전자정부 1등 국가와 행정정보공유법제의 발전

우리나라가 전자정부 1등 국가가 되는 데는 발달된 정보통신 인프라와 더불어 행정정보의 전자화가 핵심적 기능을 수행하였다. 또한 행정정보공유 정책은 전자정부정책의 핵심기반이 된다. 아직 우리 행정환경이 전자정부의 궁극적 목적인 민주주의의 완성이나 정보사회의 거버넌스 확립에 행정정보공유 정책을 활용하지 못하고 있는 점은 아쉬운 점이지만, 그 첫 단계로서 국민 편익증진과 행정효율성 및 경제성 확보를 위하여 매진하고 있는 점은 다행이다. 특히, 국민의 행정정보 구비서류 업무를 경감하기 위하여 범정부 차원에서 행정정보공유추진위원회를 두고 상근 공무원조직으로 이를 지원하게 함은 물론 체계적 행정계획을 세워서 추진하고 있는 점과 그 성과가 구체적으로 나타나고 있는 점은 앞으로도 우리나라 전자정부가 지속적으로 세계 1등을 유지하게 되는 비결이 될 것 같아 자랑스럽다. 최근에는 전자정부법의 전면개정을 통해 행정정보공유 정책의 법적 근거가 더욱 튼튼하게 되었다. 일단 급하게 근거를 마련하는 일은 시작하였지만 앞으로 행정정보공유 정책의 발전을 위하여 제도적으로 개선하여야 할 일이 많다. 우선 규범적으로 대상기관이나 대상정보에 대한 요건이나 확정절차 등을 보다 구체화할 필요가 있다. 특히, 법적으로 민간기관에 대한 활용필요성을 인정하고 있으면서도 그 대상기관은 특정 업종에 특정 기관으로 한정하는 듯한 입법태도는 바람직하지 못한 것으로 평가된다. 아직 기회가 있는 만큼 하위법령의 구체화 과정에서 이러한 입법적 검토사항이 충분히 반영되기를 바란다. The best e-Government in the world was due to digitalizing administrative information and well-developed IC infrastructure. In addition, administrative information sharing policy is the backbone of e-Government Policy. Unfortunately, we are still not use e-government information sharing policy to achieve completion of democratic and governance of information society. But, It is comforting that Promote public convenience and to ensure the administrative efficiency and economy are being used it. In particular, it is proud that install the committee of public information sharing in order to reduce paperwork and set up a specific policy plan for policy objectives. In recent years, legal basis of administrative information sharing policy has become more clear because of revising e-Government act. But, there are a lot of drawback that relation with system. From now on, it should reflect various improvements in the process of the planning and developing of Enforcement Regulations & Enforced Ordinances.

