국제물품매매계약의 CHECK-LIST에 관한 연구 - 비엔나협약에서 해결되지 않는 문제를 중심으로 -

The CISG has been effective since January 1,1988. Even if both parties of international sales contract are located in ratifying countries, the CISG does not apply to certain excluded transactions. The CISG does not apply if the parties have opted out of the CISG. When the parties opt out, they usually agree on the law that is to replace the CISG. In the context of international sales, the frequent and difficult choice of law problems will arise when the CISG applies to a transaction but does not resolve all the legal issues before the tribunal. So this article deals with the question. What should we select the applicable law in such situations? (1) For products liability issues excluded from the CISG by article 4 and 5, the court should apply the substantive law of the market state and the statute of limitations law of the forum, (2) For validity issues excluded from the CISG by article 4(a). the court should apply the UNIDROIT Principles when its rules resolve the issue.

모바일 Port-MIS의 활용현황 분석 및 활성화 방안 수립

To cope with the recent developments of info-communication technology and information infrastructure, and in particular, to respond to the environment of wire and wireless communication integration, and also to overcome the limit of the existing web-based Port-MIS, the Ministry of Maritime Affairs and Fisheries is developing a mobile Port-MIS public service system (hereinafter referred to as a mobile Port-MIS). Accordingly, this study analyzes the current situation of the mobile Port-MIS that is under operation of the lust stage, finding out the problems, and suggesting new measures to activate the mobile Port-MIS. We expect this study will be able to suggest a guideline to the government institutions or other related organizations that plan to introduce a mobile technology in the near future. 해양수산부는 정보통신기술발전과 정보인프라 특히 유 무선통합통신환경으로 급속히 변하고 있는 환경에 대응하기 위해서 또한, 기존의 웹 기반 Port-MIS시스템의 한계를 극복하기 위하여 최초로 모바일 기술을 활용한 모바일 Port-MIS 민원처리 시스템(이하, 모바일 Port-MIS)을 개발하여 운영하고 있다. 이 시스템은 새로운 시스템이기 때문에 서비스 초기에 많은 문제점과 저항이 있을 것으로 예상된다. 그래서 본 연구에서는 현재 신규 개발 운영 중인 모바일 Port-MIS의 활용 현황을 분석하고, 문제점과 활성화 요인을 파악하여 이를 기반으로 모바일 Port-MIS의 활성화 방안을 제시한다. 본 연구는 향후 모바일 기술 도입을 준비하는 정부기관 및 기타 기관에게 가이드라인을 제시할 수 있을 것이다.

본 연구에서는 물류IT기업의 성공요인을 다각도로 조명하기 위해 환경 적요인, 정책적요인, 내부역량요인 등 3가지 측면을 고려하여 물류IT기업의 성공요인 모델을 개발하였으며, 요인분석을 통해 물류IT 기업의 성공요인을 발견하였다. 요인분석 결과 주관적인 성공요인은 아이디어와 능력으로 시장을 창출해서 경쟁자보다 앞선다는 요인, 조직내 관계와 정부지원 등의 조직에 대한 요인 그리고 시장파악과 지역산업화 등의 외부의 환경에 대한 요인이 성공요인으로 나타났다. 내부 역량에 대한 요인분석 결과, 조직 및 인적자원관리체계의 요인, 고객관계와 자원 그리고 경영전략의 경영능력에 대한 요인, 그리고 개발능력, 특성화된 제품, 네트워킹, 지역산업화의 지역산업에 적합한 제품에 대한 요인이라는 3가지 요인이 성공요인으로 나타났다. 기업외적 성공요인에 대한 요인분석 결과는 벤처기업 지원 육성정책, 클러스터 조성정책, 기술개발지원, 전문인력 양성지원과 같은 정책적인 측면의 요인과 세제 및 금융지원, 마케팅지원, 사무실지원(임대) 등과 같은 기업 운영 측면의 요인이 성공요인으로 나타났다. Under this economic circumstance, the logistics firms located in port take better advantages than those in other areas. This study observed those firms with consciousness to which matters were affected a growth of the logistics IT firms. This study considered in terms of three factors which are an economic factor, a political factor and an internal-ability factor for the matters of logistics IT firms' success through the factor analysis. According to the factor analysis, subjective factor showed positive: (1) expanding market through the ideas and abilities, (2) internal relations and government support (3) capability of market identification and focusing on regional industrialization. As a result of the internal ability analysis, there were three positive matters such as (1) a factor of organization or human resource management, (2) relationship with consumer and resource and management ability for strategy, and (3) developing unique product, networking, suitable goods of regional industrialization. The external factor, through the factor analysis was trued out (1) a emerged political factor such as a support up venture, cluster composition, investing R&D and specialist training, (2) economic factor such as tax reduction, financial support, marketing collaboration renting office in a low price by regional government.

발전소용 4.16 kV급 차단기에서 감전사고 사례 분석

This paper describes electric shock accidents on a 4.16 kV class circuit breaker for power plant. Electric shock accidents mostly involve damage of human life, in comparison with electrical fire, rate of human death tend to be higher in electric shock accidents. Specially, in a high voltage facilities rate of human death comprised about 43.7% by electric shock accidents. If electric shock accidents happen in a 4.16 kV class circuit breaker for power plant, then the power plant discontinue power production. Electric shock accidents in a power plant have a great ripple effect such as an electric power shortage. In this paper, we analyzed electric shock accidents on a 4.16 kV class circuit breaker for power plant. From the analysis results, we confirmed a cause of electric shock accidents on a 4.16 kV class circuit breaker, it happened by defect of interlock equipment or occurrence of breakdown between first feeder contactor and shielding plate. In order to reduce electric shock accidents on a 4.16 kV class circuit breaker, the power plant should consider improvement of interlock equipment and insulation of feeder contactor in circuit breaker.

소백산 천문대 61CM 반사망원경을 위한 자동 차등측광 시스템의 개발

We developed an Automatized Differential Photometry System (ADPS) to achieve high time resolution and high efficiency in the photometric observations of short period variable stars. This ADPS has been introduced to the CCD camera system attached to the 6lcm Reflector at Sobaeksan Astronomy Observatory. Several new algorithms were devised for the controlling the telescope. the star recognition in a CCD frame and the aperture photometry, etc..As the result, the differential photometric observation was fully automatized without any manual control, and much faster data acquisition could be achieved over the conventional photoelectric differential photometry.
