        상가건물 권리금 보호규정에 관한 소고

        Although the Commercial Building Lease Protection Act is in place, including the articles for the protection of opportunity of collecting premiums, the tenant’s right is not absolutely protected. As a result, there are major disputes that have occurred or are expected to happen in the future : problems of the existence of the protection period of the rights, of collecting premiums, of calculating the amount of damages in the act of interfering with the opportunity to collect premiums, violation of the obligation of arranging new tenant and other duties, and of the range of limiting the landlord's rights. Due to these problems, there are cases where interested parties are not actually covered by the protection regulations despite the presence of articles for protection of premiums. This study is to find a solution to practical problems by an empirical method using lower court rulings on premiums. As a result of the study, the following improvement measures were drawn : the interpretation on the part of the remarkably large amount of rent and deposits under the law, the interpretation of those who used commercial buildings for non-profit purposes for a year and a half, regulations when the tenant is interfered in the process of arranging new tenants, offering the information about new tenants, exemption from Article 10-4 (1) and the provision of the right to renew the contract at the time of signing the lease, and the alternative plan to improve the regulations from 3 months before the end of the lease period to the end of the lease. 권리금 회수기회 보호규정을 포함한 상가건물임대차보호법이 시행되고 있지만 임차인의 권리금 자체를 절대적으로 안전하게 보호받지 못하고 있다. 이로 인해 현재까지 주로 발생하였거나 앞으로 발생할 것으로 예상되는 주요 분쟁의 모습으로 권리금 보호규정의 행사기간 존재여부의 문제, 임대인의 임차인에 대한 권리금 반환의 문제, 권리금 및 권리금 회수기회 방해행위의 손해배상액 산정 문제, 신규임차인 주선 및 기타 임차인의 의무위반 효과, 임대인의 권리행사 제한 범위와 관련한 문제 등이 발생하고 있다. 이러한 문제들로 인하여 이해관계인들은 권리금 보호규정이 있음에도 불구하고 실질적으로 보호규정의 적용을 받지 못하고 있는 경우가 발생하고 있다. 본 연구는 권리금에 대한 하급심 판례 등을 활용한 경험칙적인 방법으로 실무적인 문제의 해결방안을 찾고자 하였다. 연구결과 첫째, 상가임대차법상 현저히 고액의 차임과 보증금에 관한 부분에 대한 해석. 둘째, 1년 6개월 비영리 목적으로 상가건물을 사용한 자에 대한 해석. 셋째, 임차인이 신규임차인을 주선하는 과정을 임대인으로부터 방해받는 경우의 규제. 넷째, 임차인은 신규임차인이 되려는 자에 대하여 자신이 알고 있는 정보 제공. 다섯째, 임대차계약 체결 당시 임차인이 제10조의4 제1항 적용배제 약정 및 계약갱신요구권 행사 규정. 마지막으로 임대차기간이 끝나기 3개월 전부터 임대차 종료 시까지의 명문규정을 보다 구체적으로 개선하는 방안을 도출하였다.

        전이성 뇌실질내 종양환자의 예후에 영향을 미치는 인자들

        This study was conducted on 60 metastatic brain parenchymal tumor patients admitted at this hospital between January of 1987 and July of 1993. he mean age of the patients was 54, the youngest 26 and the oldest, 78. The ratio of male v.s. female was 1 : 2.3, 50 were single metastatic and 10 were multiple. The following are the results of the analyses of the factors affecting the prognoses of metastatic brain parenchymal tumor patients : The group operated on showed a significantly prolonged life-span as compared with the group without operation, which was also phenomenal among the single metastatic patients. Among the primary tumors, breast cancer had the longest median survival period, 20 months, and the shortest survival period was one month with the gasrointestinal tumor. As for clinical grade and survival span, those above the Karnofsky scale of 80 survived a median of six months, and those below 50 survived for 2 months. The group with favorable clinical conditions before operation resulted in a significantly long life span. Especially in the group with 80 or above of the Karnofsky scale, the operated group showed a far more excellent prognoses as compared to the non operated group. The median survival time was 20 months in the group with more than 12 months as an interval between diagnoses of primary tumor and metastasis, whereas it was 3 months for the group with an interval of less than 6 months. Thus, the longer the interval, the better the prognosis. This fact was statistically significant. Among the patients with an interval of 12 months or more, the operated group also showed better prognosis than the nonoperated group. The mean six months survival rate was 33.3%, the one-year rate was 23.3%, the two-year rate was 10.0% in all cases. The longest survival time was 36 months. The whole body metastasis was the most common cause of death, accounting for 64.2%.

        The surgical approach to spinal tumors varies not only with the level and location of the tumor. but also with the type and extent of the tumor Some of the dumbbell neurofibroma(neurilemmoma) can be removed through simple laminectomy but usually are approached through two separate incisions by two stages In this report. posterior and anterolateral approaches in a single stage to dumbbell neurofibroma(neurilemmoma) of the spinal region are described. This approach provides full exposure of intra- and paraspinal portions of the tumor thus permitting safe dissection and total remova l Six patients who underwent this procedure are described to illustrate its application.
