전염병으로 한 차례 침체를 겪었던 항공산업의 여객 수요가 꾸준히 회복세를 이어 나가는 가운데, 각 항공사는 다양한 상품 출시에 박차를 가하고 있다. 승객이 항공 운송 서비스를 받아들이는 방식이 목적지에 도달하기 위한 단순한 운송수단을 넘어서 여행의 일부로 받아들이고 있기 때문이다. 비상구열 좌석의 공간을 유료부가서비스로 지정하여 추가 금액을 부과하는 것 또한 보다 쾌적한 여행을 원하는 승객들의 니즈를 적극 반영한 결과물이라 할 것이다. 그러나 이는 수익 창출에만 초점을 맞추고 항공운송에서 가장 중요시되어야 할 보안의 측면을 간과하고 있다. 최근 비상구열 좌석 탑승 승객이 아시아나항공 OZ8124편 여객기의 출입문을 여는 사고에서도 확인할 수 있는 것처럼, 현재 운영되고 있는 비상구열 좌석 배정 기준은 절차적으로 미비한 부분이 많아 보완이 필요하다. 이에 본 논문에서는 비상구열 좌석의 정의를 살펴보고 국내 항공사의 현행 비상구열 좌석 탑승 기준을 검토한 후, 동 제도의 한계와 그 개선 방향에 대해 논하고자 한다. 본 연구에서 현 제도에 대해 지적하는 네 가지의 문제점으로는 (1) 비상구열 좌석의 유료부가서비스화 현상, (2) 비상구열 좌석의 유의사항 고지의 부족, (3) 탑승 승객의 정신건강상태 확인 절차의 미비, (4) 비상구열 좌석 탑승 승객에 대한 주류 제공 제한 규정의 부재가 있다. 이러한 사항들의 개선을 통해 크게 두 가지의 기대효과를 예측해 볼 수 있다. (1) 비상구열 좌석에 대한 일반인의 인식 재고와 (2) 비상구열 좌석 탑승 승객의 정신건강상태 확인 및 지속 관리를 통한 비상사태 대비이다. 본 연구는 이와 같이 비상구열 좌석의 존재 의의를 다시 한번 확인하고 해당 절차 보완의 중요성을 시사한다. As the aviation industry gradually recovers from a downturn caused by the pandemic, airlines are increasingly focusing on launching various products. This is because passengers now perceive air travel not just as a means of transportation but as an integral part of their journey. Charging extra for emergency exit row seats, offering more space, reflects passengers' desire for a more comfortable travel experience. However, this focus on revenue generation overlooks the critical aspect of security in air transportation. Recent incidents, like a passenger opening an emergency exit on Asiana Airlines Flight OZ8124, highlight the inadequacies in current procedures for allocating emergency exit row seats. This article examines the definition of emergency exit row seats and reviews the current boarding standards for these seats in domestic airlines. It identifies four key issues: (1) the commercialization of emergency exit row seats, (2) inadequate briefing on emergency exit row seats, (3) insufficient procedures for assessing passengers' mental health, and (4) lack of regulations on alcohol consumption for passengers in emergency exit rows. Addressing these issues could lead to two significant outcomes: (1) reshaping public perception of emergency exit row seats, and (2) better preparation for emergencies through continuous monitoring and assessing passengers' mental health. This study reaffirms the importance of emergency exit row seats and the need to improve related procedures.

The Aviation Security Supervision is provided in Article 33 of the Aviation Security Act as part of preventive security police action. The Aviation Security Supervision specifically consists of the inspection as an administrative investigation and the corrective action as an administrative guidance. In this regard, it is necessary to understand its contents and limitations through the Framework Act on Administrative Investigations and the Administrative Procedure Act. In particular, the problem can be described as a Corrective Measures based on the inspection results. Recommendations for improvement and On-site corrections is non-power administrative guidance under the National Aviation Security Level Management Guidelines in the form of administrative rules. Only Corrective action under the this Guidelines is regulatory and administrative action and can be appealed and administrative litigation under the Administrative Litigation Act. Meanwhile, the Aviation Security Act and its subordinate statutes are silent on the prior remedy of corrective action. The Guidelines provide for petitions, including Corrective action, Recommendations for improvement, and On-site corrections. However, the period of seven days is very short, and there is a problem in the form and authority.
