미래자동차의 공간디자인 보호 범위에 대한 검토 - 부정경쟁방지법을 중심으로 -

(연구배경 및 목적) 전기차와 자율주행으로 대표되는 미래 자동차는 단순한 이동과 운송 수단을 넘어 또 하나의 생활공간이된다. 이로 인하여 미래 자동차는 차체 디자인에서부터 내부 디자인까지, 공간디자인에 있어서 상당한 변화를 맞이할 수 밖에 없다. 이처럼 미래 자동차의 경우 기존의 내연 자동차에 비하여 다양한 공간디자인 구현이 가능해짐에 따라 공간 아이덴티티의 중요성이 커지고 있으며, 이에 대한 법적 보호의 중요성 역시 더욱 커지고 있다. 그러나 미래 자동차의 공간디자인에 대한 법적 보호와 관련해서는 자동차라는 물품의 기능성과 디자인 등록요건으로 인하여 「저작권법」과 「디자인보호법」이 한계를 보이고있다. 이에 본 연구에서는 미래 자동차의 공간디자인에 대한 현행법상 보호 범위 및 한계를 「부정경쟁방지 및 영업비밀보호에관한 법률」상의 상품주체 및 영업주체 혼동, 상품형태 모방, 성과모방을 중심으로 검토하고 적절한 보호를 위한 개선 방안을 제언하는 것을 목표로 한다. (연구방법) 본 연구는 우선 미래 자동차의 공간디자인이 제3자에 의하여 무단으로 사용되는 경우 부정경쟁방지법상 「부정경쟁방지법」이 규정하고 있는 부정경쟁행위 유형들 중 상품주체 및 영업주체 혼동, 상품형태 모방, 성과모방에 해당하는지 여부를 검토한다. 이를 위하여 미래 자동차의 차체 디자인과 내부 디자인으로 나누어 관련 규정과 관련된 학설 및 판례들을 조사한다. 다음으로 미래 자동차의 공간디자인 보호에 있어서 현행 부정경쟁방지법의 한계를 검토한다. 다음으로 향후 미래자동차 상용화에 따라 미래자동차 공간디자인과 관련하여 야기될 수 있는 부정경쟁방지법상 분쟁에 대응하기 위한방안을 제언한다. (결과) 특정 미래 자동차의 공간디자인 전체 또는 구성요소를 무단으로 이용하는 경우 부정경쟁방지법상 상품주체 혼동행위 및 영업주체 혼동행위, 상품형태 모방, 성과모방에 해당할 수 있다. 다만, 특정 미래 자동차의 공간디자인 전체 또는 일부가 동종의 상품이 통상적으로 가지는 형태인 경우와 상품의 형태가 갖추어진 날로부터 3년이 경과한 경우에는 부정경쟁방지법상 상품형태 모방에서 제외되며, 미래 자동차의 내부 디자인 전체가 부정경쟁방지법상 하나의 상품 형태로 보호받기는 쉽지 않다. 아울러 성과모방을 광범위하게 인정하는 경우 그러나 부정경쟁방지법상 상품형태 모방의 범위에서 제외되는 통상적으로 가지는 형태인지 여부를 판단함에 있어서, 그 판단 대상이 명확하게 규정되어 있지 않다. 아울러 상품의 형태가 갖추어진 날부터 3년이라는 기간의 기산점이 명확하지 않는 경우가 많다. 또한 일반조항인 성과모방 규정을 광범위하게 해석하는 경우 시장경제의 기본인 경쟁의 자유를 과도하게 제한할 수 있다. (결론) 미래 자동차의 경우 기존의 내연기관차에 비하여 공강디자인 구현에 있어서 제한이 줄어든다는 점을 감안하여,‘동종 상품이 통상적으로 가지는 형태’의 의미를 명확히 하고, 가상공간을 활용한 신차 출시가 일반화될 수 있는 상황을 감안하여 상품 형태 보호기간 3년 기산점을 보다 명확히 할 필요가 있다. 또한 타인의 범위를 한정해서 해석하는 방식으로 일반조항이 지나치게 광범위하게 적용되지 않도록 제한할 필요가 있다.

