        The seamen's act was enacted for the purpose of protect the crw's fundermental life and in order to operate the boat safely keeping rules on board, however, In the fishing vessel every exertion condition is worse than any other vessels as to the seamen's wage, boarding contract, application, public welfare aspect. It is necessary to replenish an institution to protect a number of fishermen's right and interest and their well being based on the stable foundation between employer and employee. According to the research of basic labor condition of fishermen I have investigated the following aspects respectively The results are as follows. 1.The seamen's wage was paid at the low cost consiting of minimum guaranteed wage in-stead of excessive labor. 2.As their distribution of Individual Income is determined according to the amount of fishing, Even the fundermental life of human-being was disregarded on account of Fishing practices. 3.With rack of Institutional protection of basic life it has come to bring severe loss to the crew's right and interest.

        In accordance with trend of international decision of training and certification for fishing vessel's crew, we have to involve the tendency of international flow. Accordingly, the domestic law has been reformed in order to promote safety of life and the protection of marine environment due to the pollution. With the reform of ship personal law according to IMO/STCW convention, we have to supplement the category of training syllubus suitable for the decision of IMO/STW 1984.

      • 漁船의 海難事故와 防止 對策에 관한 硏究

        The marine casualties of fishing boat has been taken place in many ways i.e. collision, foundering, agrounding, engine blink, fire, damage of fitting. etc. I have investigated the aspects of marine casualties of fishing boat concernings to the states of character of casualties during 1987∼1991 and suggested counter-measure for preventing marine accident of fishing boat. The results were as follows: 1. Most casulties were occured on the mishandling of engine on account of deficiency of maintenance and preliminary article. 2. Most marine casualties has been taken place the vessel less than 100 ton by the tonnage and much happend on account o operational fault and neglect of their duty by the reason. 3. The authorities will be estabilished prohibited zone according to the operational method to keep out of the marine casualties of fishing boat. 4. The authorities must strengthen the safety education of fishing boat to replace education which is prositive and practical once five years. 5. The administration have to consolidate the safety inspection of fishing boat according to the international trend. 6. Even in fishing boat, the Fishing boat must be utilized the GMDSS system in connection with the marine casualties. 7. The administration must unify the all of act concerning to the fishermen promote the social welfare and their well-being.

      • 海難事故에 對하여(Ⅱ) : 漁船의 乘揚事件을 中心으로

        The maritime casualty are happened frequently as the various aspects, I have researched following aspect relating to the agrounding of fishing boat, based on the judgement of maritime Inquiry court during 1965-1774. The results are as follows. 1. Most accident of agrounding are taken place with lack of operational skills and seamens poor technique. 2. The accident of agrounding are brought into not only act of God but also to be absented in mind. 3. The most accident of agrounding are taken place frequently 4-8 in month, 20-06 h in time, 100-200 in tonnage. 4. Relating to the Meteorological condition and seas, mostly accident are happened in rough weather owing to foggy, cloudy weather as increase the Beaufort scale.

      • 海技士 免許의 單一化를 爲한 考察 : 訓練 要目을 中心으로

        The unification of licensed system is relation to the seamens act has been discussed during many years. Now, the qualification of domestic act has been divided into commercial boat competency and fleshing boat competency. But, the quariflcation and training syllubuses were similar at the view point of operating the vessel. Accordingly, I have researched training syllubuses for seamens qualification on the domestic rule and international trend. But, different systems are applied to own countrys condition. I suggest that the unification of licensed system will be enacted to develope the maritime industry.

      • 漁船船員敎育의 問題點과 그 對策에 關하여 : IMCO / STCW 협약을 중심으로

        IMCO/STCW convention was enacted for the purpose of protect the environment of the sea and the saftey of life at the sea, but the existing marine officer's law has many diffcult problems to solve the quali-fication of the crew and the license system according to the requirement of minimum knowledge and manda-tory minimum requirement for the certification of master and officer by the STCW convention. Accordingly, the training for officer who engaged in fishing vessel must be varied in accordance with the international trend. In this thesis I have revealed the practical problems of developing the crew's quality and reform the license system in the fishing vessel.

      • IMO/STCW-F 협약의 채택에 따른 해기사 교육에 관한 고찰

        The STCW-F convention(International convention on the standards for the training, certification and watchkeeping for fishing vessel personnel) was adopted for the purpose of the safety of the fishing vessel crew and protection of marine environment in 1995. also, this convention will be implentmented in due course. We have to discuss the contents of this convention in order to accept the convention to meet with the international trends and regards. It is unevitable that the STCW-F convention will be accepted in order to decrease the sea casualty of fishing vessel and marine pollution of the vessel. Otherwise, while in port of other parties, the fishing vessel over than 24m in length shall take proper steps for receiving the port state control, and also, the "Limited waters" will be determined by dint of IMO Guideline and aspects of fisheries scale and characteristics of fishing vessel. All of skippers and officer on watch of the fishing vessel more than 24m in length shall hold the G.O.C or R.O.C in accordance with rules of radio regulation to communicate with other vessel and shore. So that, the curriculars for the training of the fisheries institute should reform to meet with the international agreement. Also, the social security system will provided in line with the development of practical skill, knowledge and training of fishing vessel crew on board.

        In order to develop the curriculum of the fishery department in the fisheries Jr. college, We have collected and analyzed the domistic and foreign data adquated to the fishey department under the international trend, also we gathered the opinion from the inquiring paper investigation and consultation to the industrial field, concerned college and graduate during the 6 month from September 1982. The fishery department curriculum in fisheries Jr. college will be industrialized with the concerned technics and knowledge in relation to speciality of maritime affairs. Accordingly, we have developed the adquate curriculum which is practical and can be cultivated the technician to adopt in the industrial society.

        I have researched the aspect of manpower of fishermen who boarded in the fishing vessel. The following plan to increase the manpower of fishermen will be provided. 1.The seamen has to hold the stablized vocational sense to raise operational efficiency and safe of life at the sea. 2.Adquate wage policy will be provided in connection with speciality of maritime labor. 3.The social security plan must be provided in order to promote the safe operation. 4.The fishermen's act has to be enacted for the purpose of protection of fishermen. 5.The military exemption system has been applied to near coastal fishermen who boarded in the fishing vessel. 6.The fishermen's immigrant policy and fishermens overseas job has been guarranted by the government unrestrictedly. 7.The practical marine education has been strengthened by developing the sea scout campaign.

        Based on the judgement of the maritime accident in inquiry court, Analysing the submersion of fishing boats, the results are as follows. 1.Most submersion of fishing boats are taken place not on the act of God, but carelessness of seamen's poor operation. 2.The submersion of fishing boats are happened on the account of the loss of stability on the condion of top heavy, to neglect the meteorlogical condition. 3.The submersion of fishing boats are happened on poor lookout and to negleglect the check of ship position, 4.The submersion of fishing boats aretoken place on the bad maintenance of engine and handle without care: 5.The submersion of fishing boats much are happened at 22h-06h in time, Jan- April in month. 6.Concerning to the submersion of fishing boats, increasing the wind force, (Beaufort scale 7 over)The accident are much happened.
