This paper seeks to identify the legal concept and limitations of Block-Through-Connection under District Unit Plan, conducting the analysis on legal theories and cases in Seoul. The results of the study are as follows. First, Block-Through-Connection limits the right to use and make a profit from land property rights. However, it can be also viewed as general planning restrictions through the balance of public and private interest due to the secured premise of floor area ratio incentives. Therefore, it merely gives the landowner a public legal obligation to open the part to the public for 24 hours, rather than secures the right to use the part of the land. Second, there is a fundamental limit because the National Land Utilization and Planning Act does not have a proper tool to enforce the property owner when he/she violates the obligations. Third, in order to overcome the legal limitations, it is necessary to secure the legal right to use the part of private property through the easement or partial air right under the Korea’s property law.
혁신도시가 지역의 경제적 자족성에 미친 영향 분석 연구

In this study, we wanted to analyze the impact of Innovation Cities created for sustainable development on the economic self-sufficiency of the region. The targets of the analysis were limited to eight Innovation Cities, excluding the Busan Innovation District and Jeju Innovation City, among the 10 Innovation Cities in Korea. To this end, the change in economic self-help stones was analyzed using commuting OD data from 10 regions where eight Innovation Cities were located. The results were as follows First, the creation of an Innovation City confirmed that the region was growing into an economic hub. This is believed to be the increase in the proportion of jobs that secure jobs and create high value-added jobs in the region, as the creation of industrial, academic, and annual clusters, a key strategy for creating Innovation Cities, has been the result of surrounding industries. Second, there is a phenomenon of separation of directives in Innovation City areas. Industrial, academic, and annual clusters have become a base for integrating industries by providing new locations to companies in the surrounding region, and as a result, it is believed that the separation of workers in and outside the region is occurring. Third, it was confirmed that the relocation of public institutions contributed to strengthening economic self-sufficiency in the early Innovation City areas. Although the relocation period is not much different from the time when apartments were moved in, it is believed that the newly formed economic hub of former public institution workers in the region contributed to the economic conditions of the region.

Several issues still haven’t been resolved with respect to apartment house remodeling in Korea. Such issues include regulations regarding remodeling permission, excessive alteration of structural design, complicated review process of the structural stability, and many others, making it difficult to promote the apartment remodeling. In this study, the laws and procedures related to permit regulations of remodeling are classified into four categories and analyzed. Those categories are: permission for remodeling, plans to alter rights, deliberation, and safety inspection. According to the analysis of the relevant laws and regulations, it is found that a number of current laws do not conform to the purpose of apartment house remodeling, and they are even in conflict with other regulations due to the lack of coherence and inconsistency. As such, to prevent excessive costs and processing time during a remodeling project, an improvement plan is suggested regarding the review of structural stability, which is a major issue in the current remodeling market. In addition, it is essential to establish standards for the approval of project plans and donations, reflecting the nature of the apartment house remodeling. Such improvements in the laws and regulations related to the remodeling of apartment house would promote the market in Korea, and is expected to provide critical help to solve the aging house issue in Korea.