Recently, Autonomous cars and electric vehicles have been developed and produced, causing a major change in human daily life. There are various types of automobiles depending on their use and function, and new automobiles with advanced technology will continue to be designed and developed along with the development of the modern and future industry. Therefore, it can be seen that the role of industrial design is very important in order to successfully develop the automobile industry that will develop in the future. An industrial design strategy (direction) for the automobile industry, which is more advanced than the existing industrial design strategy, is urgently needed. This study studied the rapidly developing near-future automobile industry and studied how the automobile industry will affect human civilization in the near-future. In addition, this study analyzed the near-future industrial design strategy (direction) for the new concept of the automobile industry and the successful development of the near-future automobile industry. This study researched in-depth the role of industrial design for the development of the automobile industry in the near-future and the automobile industry. Industrial design directions for the near-future automobile industry are classified into the following five. These five directions were deduced from creative design using new energy, ultra-technical innovation design, new industrial design, eco-friendly design for residential environment protection, and teamwork industrial design. The near-future world culture and civilization will lead to the development of new technologies and science accompanied by rapid change. Therefore, it is time to study the role and prospects of the automobile industry according to the role and change of human lifestyle. This study analyzed and researched all expected fields of the near-future automobile industry and presented the direction and role of industrial design to cope with rapidly changing times. 최근, 자율주행자동차(Autonomous Car)와 전기 자동차 등이 개발 생산됨으로서, 인류의 일상에 큰 변화를 일으키고 있다. 자동차는 용도와 기능에 따라 다양한 종류가 있으며, 근미래 산업의 발전과 함께 첨단기술을 적용한 새로운 자동차가 계속하여 디자인되고 개발될 것이다. 따라서, 향후 발전될 자동차 산업을 성공적으로 발전시키기 위하여는 산업디자인의 역할이 매우 중요하다고 볼 수 있다. 기존의 산업디자인 전략보다 발전적인 자동차 산업을 위한 산업디자인 전략(방향성)이 절실히 필요하게 되었다. 본 연구는 급속히 발전하고 있는 근미래 자동차 산업에 관한 모습을 연구하고, 자동차 산업이 근미래 인류 문명에 어떠한 영향을 미칠 것인지에 관하여 연구하였다. 또한 근미래 자동차 산업의 성공적인 발전을 위하여 산업디자인은 어떠한 개념으로 대비해야 하는지에 관한 연구와 함께 신개념의 자동차 산업을 위한 근미래 산업디자인 전략(방향성)을 연구하였다. 본 연구는 근미래 자동차 산업에 관한 연구와 자동차 산업의 발전을 위한 산업디자인의 역할에 대하여 심도 있게 연구하였다. 근미래 자동차 산업을 위한 산업디자인 방향은 다음 다섯 가지로 분류된다. 신에너지를 활용한창조적 디자인, 초 기술 혁신 디자인, 신조형 산업디자인, 주거 환경보호 친환경 디자인, 팀워크 산업디자인으로 이러한 5 가지 방향성을 도출하였다. 근미래 세계문화와 문명은 급속한 변화를 동반한 새로운 기술과 과학의 발전을 이루게 된다. 따라서, 인류의 생활양식의 역할과 변화에 따른 자동차 산업의 역할과 전망에 관한 연구는 필요한 시점이다. 본 연구는 근미래 자동차 산업에 대한 예상되는 모든 분야에 대하여 분석하고 연구하여 급변하는 시대변화에 대처할 수 있는 산업디자인의 방향성과 역할에 관하여 제시하였다.

This study will investigate the history of autonomous vehicles, its difference from conventional automobiles and provide recommendations for the most optimized interior and the exterior design for fully autonomous vehicles in the future. Since the first automobile invention, proficiency to operate vehicles at various speed and road conditions created different rules and regulations. The concept of an autonomous vehicle, where the function supports, relieves and replace human driving to increase efficiency, reduce stress, fatigue and eventually eliminate accidents has been the ultimate goal of everyone. History wise, earliest forms of an autonomous vehicle in a concept form was proposed from the 1930s and with continued development of vehicle and other related technologies, the dream is starting to become a reality. However, it is surprising to know that the design styling of the autonomous vehicle has largely been ignored, and with autonomous vehicles fast becoming an integral part of current automobiles, there is a need for redefining how to develop the design and styling most optimized for fully autonomous vehicles.

This study discusses the need for a seat concept for integrated cooling and heating to improve the energy efficiency of future mobility and the individual thermal comfort of users. An independent seat developed by conducting a thermal management simulation workshop is capable of cooling and heating systems for each part. A mock-up evaluation of the proposed integrated cooling and heating seat was conducted, and future research directions were suggested. By overcoming the problems of the existing air conditioning system, this study proposes a more efficient and comfortable independent air conditioning integrated heating and cooling vehicle seat concept.
