        설화 < 친자식보다 나은 양아들 >에 나타난 가장(家長)의 소외 문제와 주체성 회복의 과정

        본고는 < 친자식보다 나은 양아들 > 설화 속 서사의 주체인 영감을 중심으로 가장이 소외되는 원인을 밝히고 그 해결과정을 확인해보고자 하였다. < 친자식보다 나은 양아들 >에서 가장은 타자에게 소외된 가장의 면모를 보이는데 이는 타자에게 자신의 삶을 의존하고 스스로를 소외시켰기 때문임을 알 수 있었다. 이에 설화 속 영감은 타자에 대한 의존성을 버리고 스스로의 주체성을 되찾으면서 소외당한 가장의 처지를 벗어나게된다. 본고에서는 < 친자식보다 나은 양아들 > 통해 딸보다 아들, 불효와 효,노후를 위해 재산은 반드시 끝가지 지키고 있어야 한다는 논의를 하고자하는 것이 아니다. 오늘날에도 가족 구성원들에 의해 소외된 가장이 많다는 점에서 이들의 상처를 치유할 수 있는 실마리를 설화를 통해 확인코자 한 것이다. 이에 < 친자식보다 나은 양아들 > 설화는 오늘날 소외된가장에게 자기 스스로를 돌아보는 시간이 필요함을 말하고 있으며, 스스로의 주체성을 찾고 스스로를 이해하고 사랑할 때 비로소 소외감에 의한상처가 회복 될 수 있을 것이라는 실마리를 제공하고 있다는 점에서 그의의가 있다 할 것이다. This article aims to find out what makes the head of family, the main character of the story < Adoptive son better than biological one > isolated and how to address the issue. The head of family in < Adoptive son better than biological one > reveals that he is rather isolated from others, which results from his tendency to rely on others and to choose to isolate himself. The old man in the folktale eventually escapes from his tendency of reliance and find his identify, thereby breaking free his pathetic circumstance of isolation. This article does not intend to discuss son preference, dutiful or undutiful, or to argue that one should keep his or her wealth for later years through < Adoptive son better than biological one >. Today, we see a lot of heads of family isolated from the rest of the members and try to find ways to properly address the issue and sooth their wound through the tale. As such, the tale < Adoptive son better than biological one > suggests isolated heads of family today have time to look back on himself and carries its significance in that it says understanding and loving oneself while finding his identify is the right way toward recovering from the would caused by a sense of alienation.

        지형 , 토양 및 기상인자가 해송의 수고생장에 (樹高生長) 미치는 영향

        This study was conducted to investigate the effects of the topographical factors (16 items), physico-chemical properties of soil (13 items) and meteorological factors(9 items) on the height growth of Pinus thunbergii stands along the coastal area in Korea. According to the coefficients by partial correlation analysis in total area, it was found that tree height growth was considerably affected by local topography, soil hardness, soil B-horizental depth, effective soil depth, soil moisture, parent rock, soil texture, and etc.. And the soil factors were available P₂O_5, total nitrogen, base saturation, exchangeable Ca^(++), and etc.. In partial correlation analysis, annual relative humidity, annual precipitation, index of aridity, and etc. were found to be the most important factors influencing on tree height growth of Pinus thunbergii stands. In conlusion, the topographical, soil and meteorological factors have multiplex influence on the tree height growth in the Pinus thunbergii stands. They promise to provide the basis of improving not only the selection of suitable sites and the management of soil fertilizer but also the estimation of growth and yield. Hence these results would be used successfully for the design in the scientific forest working plan.

        사회적 기업에 대한 회사법적 검토

        The social company is the company which accomplishes a profit act while pursuing a social purpose. It is self-evident today that a nation cannot be in charge of the welfare for all society fragility hierarchies under the situation that a global economic crisis comes successively, and yet is not completely solved. One alternative plan which can solve such a welfare blind spot zone is a social company. Therefore we need nomothetic supplement and the law interpretation so that it is activated a social company in a dimension of the company law. The following suggestion is a legislation in the company law and an interpretation direction for the social company in this article. At first we have a needing that designed the current commercial law restrictions rule for no voting right or voting right restrictions stocks more flexibly in the case of a social company. The second, there is the stockholder who thinks this to be contribution when acquire the stocks of the social company. Therefore we may solve this problem as if publishing the various class shares like as zero dividend stocks and dividend stocks. We have to consider whether legislative amendment to the commercial law is needed. The third, a social company are dissolved, the issue of distribution of the remaining assets occurs. It is difficult to accept so-called Non-Profit Company in the current commercial law. The nomothetic solution that can accept Non-Profit Company is required by the revision of the commercial law. The fourth, a social company, the company originally thinks of a purpose social than profit characteristics more momentously. Therefore the director in the social company gives priority to the main purpose of the company called the social purpose over profit characteristics and must carry out duties. When a director gives priority to the social purpose that is a company original purpose, and a company suffers damage from the profit-related side; the exercising of the director is not violated of the fiduciary duty(duty of care). The fifth, when a director damages the company for social purpose accomplishment (social activity), the social company, it is not become a target of the shareholder lawsuit. Because such a social purpose is a purpose prescribing in the articles of association of the company. The court will have to reject the suit when a stockholder states representative suit. The sixth, there are many problems so that the social company where is in a company form moves into action. At least we will have to put grounds rule for the corporate social responsibility in the commercial law that is the fundamental law of company.

