제국주의 침략에 따른 베트남 · 중국 관계와 조선 · 중국 관계의 변화, 그리고 두 관계의 상호작용

본 연구는 19세기 중·후반 제국주의의 동아시아 침략이라는 공통적·역사적 배경 속에서 베트남과 조선이 주요한 위치를 차지하고 있던 기존의 조공체제가 무너지며 베트남·중국의 관계와 조선 · 중국의 관계가 어떻게 변화되었는지, 나아가 이 두 관계가 어떻게 상호작용하였는지에 대하여 살펴보았다. 1860년대까지 베트남과 조선은 중국의 조공국이지만 자주성을 지녔으며, 1870년대 후반까지 중국 역시 국내외의 문제로 인해 조공국인 베트남과 조선의 문제에 깊이 간섭하지 않았다. 하지만 이후 조공체제가 흔들리기 시작하자 중국은 베트남과 조선에 외교적 · 군사적으로 노골적인 간섭을 시작하였다. 중국은 전통적 조공체제를 근대적 조약을 통한 제국주의적 질서로 재편하여 베트남과 조선을 속국화하려 하였고, 이 과정에서 베트남과 중국의 관계와 조선과 중국의 관계는 서로 맞물려 돌아가며 상호작용을 일으킨다. 즉 프랑스의 베트남 침략이 본격화되자, 중국이 베트남에서의 종주권을 위해 일으킨 청불전쟁으로 조선에 있던 청군이 베트남으로 이동하였고, 이 기회를 틈타 조선에서는 중국과의 사대관계의 청산을 주장하며 갑신정변이 일어난다. 하지만 베트남의 정세가 프랑스로 기울자 중국은 갑신정변을 진압하며 조선의 군사 · 재정 · 외교를 통제하기 시작했고, 서방 국가들에게 조선을 중국의 속국으로 인정받으려 하였다. 19세기 동아시아에 밀어닥친 제국주의의 큰 파고는 베트남과 조선에 대한 중국의 종주권 수호의지를 강화시켰을 뿐 아니라 중국이 제국주의에 참여하도록 만들었다. 중국은 베트남을 프랑스에 빼앗긴 것에 대한 상실감을 조선에서 보상받으려 하였던 것이다. Against the common historial background of imperialism’s invasion of East Asia in the mid to late 19th century, this study examines how China’s relations with Vietnam and Korea changed, and how these relations interacted with each other amid the collapse of a traditional tribute system in which Vietnam and Korea occupied significant positions. Until the 1860s, Vietnam and Korea retained autonomy despite being tributary states of China, and until the late 1870s, domestic and foreign issues prevented China from deeply interfering with the affairs of Vietnam and Korea. As the tribute system began to falter, however, China began to more explicitly interfere diplomatically and militarily in the affairs of the two countries. China tried to turn them into its vassal states by reorganizing the traditional tribute system into an imperialistic order based on the modern treaties. In the process, China’s respective relations with Vietnam and Korea became interconnected and interactive with one another. That is, as the French invasion of Vietnam began making its stride, the Chinese army stationed in Korea moved to Vietnam to go to war with France to maintain China’s suzerainty over Vietnam. Taking advantage of this situation, the Gapsin Coup of 1884 was staged on the Korean peninsula in an attempt to end the relationship based on toadyism between China and Korea. However, as the situation in Vietnam became favorable for France, China turned its attention back to Korea, managing to repress the coup and beginning to take control over Korea’s military, finances, and diplomacy. Furthermore, China desired for western countries to acknowledge Korea as its own vassal state. The big wave of imperialism that crashed upon East Asia in the 19th century caused China to engage in imperialism and to intensify the will to defend its suzerainty over Vietnam and Korea, which resulted in its attempt to seek compensation through Korea for its loss of Vietnam to France.

