미국 우선임금(prevailing wage) 제도의 시사 ― Davis-Bacon Act를 소재로 ―

미 연방과 일부 주에서 시행중인 우선임금법(Prevailing wage Laws)은 정부가 자금을 지원하는 건설사업 등에서 일하는 노동자에게 지급되는 임금을 규제한다. 이중 1931년 연방법으로 제정된 데이비스-베이컨 법(Davis-Bacon Act)이 대표적이다. 데이비스-베이컨 법은 연방 정부가 발주하는 2,000달러 이상의 건설공사를 수행하는 계약업체로 하여금 근로자에게 우선임금을 지급하도록 강제하는 것을 골자로 한다. 여기에서의 우선임금은 공사가 이루어지는 해당 지역 건설업의 지배적 임금을 의미한다. 우선임금은 직무별로 정하며, 구체적인 금액은 원칙적으로 노동조합이 존재하여 해당 지역의 30% 이상(2023. 10. 이전에는 50%)의 노동자가 동일한 협약임금을 적용받는 경우 해당 임금률로, 노동조합이 없거나 가입률이 낮은 경우에는 임금조사를 통해 최빈값 내지 가중평균값으로 정한다. 우선임금을 적용함으로써 임금수준이 낮은 노동자를 이용하는 건설업자가 임금수준이 높은 지역에서의 공사를 수주하는 것이 어려워지므로 해당 지역에서의 경쟁 심화, 임금수준 하락 등 각종 문제로부터 지역사회의 노동자와 그들을 사용하는 사업자 등을 보호한다. 나아가 연방이 발주한 공사를 수행하는 업체는 자신이 직간접적으로 고용한 모든 노동자에게 우선임금 이상의 임금을 전액 지급하여야 하므로 하청의 연쇄에 따른 임금하락이 원천적으로 차단하는 기능도 있다. 데이비스-베이컨 법은 제정이후 현재에 이르기까지 찬반논란이 전개되고 있지만 미국은 우선임금법의 아이디어를 지속적으로 확대적용해 오고 있다. 우리 헌법은 적정임금 보장에 대해 규정하고 있지만 그 의미와 실현방법에 대한 논의는 활발하지 않다. 이러한 상황에서 미국의 우선임금법제는 국가가 선도적으로 건설노동자의 임금수준을 보호한다는 점에서 헌법상 적정임금 보장의 실현에 있어 국가의 역할과 노동조합 활동 촉진의 중요성, 적정 임금액수 보장 방안 등에서 많은 시사를 준다. Prevailing wage laws in the United States, both federally and in some states, regulate the wages paid to laborers working on government-funded construction projects. The Davis-Bacon Act is a federal law enacted in 1931 that requires contractors working on federally funded construction projects of $2,000 or more to pay Prevailing Wages (the “PW”s) to laborers. “PW” in this context means the prevailing wage in the construction industry in the area where the project is being done. The PW is determined by job, and the specific amount is (i) the wage rate if a labor union exists and at least 30% of the workers in the area are paid the same collective bargaining agreement wage, or (ii) the mode wage rate (sometimes weighted average) if there is no labor union or low membership rate, based on a wage survey. By applying the prevailing wage, it is difficult for construction companies that use low-wage workers to win contracts in areas with higher wages, thus protecting local workers and the businesses that use them from increased competition and cutting wages down in those areas. Furthermore, the Davis-Bacon Act requires that contractors performing federally contracted work must pay all workers they directly or indirectly employ at or above the prevailing wage, thereby preventing wages from being driven down by cascading subcontracting. While the Davis-Bacon Act has been controversial since its enactment, the United States has continued to expand the idea of prevailing wage laws. Our Constitution guarantees an adequate wage, but there is little discussion about what that means and how to realize it. Under these circumstances, the U.S. prevailing wage system has many implications for the realization of the constitutional adequate wage, including the role of the state in protecting the adequate wage level of workers, the importance of promoting labor union activities.