        난대지역 주요 4개 수종의 탄소배출계수 개발 및 적용

        In this study, we developed the carbon emission factors for 4 major species of warm-temperate regionin Korea, and tried to provide their carbon emissions and removals estimates using these carbon emissionfactors. We selected Castanopsis cuspidata, Camellia japonica, Quercus acuta and Quercus glauca as targetspecies and derived their carbon emission factors. The basic wood density that serve as one of the carbonemission factors were 0.583 for Castanopsis cuspidata, 0.657 for Camellia japonica, 0.833 for Quercus acutaand 0.763 for Quercus glauca and their uncertainties ranged from 5.3 to 17.9%. Biomass expansion factors werecalculated as well: 1.386 for Castanopsis cuspidata, 2.621 for Camellia japonica, 1.701 for Quercus acuta and2.123 for Quercus glauca and associated uncertainties varied from 14.7 to 30.5%. Lastly root-shoot ratios foreach species were also determined: 0.454 for Castanopsis cuspidata, 0.356 for Camellia japonica, 0.191 forQuercus acuta and 0.299 for Quercus glauca with the uncertainties lying within a range from 19.8 to 35.7%. These three carbon emission factors including basic wood density had the uncertainties of less than 40%recommended by FAO. Therefore the application of country-specific emission factors seemed to provide quiteaccurate estimates of carbon emissions and removals. The estimation of the carbon stored in the 4 species werealso conducted which amounted to 186.10 tCO2/ha for Castanopsis cuspidata, 280.63 tCO2/ha for Camelliajaponica, 344.04 tCO2/ha for Quercus acuta and 278.91 tCO2/ha for Quercus glauca and their annual carbonremovals were 6.65 tCO2/ha/yr, 6.25 tCO2/ha/yr, 11.70 tCO2/ha/yr and 12.29 tCO2/ha/yr, respectively. Thissystematic assessment of forest resources can be a reliable source of information for managing evergreen broadleavedforest in warm temperate regions and thus serve as useful data for effective decision-making to addressvegetation zone shifts due to climate change.

        담배소송과 고엽제소송에 관한 연구

        I researched the relationship between law and policy litigation through the two representative lawsuit, that are the defoliant litigation and tobacco litigation. In particular, social interest is also high for the lawsuit that not only litigants, to lead to significant consequences for many persons, the judiciary and the political sphere is striving to actively solve the case. In the case of lawsuit of this kind, it is associated with a class action mainly in many cases, it is tinged with public interest litigation nature. Also, in most cases, lawsuit of this kind is necessary efforts to resolve the situation amicably through reconciliation. In the case of Agent Orange litigation and tobacco litigation is a lawsuit to request compensation for damage parties. Rather than a lawsuit contesting the rights and obligations of individuals, it is a lawsuit that has been associated with the implementation of public policy in some respects. Therefore, in order to solve such a problem, legislation that assumes national agreement must be made. In order to achieve substantially the legislation, the pursuit of public interest judicial unit must be made. It is not only there is a limit coming from, such as the principle of separation of powers and the nature of justice in the judicial decision on public policy. That in such a limit even to comply with the appropriate level of the limiting factor will be the conditions to ensure the vitality and persuasive power of the court’s decision. So, the judiciary is, must take into account the interests of the entire nation and the public more actively. That attitude change of the judiciary aggressive and more, consider the phase and raison d’etre of the judiciary as the last bastion of the rule of law, it is important to encourage judicial activism. Agent Orange litigation and tobacco litigation are not over yet in Korea. There is also a possibility that the litigation which began today in some respects. It is believed that shall take legal policy and reasonable compensation for Agent Orange victims and tobacco victims in our country. At that time, experience in the United States shall be a big help.

        순응도 기반의 구동기 동적 성능 최적화

        본 논문은 4차 동적 시스템인 구동기를 구성하는 부품들의 변량 및 공기외란의 변량으로 인해 구동기 성능에 변량이 존재할 때, 구동기의 성능을 순응도 기반으로 최적화한 설계 결과를 제시하였다. 구동기는 BLDC 모터와 평기어 및 웜기어 조립체, 카나드로 구성된다. 구동기의 성능은 시간에 따라 변화하는 카나드 각도 정보를 이용하여 평가하였다. 고차 시스템의 성능은 해석적 접근을 통해 시스템 변수들의 함수로 표현하기 어렵기 때문에 반응표면모델을 기반으로, F-검정을 수행하여 유효한 시스템 변수들을 선정한 후 성능을 유효한 시스템 변수들의 함수로 근사화하였다. 본 연구에서 변량을 가지는 구동기 성능의 규격에 대한 순응도를 확률값으로 정의하였다. 순응도를 최적화하여 구한 설계변수는 부품 및 공기외란에 변량이 존재하더라도 고려한 규격을 모두 만족시킬 수 구동기를 제공할 수 있다. This study shows the conformance-based design results of a fourth-order dynamic actuator showing a performance variation caused by variation in the components as well as aero-induced disturbances. The actuator comprises a BLDC motor, spur gear and worm gear assembly, and canard. The actuator performance was evaluated by using time-variant angle information of the canard. Based on the response surface models, critical system variables were screened using F-tests, and then, the performance was approximated as a function of the variables because it is difficult to determine the performance of a high-order dynamic system as a function of system variables through analytical approaches. In this study, the conformance of uncertain performance to the specification was defined as a probability measure. The design variables obtained by optimizing the measure can provide actuator performance conforming to the specifications considered, even though there is a variation in both the components and the aero-induced disturbances.