한국경찰의 융합행정현황과 발전방안

최근 미국을 비롯한 서구 선진국들은 공공정책집행이나 공공서비스 제공에 있어서 부처간의 융합적 접근을 강조하고 있다, 우리나라에서는 2010년부터 안전행정부가 중심이 되어 부처관 관련성 있는 업무에 대해 협력을 통해 행정효율성을 높이기 위한 융합행정을 제도적으로 추진해오고 있다. 이 연구는 융합행정과 관련하여 치안행정 분야의 융합행정의 현황과 향후 발전시켜 나가야 할 과제들을 제시하고 있다. 먼저 치안행정 분야 융합행정의 대표적인 사례로 실종아동 등 찾기 정보공유, CCTV 통합관제 시스템 구축, 112 신고로 전화금융사기 예방 및 신속한 피해회복처리 협력, 자동차 과태료 일괄 압류 해제 납부시스템 구축, 소규모 도서 치안관서 융합행정, 해수욕장 안전관리 통합 운영 등을 제시하였다. 다음으로 치안행정 분야 향후 융합행정이 필요하고 확대ㆍ발전시켜 나야가할 분야를 경찰기능별로 제시하였다. 생활안전 분야에서 경찰업무 중 상당한 부분을 차지하는 주취자에 대한 효율적 처리를 위해 경찰과 소방, 지방자치단체 등과의 융합행정이 필요하다. 수사 분야에서는 형사사법기관별 별도로 운영되기 때문에 기관 상호간 정보공유 마비로 인해 국민을 불안에 떨게 하는 성폭력 등의 흉악범죄를 예방하고 범죄자를 신속하게 검거하기 위한 형사사법기관간의 정보공유에 대한 융합행정을 확대시켜 나갈 것을 제시하였다. 경비ㆍ교통 분야에서는 각종 재난발생시 유관기관 상호간 유기적인 대응을 위한 융합행정과 정보ㆍ보안 분야에서는 최근 북한의 경제적 사정 악화 등으로 급증하고 있는 북한 이탈주민들의 국내정착을 지원하는데 있어 융합행정이 요구됨을 제시하였다. 마지막으로 지방행정 개편관련 향후 자치경찰제가 시행될 것으로 보이지만 지방행정 개편이 아직 미미한 현 단계에서 국가경찰과 지방자치단체 간의 지역치안에 효율적으로 대응하기 위한 기구로 지역치안행정협의회를 활성화시킬 것을 제시하였다. 이러한 치안행정 분야 융합행정이 성공적으로 시행되기 위해서는 다음과 같은 몇 가지 조건들이 필요하다. 첫째, 치안행정 분야 융합행정은 경찰 자체의 노력만으로만 성취될 수 있는 것이 아니라 관련기관들 간의 목표에 대한 공감대가 형성되어야 한다. 둘째, 융합행정에 참여하는 기관간의 권한과 책임을 명확화 하기 위한 법률의 정비가 필요하다. 셋째, 융합행정을 통해 예산 등이 절감되고 대국민 서비스가 향상될 수 있도록 하기 위해서는 융합행정 성공에 대한 인센티브가 주어지도록 해야 한다. 가령 융합행정 성공에 대한 성과급 보상이나 특별승진 등이 필요하다. Recently the United States and other Western developed countries is emphasized integrated approach in the public policy enforcement and to provide public service. Ministry of Security and Public Administration in Korea has been promoted to integrated administration since 2010 through a collaboration between the administrative departments to improve the efficiency of the administrative. This study suggested the current status and future direction of the police integrated administration in Korea. First, the field of public security adminstration as a prime example of integrated administrative find missing children, including information sharing, CCTV integrated control system, a call to 112 reported fraud prevention and rapid damage recovery process collaboration, a fine batch of cars seized to pay off system, public security authorities in small island administrative convergence, beach safety management and integrated operation are presented. Following integrated administration of police administrative areas requires and expand in future. In the field of Life Safety accounts for a significant portion of police work effectively for the treatment for drunk man police and fire protection, local governments need of integrated administration. Investigation in the field of criminal justice institution operating separately because due to lack of information sharing between agencies and the people to tremble with anxiety and other serious crimes of sexual violence prevention and arrest criminals quickly to information sharing among criminal justice agencies for integrated administration by expanding suggested that out. In the field of disaster-related guard and transportation related organization integrated administration is required. Finally, the implementation is not yet local police system at the present time the national police and local governments to strengthen cooperation between the security area it is necessary to enable the Community Safety Committee.

행정정보의 효율적인 활용을 위한 법ㆍ규제 분석

스마트 디바이스와 클라우드 컴퓨팅 서비스 이용이 활성화됨에 따라 행정정보가 사회ㆍ경제적 가치가 높은 유용한 정보로 부각되고 있다. 행정정보는 수집기관과 분야가 다양하고 개인정보를 포함하고 있기 때문에 이를 효율적으로 활용하기 위해서는 정보의 공유와 법적 근거가 필수적이다. 본 연구는 행정정보 활용 시 저촉되는 법ㆍ규제를 분석하고 개선방안을 도출하기 위해 행정정보 공유 프로세스를 유형화하고, 그 과정에서 적용될 수 있는 법ㆍ규제제를 분석하였다. 연구 결과 행정정보의 상업적 활용에 대한 명백한 입법 기반의 마련이 시급하며 행정정보를 수집ㆍ가공할 수 있는 기관이 필요한 것으로 분석되었다. 개인정보를 보호하고 시민들의 삶의 질을 향상시키기 위한 본 연구는 정책적 자료 및 가이드라인으로서뿐만 아니라 산업적으로도 지대한 공헌을 할 것으로 기대된다. Since appearance of smart devices and cloud computing services, the social and economical values of administrative information have been magnified as valuable information. In order to make better use of various administrative information generated by diverse government organizations efficiently and effectively, information sharing based on legal systems is essential because of several obstacles including privacy. To suggest practical ways for using administrative information, this study categorized the administrative information sharing process, and analyzed the regulations and legal systems that are contradictory to the regulations. The result of analysis appears that there is a need of legislative base for well-defined business use of information, and a need of the organizations, that available to collect and manufacture the information. The results of this study can be expected to make legislation contributions not only for industries, but also by suggesting the policy making and guidelines to protect privacy and improve the quality of citizens’ life.