본고에서는 후레 왕조의 『국조형률』에 나타난 官吏犯罪 관련 수속 규정과 조선 초기(15세기) 官吏犯罪 수속 규정의 내용을 밝혀 비교하였다. 국조 형률은 관리의 공죄에 대해 수속으로 대신하게 하여 관리가 자신의 업무와 관련하여 안정적으로 일을 하게 하였다. 그리고 수속 형벌에 있어서 5형(刑) 외에도 폄(貶)과 자면형(刺面形)에도 수속을 하게 하였다. 그리고 수속 환산 량에 대한 규정을 보면 품관이 높을수록 더 많은 부담을 지게 하여 관품이 높을수록 범죄에 대한 책임을 무겁게 하였다. 이런 점은 수속 규정을 통하여 관리의 책임을 강화시키면서 관리범죄를 예방 효과를 가져다주었다. 조선의 경우 세종 대에 와서『대명률』의 기본적인 수속 규정을 따르면서도 당시의 상황에 맞게 조정되었다. 문무관원 외에 생원과 진사와 같은 관원후보생도 수속으로 형벌을 대신하게 하여 일면 양반을 위한 특혜적 성격을 띠었다. 동시에 하급 기술직과 전문직에게 수속으로 대신하도록 하여 공무를 계속할 수 있게 하여 행정적 효율성을 기하기도 하였다. 수속 환산 량은 관품의 고하에 상관없이 일반 백성들도 동일한 형벌엔 동일한 수속을 바치도록 하였다. 사회와 경제적 여건에 따라서 면포로 바치게 하였고 수속 환산 량도 가난한 자를 위해 부담을 점점 줄이는 방향으로 조정되었다. 후레 왕조 시기 수속 규정은 공죄에 대해 그리고 관품에 따른 차등적 수속 환산 량을 규정하여 관리에게 책임의식과 관리 범죄 예방적 효과를 가져다 준 반면 조선 초의 수속 규정은 양반 관리에 대한 특권과 행정적 효율을 위한 목적으로 주로 시행되었고 관리범죄의 예방적 효과는 미미했으리라 생각된다. The ransom system was implemented out of consideration for the socially disadvantaged, and it was also implemented to give preferential treatment to officials or to improve administrative efficiency. Both the Late Le Dynasty of Vietnam and the Joseon Dynasty of Korea implemented the ransom system by reflecting the punishment system. The following features can be seen through the comparison of the rules of ransom between the Late Le Dynasty of Vietnam and the Joseon Dynasty of Korea, where the most notable are the punishment rules. In the Quoc Trieu Hinh Luat (The National Penal Code), all officials could be exempted from punishment by paying ransom in cases of offenses due to negligence, excepting serious crime like the 10 evil sins. According to the rules regulating the ransom in Joseon Dynasty, in addition to the high-ranking officials, the rules permitted ransom payment for (a) the official candidates after being discovered to have received preferential treatment and (b) the technical low-ranking officials for other offences, because they were integral parts of the bureaucratic system which made their replacement extremely difficult (i.e., affecting the administrative efficiency). So, the rules of ransom facilitated this kind of punishment instead of the formal punishment. In the Quoc Trieu Hinh Luat (The National Penal Code), officials could be exempted from not only the physical punishment (the 5 punishments) but also from the personnel relegation and the punishment of writing some words on the body if they settled the ransom. In the punishment rules of Joseon Dynasty only the high-ranked officials could be exempted from physical punishment (the 5 punishments). In the Late Le Dynasty, these rules were derived from the development of the money economy, which in turn conditioned the exemption to be made by paying money, but in the Joseon Dynasty, however, the rules stated that fabric must be used for the ransom. In terms of the amount paid for the ransom, in Late Le Dynasty, it was proportional to the officials’ rank and the severity of the punishment. This was different in the Joseon Dynasty because regardless of the high or low bureaucratic rank they should pay the same ransom in same punishment level and the amount was reduced depending on the social and economic situation. The rules of ransom in the Late Le Dynasty, in my opinion, which required the high-ranking officials to pay proportional ransom to be exempted from punishment, were more effective to some extent to prevent administrative crimes. On the other hand, I think the rules of ransom in the Early Joseon Dynasty favoured high-ranking officials and brought efficiency in administration by permitting the payment of ransom for low-ranking or technical officials, but overall the effect of preventing crime was weak.
