국제사회 주거권 논의와 연계한 북한 주거환경 개선방안

본 논문은 국제사회의 주거권 논의 현황과 특징을 분석함으로써 북한지역 주민들을 대상으로 하는 주거환경 개선사업이 인도적지원의 대상이 될 수 있는지에 대해 고찰하는 데 목적이 있다. 분석 결과 주거권은 인간의 기본적 권리를 구성하며 이를 충족시키지 못하는 환경에서는 인도적 차원에서 적절한 조치가 필요함을 알 수 있었다. 하지만 지난 20년간 진행된 대북지원은 식량 및 보건, 의료지원만을 인도적 지원 대상 품목에 포함시켜 왔다. 이러한 가운데 북핵 문제로 불거진 UN의 대북제재는 인도적 지원만을 예외로 두고 있고, 향후 북미 정상회담을 통해 북핵문제가 해결된다고 하더라도 UN의 제재가 완전히 해제되는 데에는 상당한 시일이 걸릴 수도 있다. 또한 향후 대북지원은 과거와 같이 식량 및 보건, 의료지원에 국한될 가능성이 크고 이는 열악한 주거환경에 놓인 북한주민들의 주거인권에 대한 고통은 여전히 계속될 것임을 의미한다. 결과적으로 본 논문은 국제사회의 주거권 논의에 근거할 경우, 북한지역 주민들을 대상으로 한 주거환경 개선사업이 인도적 지원의 구성요소를 충족시키므로 향후 지속가능한 남북교류협력사업을 위해 인도적 지원사업의 범위에 북한지역 주거환경 개선사업을 포함시키는 방안을 주장한다. This study seeks to make a case that HABITAT operation to North Korea can be considered as humanitarian assistance under the UN’s sanction. The Korean government has decided to provide humanitarian aid to North Korea despite UN’s restrictive actions against North Korea. Although conditional, the two Koreas are considering to pursue a few economic cooperation projects. While the UN and the international community are participating in the implementation of UN Security Council resolutions to sanction North Korea, South Korea needs to consider the sustainability of humanitarian aid to North Korea. This study analyzes international human rights discourse on housing rights, the condition of North Korean housing environment, the history of North-South exchange and cooperative activities in order to seek the possibility of incorporating the HABIT operations to North Korea into humanitarian assistance. Under the UN sanctions against North Korea, it seems that HABITAT or housing related operations from humanitarian assistance to North Korea are not allowed. Considering the right to housing in international human rights discourse, however, this paper argues that HABIT or housing related operations should be allowed as humanitarian assistance.

통일 후 북한지역 국유지의 소유권 처리에 관한 논의

최근 북한 김정은 국무위원장 ‘신변이상설’의 소위 가짜뉴스는 단기간에 한국을 비롯한 국제사회에 적지 않은 ‘인포데믹(infodemic)’ 파장을 불러일으켰다. 그리고 이로 인한 북한 급변사태 논의들이 자연스럽게 이루어지기도 하였다. 1989년까지 같은 처지의 분단국이었던 한반도와 독일은 현재 정치·경제적인 측면에서 큰 차이를 보이고 있다. 독일과 러시아를 포함한 체제전환국들의 다양한 이행사례들은 한반도에 중요한 시사점을 줄 수 있다. 특히 작금의 상황에서 통일 시나리오에 대한 이론과 원칙의 논의는 중요하다고 판단된다. 이에 본 연구는 기존의 선행연구들에서 한계로 지적되는 통일방식에 대해 ‘조약의 국가승계이론’과 ‘통합이론’의 관점에서 고찰해보고, 독일의 국유재산 전담관리기관의 사례를 분석하였다. 그리고 광복 이후 일제 식민지 시절의 귀속재산에 대한 처리문제를 분석하여 한반도 통일 후의 상황에서 북한 부동산의 소유권 처리방안에 대한 정책적 시사점을 도출하였다. 본 연구에서는 남북한 통일 과정에서 전제가 될 수 있는 방식을 이론적 차원에서 접근하였다. 특히 기존 논의 중 4개 시나리오를 가정하고, 북한의 부동산 소유권 처리방안을 검토하였다. Recently, fake news of North Korean leader Kim Jong-un s personal abnormalities caused quite a few infodemic repercussions for South Korea and the international community in a short period of time. As a result, discussions on sudden changes in North Korea naturally took place. The Korean Peninsula and Germany, which were the same divided countries until 1989, are now showing wide differences in political and economic aspects. Various cases of Eastern European transition countries could give important implications to the Korean Peninsula. In particular, it is deemed important to discuss theories and principles on unification scenarios in these days situations. In response, this study examined the unification method, which is pointed out as a limitation in the previous prior studies, from the perspective of National succession t heory a nd integration theory and analyzed the c ase of t he G erman state property management institution. This study analyzed how landownership, which had been lost to Japan in the past, was recovered. In this study, the theoretical approach was made to the method that could be a premise in the process of unification between the two Koreas. In this study, four scenarios were assumed, among the existing discussions, and real estate ownership treatment in North Korea was reviewed.