행정정보공유를 통한 행정서비스 제고방안에 관한 연구

거버넌스가 1990년대 이후 나타난 새로운 국정운영의 방식이라면, 디지털 행정은 21세기 지식기반 행정의 핵심 수단이고 오늘날 정부개혁의 지향점이다. IT의 발달은 네트워크, DB등에 의해 정보수집, 이용, 관리, 배분 비용을 최소화하고 행정기관은 동일 정보를 각 기관마다 다시 반복 입력하는 불필요한 시간, 인력, 장비 이용을 줄임으로써, 또 고객은 그 대가로 대기시간, 행정의 생산성, 서비스의 질, 만족을 얻을 수 있어 공유에 따른 문제를 일시에 해결한다. 본 연구는 거버넌스 관점을 중심으로 행정정보공유의 의미와 행정서비스 제고방안을 분석한다.

행정정보공동이용제도의 개선방안에 관한 연구

행정정보공동이용은 정부의 효율성과 국민의 편의를 제고하기 위하여 매우 중요한 제도 중 하나이다. 그러나 행정정보공동이용은 부처 간 이견조정기능 미흡, 관련 법률의 정비 필요성 등 다양한 비판에 직면하고 있어 이의 해결이 시급한 상황이다. 따라서 본 연구의 목적은 지난 2005년부터 시행된 행정정보공동이용제도를 평가하고, 문제점을 개선하기 위한 정책대안을 제시하는 것이다. 이러한 목적을 달성하기 위하여 담당 공무원, 교수, 일반기업 직원, 연구기관 연구위원 등 전문가들을 대상으로 설문 및 인터뷰조사를 실시하였다. 연구조사는 문헌분석, 정부사업분석, 전문가회의 등을 통하여 개발되었으며, 연구분석틀과 일치하도록 조직, 기술, 문화, 관리, 정책, 법률 등 여섯 가지 측면으로 구성되었다. 연구 결과 추진체계의 조직구조상 단점 극복, 공유추진단의 자체 데이터베이스 구축, 정보유통방식의 혁신, 관련 문화의 개선, 대상정보 및 이용기관의 지속적인 확대, 활용도가 많은 정보에 대한 제공의무 신설, 행정정보공동이용법의 재추진 등이 필요한 것으로 밝혀져 이와 관련된 정책대안을 제시하였다. Information sharing is one of the key factors enhancing government efficiency and public convenience. However, critics argue that Korean government is now facing various kinds of barriers such as insufficient collaboration among agencies, inappropriate statutes, and technical problems. Thus, this study aims to develop policy alternatives that help resolve the existing problems suggested above. In order to achieve research objectives, this study employs both quantitative and qualitative methods as ways to investigate different dimensions of information sharing in government. Both survey and interview include six dimensions such as organization, technology, culture, management, policy and law. The results show that Korean government needs to implement following alternatives; developing its own database that helps support government decision making, changing organizational culture, continuous extension in terms of the number of object information and affiliated agency, and developing a statute dealing with government information sharing.

