정치영역에서의 반민주성과 부패에 대한 꾸준한 문제제기로 말미암아 2004년 일련의 정치개혁을 위한 정치관계법 개정이 이루어졌고 정당법 개정을 통해 지구당 제도가 폐지됨으로서 지역차원의 정당 조직이 금지되었다. 비민주적인 정당운영과 하향식 의사결정, 권위주의적 문화가 국민의 주권 실현을 방해하고 고비용 저효율의 구조로 인해 정경유착의 부패를 야기하므로 이를 해결해야 한다는 것이 폐지의 이유였으나, 활발한 진성당원의 정치 참여를 기반으로 활동하던 소수 정당들은 이러한 개정 정당법이 오히려 국민의 자발적 참여를 방해하여 정치적 기본권을 침해하고 정당의 자유를 억압한다며 헌법 소송을 제기하였다. 헌법재판소는 개정 정당법이 군소정당을 배제하고 전국정당화를 위한 최소한의 제한을 한 것으로 기본권을 침해하지 않으며 지구당 폐지가 국민의 정치참여의 매개인 정당의 활동을 본질적으로 제한하는 것이 아니라는 이유로 합헌 결정하였다. 정당은 국민이 주권을 실현하기 위해 의사를 조직화하고 대표 선출과 국가의사형성에 민주적 정당성을 부여하기 위한 매개이자 수단으로 헌법이 그 활동과 조직의 자유를 명문으로 보장하고 있다. 지구당 또는 그러한 지역 단위의 하부 조직은 이를 가능하게 하는 본질적인 기초 단위로서 역할을 한다. 지구당 폐지 이후 도입된 당원협의회로는 이러한 지구당의 역할을 하는데 한계가 있다. 따라서 지구당의 존재 여부는 정치적으로 효율적인가 아닌가를 판단하기보다 국민의 정치참여를 최대한 보장하기 위해 그 제한이 최소화되어야 한다는 최소침해 원칙에 따라 결정되어야 하고, 다원화된 의사를 가진 주권자가 능동적으로 국가 의사 결정에 참여하고 민주적 정당성을 부여할 수 있도록 하는 기초 단위로서 지구당 또는 이에 준하는 풀뿌리 대중 조직이 이념이나 지역을 중심으로 활성화 될 수 있도록 제도적으로 보장되어야 한다. In 2004 politics-related laws were revised because of the call of voters who demanded Political Reform. Especially The district party chapter has been criticized as the main channel of illegal political money, ineffectiveness and authoritarian structure of decision, so the party reform was focused on it. As a result the district party chapters were compulsory abolished. The Constitutional Court has held that the purpose of the abolishment of a district party chapter is justified because of responds to providing a structural reform in a political party`s overspending. But the abolition of the local party raises several constitutional problems such as freedom of party organization or political right. The present democratic society is based on parliamentary democracy and it`s operated centering around parties. Party acts as a mediator, collecting people`s voices and reflecting them to policy. And a district party chapter, as the minimum organization of political party in a region, is a precondition for creating the public opinion, granting democratic legitimacy to the political decision. And it plays an important role in realizing grass-roots democracy. So it is not to be evaluated on the economic efficiency point of view. In conclusion it is necessary to restore the grass-roots party organizations strictly based on democratic principle and reforms of political system should ensure the freedom of party and the sovereignty of the people.

UL-syndrome(鬱證) is a syndrome of emotional depression and various physical symptoms generally due to chronic psychological stress, without constitutional abnormality. These are cases of female patients suffering from headache, chest discomfort, heart burning, insomnia, dyspepsia, anorexia, fatigue and some other minor symptoms due to chronic stress. We diagnosed these cases as UL-syndrome and treated them with oriental medicine, specifically Gamisoyosan(加味逍遙散). This paper describes the symptoms that the patients suffered, the treatment used, and identifies stages in the development of UL-syndrome, and suggests a stage in which Gamisoyosan is efficacious.
