전시 북한주민의 지위와 보호방안에 대한 고찰 -한반도 전시 상황에서 발생할 수 있는 사례를 중심으로 -

A North Korean defector, upon entering South Korean territory, acquires South Korean citizenship. That is because the territory of North Korea is considered an unoccupied territory of the South by the Southern regime. At the same time, however, North Koreans residing in their homeland are regarded as members of anti-government organization. Such dual status of North Koreans can also be found in various South Korean policies aimed at resettlement of North Koreans. The abovementioned dual status can be problematic when war occurs in Korean Peninsula. Hypothetically at wartime, residents of the occupied Northern territory are regarded as South Korean citizens, while at the same time being residents of the occupied territory, The ambivalence not only affects the North Koreans but also influences the application of international law. If one puts emphasis on North Koreans as residents of occupied territory, then the treatment of North Koreans will be determined according to international humanitarian law, as the war will be regarded as an international armed conflict. At the same time, the exercise of South Korean government`s sovereign power in the Northern territory will be deemed groundless. In other words, territory of the North will be viewed as part of a sovereign state, separate from the South. If such is how the Korean War-more precisely, the Second Korean War-proceeds, North Korean residents can receive humane treatment of international standard; but. the establishment of perpetual peace, i.e. the unification, will yet again be postponed. On the other hand, if an emphasis is put on North Koreans as South Korean citizens, only parts of international humanitarian law can be applied in the Korean Peninsula, since the military conflict will be regarded as a non international one. Along with that comes a higher probability of international community recognizing South Korean sovereignty in the Northern territory. Concern with this scenario is a possibility that North Korean human rights might not be fully protected due to limited application of international humanitarian law. However, as the residents will be recognized as South Korean citizens, they will be subject to the South Korean law, under which the scope of protection is broader. At the same time, the assimilation process may reduce further conflicts from arising. analyzed above, more peaceful resolution to a war in Korean Peninsula can be drawn if the conflict is recognized as a non-international clash of arms. In order for that to happen, the South Korean government has to have capacity to autonomously carry out military operations, while getting recognition from the international community of the special relations between the North and the South. For such optimum to be drawn, South Korean government`s preparation is essential. Also, in order to draw consent from neighboring countries for stabilization of the North, a method of multinational participation is called for.

In this study, the flexural test for steel fiber reinforced concrete beams have been conducted. Three types of matrices including low-strength concrete, medium- strength concrete, and high-strength concrete were selected. Five types of steel fiber fractions were studied. Four types of initial notch-to-depth ratios were used. On the basis of the test results, the fracture energy is considerably influenced by the parameters, that is, the design strength, the liber volume fraction, and the initial notch-depth ratio. The notch sensitivity is softened by the mixing of the steel fiber when the strength is higher and higher. And, the proposed parameter for the sensitivity can describe the fracture characteristics of steel fiber reinforced concrete.

본 연구에서는 해석적 검토를 수행하여 합성구조물의 열적응답을 예측하고 발생가능한 문제점을 고찰함으로써 합성형구조 실 시공시 효율적인 자료를 제공토록 하였다. 복합구조의 적용에 의한 콘크리트 단면의 감소는 동일한 구성재료와 타설온도를 적용할 경우 최대온도의 발현량을 감소시키는 효과는 거의 없지만, 중앙부와 표면부의 온도차는 크게 감소시킬 수 있는 것으로 판단된다. 한편, 복합구조의 적용은 콘크리트 구조물의 단면감소를 유발하고, 감소율이 상대적으로 큰 단면에서 기설 콘크리트 구조물에 의한 구속작용으로 인장강도를 초과하는 인장응력이 발생된다. 이러한 응력은 Steel Box와 콘크리트 접촉면의 모서리부에 집중되는 것으로 판단된다. 이와같은 구속작용과 응력집중 현상은 복합구조 적용에 따른 온도차 감소효과를 상쇄시키는 것으로 판단된다. 따라서, 복합구조 적용시 이러한 문제점과 관련된 인자들과 단면 등을 고려한 해석적 검토를 통하여 온도응답 및 적절한 대책이 요구된다. This paper presents the thermal problems of steel-concrete composite structure and the basic references in placing concrete into the structure. Based on the analytical investigation, application of the composite structure has the effect of highly decreasing the temperature difference between the center section and the surface section of the structure, though its application has little influence on the decrement of the maximum temperature under the same using material and placing temperature. Meanwhile, its application causes the section decrement of a concrete structure, and in the section which the decrement ratio is relatively large, the restraint action by a old concrete structure takes place highly tensile stresses over a tensile strength. And, the stress is concentrated on sharp edges of the steel-concrete boundary. Both restraint action and stress concentration considerably decrease the reduction effect of the temperature difference. Therefore, the prediction of thermal response and the reasonable steps are required through the simulation considering the factors and the sections related to those problems.

본 연구에서는 교량에 설치되는 확장 보도부의 구조에 안정성 해석을 실시하여 효과를 분석하였다. 연구결과 인발력이 최대 40% 수준까지, 형강 당 소요천공량이 크게 감소하여 건설공해가 대폭 감소하였다. 또한 33∼50% 공사기간의 단축 효과를 기대할 수 있으며, 그에 따른 노무비 등 여러가지 요인으로 공사비 절감 효과를 기대할 수 있다. 특히 노후 교량이 많이 산재되어 있는 지방도 및 국도에 고령화 사회와 친환경 구조물 구축이라는 측면에서 긍정적인 효과를 기대할 수 있을 것으로 판단된다.
