        수사절차상 피해자참가제도에 대한 검토

        본 글에서는 우선 외국의 공판 및 수사절차상의 피해자 참가제도에 대하여 검토한 후, 현재 어떤 규정이 있는지 확인하고, 향후 우리는 우리나라의 형소법상 피해자참가제도를 규정할 경우 어떤 규정을 수사절차상에도 규정해야 될 것인가에 대하여 검토를 해보아야 되며, 현재 입법예고된 법무부의 법률안에 어떤 내용이 규정되어 있는지, 추가로 수사절차상 피해자참가규정을 포함시킨다면 어떤 내용을 규정할 것인지에 대하여 검토해보고자 한다. 그리고 그 주요내용들은 수사단계에서의 피해자 의견진술권, 피해자참가국선변호인제도, 신뢰관계있는 자의 의무적 동석, 수사관에 대한 제척·기피제도 도입의 내용이다. 한편으로 과연 피해자보호를 위하여 시스템만 반복적으로 새롭게 만드는 형식적 행위가 과연 피해자의 인권을 실질적으로 보호할 수 있는지에 대하여 깊게 생각을 해보고, 따라서 많은 부분을 법으로 전부 규정할 수는 없지만 몇 가지 점에 대하여 수사절차에 피해자 참가를 규정함으로써 그동안의 반복적 실수를 줄일 수 있으며, 체계적으로 피해자의 인권을 수사절차에서 보호할 수 있기 위해서는 수사절차상 피해자참가제도의 도입을 생각해보아야 한다. 그러므로 이런 점들에 대하여 공청회와 본격적인 토론을 시작해보아야 할 것이다. 또한 이러한 논의가 너무 앞서나갈지는 모르나 검토해보고 고민해보는 것이 무의미한 행위는 아니라고 생각한다. In this abstract, after first reviewing system of victim participation in foreign trial and investigation procedure, confirm what provisions there are presently, and we shall review what provisions to be provided in investigation procedures when we provide for victim participation system in Korean Criminal Procedure hereinafter, and we shall review what provisions are provided for in the draft law of Korean Ministry of Justice contained in the legislative notice presently and additionally what contents to be provided for if we include victim participation provisions in investigation procedure. And major contents thereof shall be victim`s right to state opinion in the stage of investigation, public defender system in victim participation, mandatory presence of party with trust relation, and inducement of exclusion/evasion system for investigator. On the one hand, we should think over inducement of victim participation system in investigation procedures to systematically protect the human rights of victim in investigation procedures, brooding over if formal act of newly making system repetitively indeed practically protect the human rights of victim, and therefore to reduce the repetitive mistakes so far by providing for some points although many parts may not be all provided for. Therefore, we should start hearing and regularized discussion on such points. Also, we think such discussion may be going out too much far ahead but it may not be pointless act to review and agonize.

        경죄사건의 신속처리를 위한 검사직무대리제도의 개선방안

        Term 3, Clause 27 of the Constitution regulates ``All nations have the right to face the trial rapidly.``, but as the burden of Public Prosecution`s Office for the cases in our country is likely to be too heavy at present, the rapid service for the criminal procedure can not be sufficiently bestowed on the nations with the prosecutors` manpower only, and it can not be guaranteed that the substantive investigation for protection of the human rights of the nation is sufficient and it can not be also said that the prosecutor`s direction of investigation for the important case is sufficient and detailed. Therefore, as the alternative for the above outstanding matter, it was reviewed over the necessity and improvement plan of the probational prosecutor system, which is being executed in Public Prosecution`s Office nationwide. In concrete, as for the direction of investigation to supplement the summary case after being sent to the police station, as it is the most essential for the probational prosecutor to decide whether to prosecute it, the regulations to be bestowed within the summary record being sent shall be newly established, and as it seems that this point becomes the opportunity for the police officer also to supplement the case record through this. Besides this, the matters for separation of the minor offense/grave offense, installation of Public Prosecution`s Office in city and gun in case the city/gun court is faced, constitutional matter of the probational prosecutor and guarantee of its position shall be also discussed in the deeper way. And as for the claim for seizure/search warrant of the probational prosecutor, the claim to demand shall be legislatively bestowed through the chief prosecutor in charge but it will be proper for the necessity for such claim to be verified during the approval of the chief prosecutor in charge. Also, relative to the qualification of the probational prosecutor, it will be recommended to establish and execute the educational course regularly, and as for the scope of the probational prosecutor`s duty, as it is true that the name of crime of the summary case is being widen to increase the business concentration of the prosecutor, it seems that its actualization plan will be necessary by changing the regulations actually in the legislative aspect. It is considered that as for the introduction matter of the deputy prosecutor system, as the prosecution administrator system treating the prosecutor`s business is absolutely supported, rather than the deputy prosecutor system, like Japan, our case will not be different. Finally, it is true that the nations worry about the protection of human rights, but this study thought over that the improvement plan to overcome some outstanding matters and to make the rapid and proper treatment of the case with the sufficient experience and the investigation capacity of the probational prosecutor.