電子政府에서의 프라이버시保護에 대한 檢討

세계가 전자화․디지털화 되어가면서 정부부문에서도 세계각국에서 '전자정부'로의 구조개혁이 시도되고 있고 우리나라도 이 방면에 있어 선도적 위치를 점해나가고 있다. 그러나, 우리나라에서의 전자정부화는 '행정의 효율성'이라는 경제적․정책적 이상의 추구에 지나치게 매달림으로써 프라이버시권 보호와 같은 국민의 기본권 보호는 이를 지나치게 소홀히 취급해 온 면이 없지 않다. 이에 우선 '전자정부'의 개념에 대해 그 연혁적 배경을 중심으로 살펴보고, 전자정부화가 진행된 '정보화시대'에 있어서의 '정보인권'의 하나로서 프라이버시권의 의미를 헌법적인 측면에서 규명해본다. 또한, 전자정부 하의 개인 프라이버시 보호에 대한 우리나라의 실정과 외국의 현실을 비교해 봄으로써, 우리의 문제점들을 규명하고 이에 대한 개선방안을 탐구해본다. 이 때 이들 문제점과 개선방안에 대한 논의는 크게 주민등록번호 밑의 개인신상정보의 집적이 가져오는 문제, 매켄토시나 리눅스 사용자의 정보접근권 침해의 문제, 지문날인 데이터베이스화의 프라이버시권 침해 문제, 정부기관간 개인정보의 '공유'와 '통합관리'의 문제, 공공기관의개인정보보호에관한법률, 공공기관의기록물관리에관한법률, 공공기관의정보공개에관한법률 등 구체적 관련 법규정상의 문제점들, 전자정부 업무 주관할부서가 불분명한 문제, 국민의사의 행정과정에의 '반영'까지도 중시하는 응답적 체계의 전자정부화 필요성의 문제를 중심으로 진전시켜본다. As the world gets more electronized and digitalized, many governments have tried reformation in governmental area to the 'E-Government' and Korea is taking leading position in that reform. But, generally speaking, 'E-Government' policies in Korea have inattentively dealt with basic human rights of Korean people such as right of privacy by having excessively clung to the economic ideal of 'administrative efficiency.' From this critical point of view, this study starts with surveying the definition of 'E-Government' based on its historical background, and reveals the implication of privacy right as one of information rights under 'E-Government' in the constitutional perspective. Furthermore, by comparing Korean 'E-Government' policies and realities with those in other countries focusing on privacy protection, this research will reveal the problems in Korean 'E-Government' policies and explore the reform measures. These discussions will be mainly based on the issues including the accumulation of personal information under Korean Social Security Number, infringement of information access rights of Mac users, infringement of privacy right by fingerprinting database, problems of jointly owning personal informations by governmental bureaus, problems in concrete legal provisions, indistinctness of supervising departments in 'E-Government' policies and, lastly, the necessity of responsive system in E-Government frame.

정부부처간 정보공동활용 장애요인 분석

본 연구는 정부부처간 정보공동활용의 장애요인을 분석하고 해결책을 모색하는데 목적이 있다. 이를 위해 42개 중앙행정기관을 대상으로 자료조사 및 관련자 면담을 하고, 공공선택론에서 가정하는 합리적 행위자 관점에서 분석을 실시하였다. 분석결과 정부부처간 정보공동활용이 미흡한 근본적인 이유는 조직구성원 및 정부부처의 이익극대화 성향과 이로 인한 조직구성원의 소극적인 태도, 정부부처의 정보독점 및 무임승차 성향 등이며, 이러한 요소들이 법제도의 미비, 예산부족, 개인정보보호 등을 명분으로 표출되어 정보공동활용이 이루어지지 않는 것으로 나타났다. 이를 극복하기 위해서는 근본적으로 정보공동활용 당사자인 정부부처와 담당공무원들이 정보공동활용을 통해 이익을 극대화할 수 있도록 하는 조직문화의 형성과 함께 인사∙예산상의 다양한 유인체계를 개발하는 것이 필요하고, 정보공동활용과 관련된 법제도의 정비, 예산관행의 혁신, 프라이버시 보호장치의 강구, 정보공동활용을 둘러싼 이해당사자들간 신뢰기반 구축이 필요함을 강조하였다.

행정정보 공동이용 조사과정에서의 콜센터 운영사례 연구

콜 센터 서비스(Call Center Service)는 첨단정보통신기술에 기반한 업종으로 지난 10여 년간 민간기업, 정부와 학계의 주목을 받아왔다 (권현지, 2007). 우리나라에서 콜 센터 개념이 처음 도입되고 그것이 정착되기 시작한 때는 1990년대 중반이고, 초창기의 콜센터의 운영주체는 대기업이며, 주로 제조업이나 통신사업 분야에서 활용되기 시작하였다. 공공분야에서의 콜센터 운영은 매우 제한적이었으나 최근 행정정보공유나 국가DB 및 다양한 정보시스템 개설 및 운영과정에서 상당히 활발하게 응용되고 있다 (정윤수 외, 2010). 본 연구는 행정정보 공동이용 모수산정을 위한 행정정보공동이용 기관 및 잠재수요 기관의 기관/사무/정보 조사 및 기관선정·평가 지표의 타당성·신뢰성 검증 조사과정에서의 콜센터 운영 사례에 대한 연구이다. 본 연구의 결과가 앞으로 공공분야의 콜센터 운영 시에 가이드라인으로써 활용된다면 보다 효율적이고 효과적인 운영이 될 것이다.
