리기관에 해당하며 국민의 공간정보복지 증진, 공간정보정책 시행계획, 공간정보 표준화, 공간정보 데이터베이스의 구축 및 관리, 중복투자의 방지, 공간정보 목록정보의 작성, 협력체계의 구축, 공간정보의 공개 등의 업무를 추진하고 있다. 지방자치단체가 공간정보 업무 추진과 관련하여 조례 제·개정의 몇 가지 방향을 도출하였다. 첫째, 법령에 규정한 내용은 조례에서 다시 정하지 않는다. 둘째, 지방자치단체에서 추진하고 있는 공간정보 업무를 구체적으로 조례에 포함한다. 셋째, 관내 민간기관에서 생산 관리하는 공간정보의 구축 및 활용을 위해서 민간기관이 포함된 협의체를 구성한다. 넷째, 법령에서 정하지 못한 용어는 조례에 포함한다. 다섯째, 지방자치단체의 공간정보 업무 총괄부서와 실무부서를 지정한다. 지방자치단체가 효율적인 공간정보 구축과 활용을 위해서는 공간정보협의회, 도시기준점, 도로기반시설물, 총괄부서, 실무부서가 조례에 포함되어야 할 것이다. Geospatial Information work is operated by central administrative agencies, management institutions, public institutions, and private institutions which based on the Framework Act on National Geospatial Information. Local governments are management agencies, and promoting public space information welfare, implementation plan, standardization, establishment and management of space information databases, prevention of overlapping investment, creation of space information list information, cooperation system, and disclosure of space information. Local governments have derived several directions for enacting and revising ordinances in relation to promoting spatial information work. First, the contents stipulated in the statutes are not redefined in the ordinance. Second, Geospatial Information work promoted by local governments is specifically included in the ordinance. Third, a consultative body including private institutions is formed to establish and utilize Geospatial Information produced and managed by private institutions in the jurisdiction. Fourth, terms not prescribed in laws and regulations are included in the ordinance. Fifth, the general department and the working department of Geospatial Information affairs of local governments are designated. In order for local governments to efficiently construct and utilize spatial information, the ordinance should include the Spatial Information Council, city reference points, road infrastructure, general affairs, and working departments.

서울특별시 1/1000 수치지형도 활용도 향상 방안 연구

서울시는 국가지리정보체계 구축계획에 따라 1996년도부터 수치지형도를 제작하여 통합공간정보시스템을 통하여 필요부서에 제공하고 있다. 최근 5년간의 통합공간정보시스템을 통하여 제공된 수치지형도 활용도 현황을 분석하였다. 분석결과 수치지형도 제작 목적과 부합하는 계획 및 설계 분야가 가장 많은 활용분야로 나타났으나 수치지형도의 전체적인 자료제공 건수는 매년 감소되는 것으로 분석되었다. 레이어의 활용도 분석결과 건물, 도로면, 경계, 보도면 순으로 활용도가 높은 것으로 분석되었으나 서울시에서 활용도가 높은 도시기본공간정보 15종에는 수치지형도가 1종만 선정되었다. 수치지형도 활용도 향상을 위해서는 5년 단위 권역별 갱신체계를 활용도가 높은 레이어를 기반으로 실시간 또는 1년 단위 갱신이 필요하며, 수치지형도 제작과정에서는 더 많은 서울시의 역할이 필요하였다. 또한 88개 레이어는 도시특성과 활용도를 반영하여 새로운 체계로 전환이 필요하며 서울시가 국토지리정보원과 상호 협력한다면 1/1000 수치지형도 활용도 향상을 선도 할 것으로 기대된다. The Seoul Metropolitan Government has been making digital topographical maps since 1996 based on the National Geographic Information System construction plan and providing them to necessary departments through the Spatial Data Warehouse. The current state of utilization of digital maps provided through the Spatial Data Warehouse over the past five years was analyzed. As a result of the analysis, it was found that digital topography map is also one of the most frequently used areas of planning and design that matches the purpose of production, but the number of data provided on digital topography map is decreasing every year. As a result of the layer utilization analysis, it was analyzed that the utilization rate of buildings, roads, boundaries, and sidewalks was high, but only one digital topography map was selected as one of the 15 most highly utilized Basic Urban Spatial Information types in Seoul. In order to improve the degree of utilization of digital map, it was necessary to update them in real time or every year based on the high level of utilization of the area-specific update system every five years, and the role of Seoul Metropolitan Government in the construction process of digital map was also required. In addition, 88 layers had to be transformed into a new system, reflecting the characteristics and utilization of the city. If Seoul cooperates with the Geographical Information Service, 1/1,000 digital maps are expected to lead the improvement in utilization.

법원의 확정판결에 따른 지적측량적부심사 제도 개선방안

지적측량적부심사 제도는 지적측량성과에 대하여 다툼이 있는 경우 토지소유자, 이해관계인 또는 지적측량수행자가 청구하는 제도이다. 지적측량적부심사를 수행하는 지적위원회는 신속한 결정을 위해 몇몇의 전문가가 몇 번의 심사를 거쳐 지적측량의 적부 판단을 한다. 그러나 토지경계와 관련하여 법원의 확정판결과 지적측량적부심사 청구의 불명확한 관계가 불필요한 행정력 낭비를 발생시키고 있다. 따라서 본문에서는 지적측량적부심사제도의 이론적 고찰 사례분석을 기반으로 법원의 확정판결에 따른 지적측량적부심사 법령개선(안)을 포함하는 지적측량적부심사 제도 개선을 제시하였다. Cadastral surveying screening is system which is claimed by a landowner, an interested party or a cadastral attendant if the argument occurs about cadastral measurement. Cadastral commission performing cadastral surveying screening judges suitability of cadastral measurement for prompt decisions through several examinations by experts. However, indefinite relationship between court's judgment and cadastral surveying screening in reference to land economics has been leading to unnecessary waste of administrative power. Consequently, in this paper, improvement of cadastral surveying screening system including its ordinance improvement based on theoretical consideration, case analysis is suggested.