        한국인 성인 남녀의 흡연관련 사망에 관한 연구

        Objectives: Cigarette smoking has been widely recognized as a major risk factor for lung cancer and other diseases in Western countries. In Korea, male cigarette smoking prevalence was among the world`s highest between 1980 and 1990 and smoking has also become a strong risk factor for lung cancer and cardiovascular diseases. The objective of the study was to calculate the smoking-attributable mortality in 2012 in Korea. Methods: Number of smoking-attributable deaths were calculated by applying the percentages of population attributable risks (PARs) to the estimated number of deaths by diseases in 2012. In this study, PARs were obtained by using relative risks from the Korean Cancer Prevention Study and the Metabolic Syndrome Mortality Study, and population smoking prevalence surveyed in 1985 conducted by Korean Institute of Tuberculosis. Results: The smoking-attributable mortality was 58,155 death in 2012. Among adult male, the smokingattributable mortality (49,704) represents 34.7% of total 2012 mortality, whereas the smoking-attributable mortality (8,451) for adult females was 7.2%. Smoking was supposed to be responsible for 41.1% of all male cancer and 33.4% of all male cardiovascular diseases, whereas smoking for 5.1% of all female cancer and 5.4% of all female cardiovascular diseases in Korea. Conclusions: Smoking actually represents a remarkable burden of avoidable deaths in Korea. Smokingattributable mortality appears to continue increasing by the next 10 to 20 years.

        최근 유비쿼터스 게임의 성장과 더불어 이기종의 환경에서 새로운 기법들로 보여질 수 있는 연구가 활발히 진행되고 있다. 본 논문에서는 이기종 환경에서 임의의 OpenGL 기반의 PC 게임이나 게임 뷰어가 있는데서 Java3D 형태로 재복원해서 볼 수 있는 방법을 제안한다. 결과적으로 구조적인 장면 그래프에서 사건을 처리하고, Parser에서 OpenGL Primitive들의 정점 정보를 해석해서 계층 구조를 변화시킴으로서 보다 빠른 실시간 렌더링을 구현하고자 한다.

        The propose of this study is to survey the revetments installed in Gangwon Province for identifying their characteristics. The survey showed that in eastern Gangwon Province, gabion, retaining wall and concrete blocks took about 63% or more, and in western Gangwon Province, dry wall, gabion and retaining wall,68% or more. Gabion and dry wall had better vegetation coverage in western Gangwon Province than in eastern Gangwon Province. That is thought to be due to slope of river and under-water frequency.

        2012년 흡연으로 인한 건강보험 진료비 추정 연구

        Objectives: The purpose of the study was to estimate relative risk and attributable risk of 35 tobacco-related diseases and to compute total medical expenses on smoking by providing a cohort study with 20 years follow-up period. Methods: Smoking-attributable medical costs were calculated by applying the percentages of population attributable risks (PARs) to the estimated medical costs by the tobacco related diseases in 2012. In this study, PARs were obtained by using relative risks from the Korean Cancer Prevention Study and the previous studies, and population smoking prevalence surveyed in 1990 conducted by Korean Institute of Tuberculosis. Results: As a result, the medical expenses from tobacco use were 1,846,562,350,000 won (about 3.86% of total medical expenses). The top 5 medical expenses on tobacco-related diseases were ischemic heart diseases, cerebrovascular diseases, lung cancer, diabetes, and chronic obstructive pulmonary disease, respectively. More than a half percent of total medical expenses (about one billion dollars) were spent from these five, tobacco-related diseases. Conclusions: While the harmful effect of smoking is expected to have a steady increase for a while, antismoking policy should be reinforced to reduce the risk of disease incidence, and the medical expenses for treating the tobacco-related diseases.
