규제예산(Regulatory Budget)은 모든 규제가 유발하는 비용에 상한을 두어 무분별한 규제의 양산을 통제함으로써 자원의 합리적 배분을 달성하는 것을 목적으로 하며 이론적으로는 강력한 규제개혁 수단으로 평가받는다. 그럼에도 불구하고 우리나라에서는 이론적으로나 실무적으로 규제예산에 대한 논의가 공론화된 바가 없다. 본 연구의 목적은 규제예산이 갖는 매력에도 불구하고 왜 제도화가 무산되었는지에 대한 의문에 기초하여 규제예산의 제도화 가능성을 탐색적으로 분석하는 데 있다.본 연구에서는 편익측정의 배제, 비용추정의 신뢰성, 정책수단의 제약, 적정규모의 결정, 새로운 비용 유발 등 규제예산의 쟁점을 분석틀로 사용하여 제도화 가능성을 분석하였다. 분석결과, 편익배제를 제외한 여타의 쟁점은 역량 및 제도운영의 기술적 문제로 환원하여 해석할 수 있었으며 이는 다소 어려울 수는 있겠으나 제도화 과정에서 해결 불가능한 문제는 아닌 것으로 파악되었다. 결국 규제예산 제도화의 중심에 편익추정 배제의 쟁점이 자리하고 있었으며 이는 규제의 효율성과 형평성 간 선택의 문제로 귀결될 수 있다. 이러한 논의가 시사하는 바는 규제개혁 프로그램의 제도화에 있어서 효율성과 형평성 간 균형의 담보가 핵심적 고려사항이어야 한다는 것이다. Regulatory budget aims at achieving rational allocation of resources by putting a cap at regulatory costs and constraining agencies from issuing ineffective regulations. Thus regulatory budget is theoretically considered as a powerful tool for regulatory reform. Nevertheless, there has been no public debate on Regulatory budget theoretically neither practically in Korea. This study aims at searching the applicability of regulatory budget on the basis of a question of why application of regulatory budget has failed despite its merits.This study examines the applicability of regulatory budget by using five disputed points(exclusion of benefit estimation, problems related to cost estimation, conditional selection of policy instrument, decision of proper size of budget, additional cost) as an analytical framework.We found that except exclusion of benefit estimation, all disputed points could be regarded as technical problems in implementing the regulatory budget and identified as solvable problems. We also found that exclusion of benefit estimation has been at the center of application of regulatory budget and regarded as a selective problem of regulatory value between efficiency and equality. This results suggest that programs or institutions for regulatory reform be designed to strike a balance between efficiency and equity.

통합재난관리이론의 분석적 해석 -재난관리체계 설계에의 정책적 함의--

본 연구는 우리나라 재난관리체계의 토대를 이루고 있는 통합재난관리의 논거를 분석적으로 해석하여 재난관리체계 설계를 위한 정책적 함의를 도출하는 것을 목적으로 한다. 이에 본 연구에서는 기존문헌 검토를 통해 재난의 유사성, 재난발생 단계별 관리의 이점, 분산관리의 비효율성, 단일 총괄조직의 필요성 등을 통합재난관리의 논거로 정리하고 이를 분석적으로 해석하였다. 그리고 이를 다시 종합적으로 토론하여 정책적 함의를 도출한 후, 국민안전처 신설 및 오룡호 침몰사고 사례에 적용하여 그 유용성을 확인하였다. 정책적 함의의 내용은 다음과 같다. 첫째, 재난관리체계의 설계 시 기계적 재난관리 원칙을 적용하기 보다는 재난의 특성과 재난발생 단계의 가변성을 고려하여야 한다. 둘째, 통합재난관리가 대응에 최적화된 체계임을 감안하여 재난관리체계 설계 과정에서 다양한 재난이론 및 패러다임을 수용하여야 한다. 마지막으로 통합재난관리가 역사적?정치적 산물이라는 점에서 우리나라 재난관리체계의 역사적?제도적 맥락을 복합적으로 고려하여 재난관리체계를 설계하여야 한다. Since the Sewol ferry disaster, Criticisms proposed on disaster management system in Korea might be showing the necessity of profound analysis and interpretation on IEM(Integrated Emergency Management) which has become the foundation of disaster management system in Korea. This study aims at suggesting policy implications for designing a disaster management system by analytically interpreting the rationales for IEM which is somewhat normative. For this purpose, this study identified five rationales(such as similarity among types of disasters, benefits of 4 phase disaster management, inefficiency of diversified management, necessity of comprehensive agency) for IEM through literature review and suggested policy implications as followings by analytically interpreting these five rationales and comprehensively debating on the outcomes of the interpretation. Firstly, the government should consider the characteristics of disasters and the variableness of disaster phases rather than utilize the principles of disaster management by rote. Secondly, various theories and paradigms on disaster management need to be taken in the process of designing the disaster management system, considering that IEM is an optimal system especially to response phase. Finally, administrative, political, and historical characteristics in Korea should be counted in when designing the disaster management system, considering that IEM is the product of historical and political conditions of a country.

우리나라의 의원입법은 정부입법과는 달리 체계화된 규제영향분석 제도를 갖추고 있지 못하다. 더구나 본 논문에서 분석한 것처럼 기존 국회의 법안 검토 및 분석 제도는 정부의 규제영향분석만큼 정교하지 못하다. 의원입법으로 성립되는 규제 법안의 사회적 영향에 대한 체계적이고 깊이 있는 분석이 이루어지지 못하고 있어 규제품질관리에 허점이 존재하고 있는 것이다. 상임위원회 전문위원의 의안검토보고는 지침에서 제시된 내용과는 달리 표준화 수준이 매우 낮을 뿐만 아니라 형식적으로 운영되고 있으며 예산정책처의 비용추계는 체계성이 높지만 평가대상 및 분석항목이 재정소요에 대한 비용추계에 국한되고 있어 사회적 영향을 고려하는 규제영향분석을 적극적으로 실시하기에는 어려움이 있었다. 법제사법위원회의 체계 및 자구심사는 법안에 대한 형식적 분석에 치중하고 있었다. 그리고 입법조사처의 입법조사분석은 국회의원의 다양한 입법분석 수요에 부응하는 제도의 성격상 규제영향분석과 같이 체계화된 지표를 가지고 표준화된 분석을 시도하는 것이 어렵다. 이런 연구결과로부터 향후 의원입법의 품질을 제고하기 위해서는 의원입법에 대해서도 해당 입법안이 사회 전반에 미칠 편익과 비용을 포괄적으로 분석하는 규제영향분석 제도를 도입할 필요성이 있음을 알 수 있다. This study intends to insist on the necessity of Regulatory Impact Analysis to the Assembly-introduced Bills which have been exempted from a detailed social benefit/cost analysis in Korea. With the various monitoring systems of Korean National Assembly like Legislation and Judiciary Committee, NABO(national assembly budget office), NARS(national assembly research service), We could not judge sufficiently whether the Bills bring to benefits over the costs to the society. Because these existed monitoring institutions does not adopt the logics of regulatory impact analysis which is useful to analyze costs and benefits of Bills. So, The growing number of bills introduced by assembly which are exempt from the regulatory quality process could be remedied by a permanent monitoring tools like Regulatory Impact Analysis in the National Assembly to assure oversight of the quality of laws.