평양시 살림집 건설정책에 관한 연구

본 연구는 김정은 집권 전후의 평양시 살림집 건설정책의 변화를 비교분석함으로써 목표달성 여부에 대한 판단과 개발지역의 도시계획적 측면을 검토함으로써 향후 평양시의 도심 경계변화와 도시개발 방향을 예측하고 남북경협에의 시사점을 도출하였다. 북한은 2021년 들어 자력갱생, 재자원화 등 경제위기 극복을 위한 다양한 정책들을 강조하며 인민들에게 그 실천을 강조하고 있는 상황이다. 연구 결과, 김정은 시대의 살림집 건설정책은 김정일 시대의 살림집 건설정책에 비해 구체적인 계획과 방법을 통해 그 실현가능성을 높였다. 이 정책이 성공할 경우 북한경제의 탄력성을 높여 외부충격을 낮출 수도 있다. 또한 동평양에서 사동지역을 첫 번째 개발지구로 지정함으로써 도심의 경계를 확장하였다는 의미를 가진다. 향후 북미협상이 진전되고, 남북관계의 복원이 이루어질 경우, 평양시의 도시개발은 남북경협의 주요한 아이템이 될 수 있으므로 이에 대한 협력방안에 대해 연구할 필요가 있다. The purpose of this study is to draw implications for inter-Korean economic cooperation by comparing and analyzing changes in Pyongyang s house construction policy before and after Kim Jong Un s reign and reviewing the urban planning aspects of the development area. In 2021, North Korea emphasized various policies to overcome the economic crisis, such as self-rehabilitation and re-resourcing, and underscored the practice to the people. As a result, Kim Jong Un s house construction policy has ever increased its feasibility through detailed plans and methods in comparison to that in the Kim Jong Il regime. If the policy succeeds, it will likely increase the resilience of the North Korean economy and reduce external shocks. In addition, the designation of Sadong as the first development zone in East Pyongyang was enough to hint that North Korea has decided to expand the boundaries of the city center. If the future U.S.-North Korea negotiations progress and inter-Korean relations are normally restored, urban developments in Pyongyang will likely be spellbinding sweet spot of inter-Korean economic cooperation. It is, therefore, necessary to study ways to cooperate.

