        金容泰,明炯植 圓光大學校 1972 論文集 Vol.6 No.-

The purpose of this study is to examine the Korean legal institution or her judicial customs generally by looking closely at their periodical characteristics from ancient times to the period of the Three kingdoms. As everyboby knows, the existing korean legal institution has come from foreign legal systems, especially the continental system from the Japanese invasion, leaving few traces of the original korean system. this succession of foriegn systems over their own ancient system must have an influence on koreans of today as to their legal thinking, even though there is no direct historical connection between the ancient institution and the existing one. The ancient Korean legal system has many simiIarities to a regular legal system as well as its peculiarities. These will provide an interesting basis for the study of comparative legal history. There have been many fragmentary surveys in the field of Korean legal history, but hardly any general systematic consideration. Needless to say, students of the history or Korean law have suffered from shortages of such data. For my purposes, I will divide Korean legal history into the four accepted historical periods: ancient times, the period of the Three Kingdoms, the Koryo Dynasty, and the Yi Dynasty, I will consider the legal system and customs of each period, attempting to relate the periodical background of each period to the different characteristics in the legal sustem. Specifically, I will discuss the systems of officials and soldiers, of taxes and education, and the legal aspects of crime, land, and marriage. The last two periods, of the Koryo and Yi Dynasty, are excluded in this study. They will be considered later.
