공무원 부문 장애인 고용부담금 부과 제도의 쟁점에 관한 연구

The purpose of this study investigated anticipated issues in the implementation of the levy system for the employment of persons with disabilities and seeking the possible solutions countermeasures in the public sector. In the preliminary survey, we conducted telephone and internet surveys to four mandatory employment- granting agencies and three non-implementing agencies that allowed the survey. It was controversial that the levy of the employment was contradictory and necessary to improve conditions for employment of persons with disabilities before the levy was handled. The main issues include insufficient legal justice issues related to social solidarity, equity issues with other disabled employment systems, categories of mandatory employment for civil servants, occupational categories and applications, selection of institutions to be imposed, uncertainties in the operation of contributions,In conclusion, establishment of a relevant department to charge within the institution, adoption of differential methods considering the specificity of individual institutions, the estimation of the appropriate employment rate per institution, introduction of positive incentive system are needed. 「장애인고용촉진 및 직업재활법」 제32조의2에 따라 2020년부터 의무고용률에 못 미치는 장애인 공무원을 고용한 기관의 장도 고용부담금을 납부하게 된다. 본 연구는 제도의 실행 시 예상되는 쟁점들을 다루고 대응방안을 모색한다. 연구방법은 예비조사 형식으로, 조사를 허락한 의무고용 이행기관 4곳과 비이행기관 3곳에 대해 전화와 인터넷 설문을 실시했다. 연구 결과, 기관의 특수성에 따른 장애인 공무원 고용의 어려움, 장애인 고용에 대한 긍정적 인식과 고용유지를 위한 기관의 노력, 고용부담 증가를 위한 장애인 고용부담금 예산 마련 및 부과방식의 개선, 장애인 고용부담금 제도의 보완 등의 의견이 있었다. 주요 쟁점으로는 사회연대 책임과 관련한 불충분한 법적 정당성 문제, 다른 장애인고용 제도와의 형평성 문제, 공무원 부문 의무고용대상자 범주와 적용제외 직종 문제, 부과대상 기관 선정 문제, 부담금 운용의 불명확성 문제, 부담금 산정문제 등이 제기되었다. 대표적인 대응방안과 선결과제로는 기관 내 담당 관련 업무 부서를 신설하고, 개별 기관의 특수성을 고려한 부담금 차등부과 방식과 기관별 적정 의무고용률 산정, 긍정적인 유인제도 도입 등을 논하였다.

대한건축사협회 50년 동안 제도의 생성과 흐름을 이해하는데 먼저 제도란 무엇인지에 대한 이해가 필요하다. 제도는 규범의 복합체라고 한다. 규범의 내용이 형식화되고 정리되어 공권력을 수반하는 법률에서부터 형식화되지 않은 채 일상생활에서의 막연한 약속과 같은 집단의 도덕적 기준이나 관습에 이르기까지 그 범위는 광범하다. 즉 정치 경제 교육 제도 등에서부터 도덕이나 언어와 같은 것까지 포함한다. 이 제도가 존재함으로써 사회를 구성하는 모든 개인의 행동은 얼마간 틀에 박히고 방향이 부여되기 때문에 사람들을 시행착오의 낭비를 절약하여 큰 불편 없이 어느 정도 자동적으로 행동할 수 있다. 이런 점에서 제도는 사회질서 유지를 그 중요한 기능으로 하는 한편 모든 개인의 자유를 다소나마 규제하고 부자연스럽게 하는 측면도 있다. 모든 개인에 대한 제한이나 속박이 심해져 정상적인 대다수의 개인의 생활요구가 자해되고 억제되는 정도가 지나치게 되면 그 사회의 가치체계나 규범이 흔들리기 시작하며, 마침내는 기존의 제도가 바뀌고 새로운 제도가 생기게 된다고 한다.

수도요금 규제체계 선진사례 (영국의 가격상한제를 중심으로)

광역상수도 등 공공요금의 규제 목적은 소비자에게는 공공서비스를 적정한 가격으로 이용하여 자원 배분의 효율성 도모하고, 사업자에게는 사업에 소요되는 원가를 보전하여 지속가능한 공공서비스를 제공하도록 하는 것이다. 하지만 현재전기, 수도 등 공공요금 규제는 사업자의 원가를 보상하지 못하는 수준에서 이루어지고 있어 공공서비스의 과소비와 사업자의 재무상태가 악화되고 있다. 현행 요금 조정은 합리적 기준에 의한다고 보기 어려운 점이 많다. 반면, 영국의 가격상한 제는 사업자의 중장기 사업계획, 투자계획 등 소요되는 원가를 바탕으로 사전에 요금 상한을 책정하고 있다. 이를 통해 사업자에게는 적정한 투자를 유도하고 소요되는 원가를 보전하는 요금을 책정하여 예측가능한 경영과 소비가 이루어지도록 하는 제도를 갖고 있다. 본 논고에서는 영국의 가격상한제를 중심으로 공공요금 규제체계 선진 사례를 제시하였다 The purposes of regulating the prices of public services are to promote efficient use of public services and to compensate the costs of services provided by public utilities. However, the current regulatory system does not compensate the full cost of public services, as a result, Korean utilities such as Kepco or K-water have struggled with heavy financial debt loads. It is hard to say the regulatory system on water tariff is reasonable. On the other hand, in the U.K., ‘Price Limits’ have been adopted as a regulatory system on water tariffs. The regulatory authority sets the water tariff every five year in advance on the basis of full service costs, business plan and investment scheme analyses. This system allows the water utilities to control their business risks and customers’ use of water resources more efficiently. This paper will examine the advanced regulatory system for water tariffs based on the price limits used in the U.K.

장애모델의 발전사를 통해 살펴 본 긍정적 장애모델의 특성과 함의

본 연구는 긍정적 모델을 중심으로 기존 장애모델들이 갖는 한계점들을 살펴보고, 긍정적 모델이 갖는 함의가 장애에 대한 기존의 관점들을 어떻게 보완하는지와 향후 장애에 대한 어떤 접근법이 전망되는지 고찰한다. 긍정적 모델은 장애와 손상을 반-비극적 관점으로 보고 긍정적인 장애정체성을 가질 것을 주장하는 모델이다. 긍정적 모델에서 손상과 장애는 누구에게나 일어나는 일상적인 삶의 부분이며, 장애인에게는 자신의 삶을 구성하는 정체성의 한 부분이다. 하지만 장애인의 개인적이고 심리적인 반응을 가지고 손상과 장애에 의미를 부여한다는 점에서 장애인들이 겪는 사회의 여러 장애문제에 대한 구체적인 해결책을 도출하기 어렵다. 따라서 추후 장애모델에 있어서는 기존 장애모델들의 한계점들을 중심으로, 특별히 장애정체성 을 논의함에 있어서 직면하는 여러 문제들을 고려해야 할 필요가 있겠다. The purpose of this study is to introduce the affirmative model of disability among various disability models and to analyze limitations of the affirmation disability model in order to present directions for development of disability models. The affirmative model is a tool which seeks to celebrate the difference the characterize the lives of disabled people. It is contended that disabled people can be proud and have positive disability identity that they are different from the majority of the population. However, the affirmative model has difficult looking for concrete solutions to the problems faced by people with impairments because this model gives new meanings to ‘impairments’ and ‘disability’ with individual and psychological reactions. Therefore, it is necessary that disability models in the future have to consider limitations of various disability models and diverse meanings to the concept of disability and disability identity in order to focus on specific disability issues.