남북교류협력사업과 북한 주거환경개선의 연계방안 연구

최근 남북한의 관계개선과 교류협력의 재개 움직임이 일고 있는 상황에서, 남북교류협력사업에 대한 과거의 사례를 고찰하고 지속가능한 정책추진에 대한 고민이 필요하다. 본 연구의 목적은 향후 북한 인권으로서 주거환경개선과 남북교류협력사업을 연계하여 사업의 지속가능성을 높이는 방안을 모색하는 것이다. 이에 본 연구에서는 먼저 기존 남북교류협력사업의 현황과 문제점을 분석하고, 사업의 지속가능성을 높이기 위한 방안을 모색하였다. 특히 UN의 대북 제재가 시행되고 있는 상황에서도 지속가능한 정책추진을 위해 인도적 지원사업으로서 북한의 열악한 주거환경과 북한 인권 보호의 연계가능성을 검토하였다. 또한 본 연구는 남북 간 교류협력 사업 의 활성화 방안에 관한 연구를 수행한 기존 선행 연구와 그 맥락을 같이 하나, 법률적 검토를 통해 교류범위의 확대를 꾀함으로써 기존 연구와의 차별화를 시도하였다. 결과적으로 기존 남북교류협력에 관한 법률에서 인도주의적 사업의 범위를 구체화하되, 주거환경보호 및 개선사업을 포함시킬 필요가 있다. 아울러 북한주민의 주거권을 보장하고, 최저주거기준을 확보할 수 있는 주거안전망을 구축할 필요가 있다. Recently, there has been a move to improve inter-Korean relations and resume exchanges and cooperation. In this time, we need to look at past cases and consider implementing sustainable policies. The purpose of this research is to explore ways to enhance the sustainability of the project by linking the improvement of housing environment and inter-Korean exchange and cooperation projects as human rights in North Korea. For this purpose, this study first analyzed the current status and problems of existing inter-Korean exchanges and cooperation projects and sought ways to enhance the sustainability of the project. In particular, the Commission considered possible linkage between North Korea s poor housing environment and North Korea s human rights protection as a humanitarian aid project to promote sustainable policies even when U.N. sanctions on North Korea are being enforced. In addition, this research was carried out in the same context as previous preceding research on ways to promote inter-Korean exchange and cooperation projects, and it was differentiated from existing research attempts by expanding the scope of exchange through legal review. As a result, the existing Inter-Korean Exchange Cooperation Act needs to clarify the scope of humanitarian projects and include projects for protecting and improving the residential environment. Furthermore, it is necessary to establish a housing safety net that can guarantee the right to North Korean residents and secure the minimum standard of housing.

한반도 신경제지도와 연계한 남북한 간 경제특구 협력정책 방향

남북한의 분단은 한반도를 둘러싼 강대국들에 의해 이루어졌다. 그렇게 시작된 분단은 어느덧 반세기를 넘어 한 세기를 바라보고 있다. 현재까지도 양 국가의 한 해 예산 중 적지 않은 부분에 국방비가 할애되고 있는 실정이다. 최근 남북한의 정상회담이 개최되었고, 북한이 북핵 폐기의 입장을 밝히며 북미회담 개최 성사되며, 한반도를 둘러싼 온풍이 불고 있는 상황이다. 특히 남북 경협사업의 재개움직임은 여러 차례 보도된 바 있다. 독일 통일사례에서도 증명된 바와 같이 분단국가에서 양측의 경제교류는 통일의 중요한 초기 단계에 해당되는 만큼 섣불리 포기하기보다는 새로운 패러다임의 전환을 통해 중ㆍ장기적이고 외부적 충격을 견딜 수 있는 종합적인 방안을 모색할 필요가 있다. 본 연구에서는 남북한 경제협력의 정책방향을 문재인 정부의 한반도 신경제지도 구상과 양측 경제특구의 교류협력 연계의 관점에서 모색하였다. 연구 결과, 단기적으로 한반도 신경제지도 구상과 연계한 남북 경제협력 정책 추진 시 지역적 범위를 구체화하고, 중기적으로 개성공단의 다자국 참여를 위한 확대 추진 및 특구지정을 위해 노력하며, 중ㆍ장기적으로 한국의 경제자유구역과 북한의 경제특구, 경제개발구의 외자유치 전략과 개발 컨셉을 양측이 공유하고 이에 맞게 일대일 매칭을 확대해 나가는 것이다. In a divided country, economic exchanges between the two sides are an important early stage of unification, so it is necessary to seek a comprehensive solution through a new paradigm rather than giving up hastily. In this study, have reviewed the New Economic Map Initiative on the Korean Peninsula by the Moon Jae-in government and the cooperative direction of special economic zones on the Korean Peninsula for the Policy Direction of South-North Korea’s economic cooperation. The results of the study were as follows : In the short term, the geographical range of inter-Korean economic cooperation policies in conjunction with the new economic map of the Korean Peninsula should be specified. In the mid-term, the government should strive to promote expansion of the industrial complex and designate special zones to participate in multi-nation countries. In the mid - and long-term terms, South Korea and North Korea need to share their strategies to attract foreign investment and develop special economic zones, and expand cooperation accordingly
