국제거래에서 분쟁이 소송으로 발전될 경우 당해 사안에 적용될 준거법의 결정문제와 어느 나라의 법원에서 재판을 받을 것인가에 대한 국제재판관할권의 문제가 빈번히 대두 되고 있다. 소송을 제기하는 당사자들로서는 자신에게 유리한 재판결과를 얻을 수 있는 법이 준거법으로 선택될 가능성이 있는 국가의 법원에 소송을 제기하는 소위‘포럼 쇼핑 (forum shopping)’전략을 세우기도 한다. 이러한 포럼 쇼핑에 대응하기 위해 영미 판례법 인 common law에서는 오래 전부터 forum non conveniens를 확립하였다. 본 논문에서는 forum non conveniens를 섬리한 미국 대법원의 판단기준을 살펴보면 먼저,적절한 대체관할지의 존재여부이며,둘째 사적이익 부분에서 자국민이 현저하기 불리한 위치에 처하는지를 확인하고,셋째 공적이익 부분에서 미국의 이익이 심각하게 침해되지는 않는지를 검토하여 판단하게 된다. 이러한 법리적 판단근거를 제시하고 이에 대한 적용사례를 분석하여 향후 무역거래를 포함한 일련의 국제계약에 있어 분쟁시 국내기업들이 미국법정에 재판받지 않고 국내법원으로 재판관할지를 선택할 수 있는 전략을 제시함으로써 패소가능성 등의 계약위험을 줄일 수 있을 것으로 판단된다.

Rhinogenic headache is a headache or facial pain syndrome secondary to mucosal contact points or rhinogenic causes in the absence of rhinitis/sinusitis. The authors report a case of atypical rhinogenic headache in a 72-year-old woman who presented with recurrent right side headache, which was aggravated by nasal breathing. A computed tomographic scan showed no evidence of rhinosinusitis and mucosal contact points. However, during nasal endoscopy, she had multiple pain-trigger points on the septum and lateral nasal wall. Treatment involved endoscopic reduction and radiofrequency diathermy of the pain-trigger point. Postoperatively, the headache was successfully relieved, and there was no evidence of recurrence. In this article, the authors present surgical option for the treatment of atypical rhinogenic headache.

성인 운동선수들의 스포츠 부정행위에 대한 윤리적 민감성

The purpose of this study was to identify the ethical sensitivity of domestic adults athletes to sports manipulation. For the study, 362 athletes were examined to confirm the level of ethical sensitivity to sports manipulation, the level of ethical sensitivity to sports manipulation depending on athletes’ characteristics and depending on the completion of sports manipulation education. The multi-facets Rasch model of item response theory (IRT) was applied, and IBM SPSS (ver. 20.0), Facets (ver. 3.67.1), and Winsteps (ver. 3.65.0) were used to analyze the data. The results of the study are as follows. First, domestic adult athletes are sensitive to intentionally arranged manipulations and are insensitive to intentional negligence. Second, athletes showed differences in the level of ethical sensitivity depending on their affiliation and the national team experience. Third, athletes showed differences in the ethical sensitivity level depending on the completion of sports manipulation education. Groups which completed the education are more sensitive to sports manipulation. Based on the results of this study, it is expected that various research can be conducted in sports ethics education field. 본 연구의 목적은 국내성인 운동선수들을 대상으로 스포츠 부정행위에 대한 윤리적 민감성을 확인하는 것이다. 구체적으로 본 연구에서는 362명의 성인 운동선수들을 대상으로 첫째, 스포츠 부정행위에 대한 윤리적 민감성 수준을 확인하였다. 둘째, 인구통계학적 특성에 따른 스포츠 부정행위의 윤리적 민감성 수준을 확인하였다. 셋째, 스포츠 부정행위 관련 교육이수 여부에 따른 스포츠 부정행위의 윤리적 민감성 수준을 확인하였다. 본 연구의 목적을 달성하기 위하여 문항반응이론의 다국면 Rasch 모형을 적용하였다. 문항측정치와 표준오차를 산출하였으며, 조사도구의 타당성 및 신뢰도 관련 증거를 확인하기 위하여 문항적합도지수와 점이연 측정상관계수를 산출하였다. 자료처리를 위해 IBM SPSS(ver. 20.0), Facets(ver. 3.67.1)과 Winsteps(ver. 3.65.0) 프로그램을 활용하였다. 본 연구의 결과는 다음과 같다. 첫째, 국내성인 운동선수들은 의도적 담합에 속하는 부정행위들에 대해 민감하며, 의도적 태만 행위에 대해 둔감한 것으로 나타났다. 둘째, 국내성인 운동선수들은 소속, 국가대표 경험에 따라 윤리적 민감성의 차이를 나타냈다. 셋째, 스포츠 부정행위 관련 교육이수 여부에 따라 윤리적 민감성 수준은 다르다. 교육을 이수한 집단일수록 스포츠 부정행위에 대해 민감한 반응을 나타냈다. 본 연구의 결과를 기반으로 국내 스포츠학을 포함한 스포츠 윤리 교육현장에서 다양한 연구가 진행될 수 있을 것이라 기대한다.

AI Comparative Analysis of Trade and Consumption Patterns in Korea and China

Purpose – This research is to empirically explore the differences in apparel consumption among male and female teenagers and college students in Korea and China. By conducting a survey to understand customers' needs and behaviors, fashion businesses will be able to improve their customer satisfaction and avoid redundancy, inventory, and the waste of resources, effort and money. Design/methodology – The research design considers the consumption patterns of male and female high school and college students in Korea and China. To analyze the data, the study employs decision trees, a type of machine learning algorithm. A decision tree model was developed to examine the relationship between the explanatory and response variables, which can be either quantitative or qualitative in nature. Findings – The main findings of this study indicate that there are differences in shopping behavior among different customer segments. The results show that men have a simpler shopping behavior compared to women. Additionally, cultural factors and the difference in fashion needs between students and non-students have a significant impact on the shopping choices of Chinese and Korean individuals. Originality/value – Existing studies often assume that the shopping behavior of high school and university students is similar and that there are no significant differences in clothing purchases between men and women across countries. The results provide valuable insights into the unique shopping behavior of different customer segments, and can inform fashion businesses in their efforts to meet the needs of their customers.

China has used the Antidumping policy as a trade protection tool against Korean products due to reduce the deficit of trade balance of payment, boost the economic growth and protect its weak industries. This paper investigates whether there is a connection between the China’s macroeconomic activity and pressures for protection under antidumping with using the current data that come from the WTO, World Bank for 1997 to 2010. The result suggests that pressures for protection under Antidumping against exporting of Korean products to China have increased during periods of macroeconomic weakness like high unemployment, low economic growth, larger deficit of trade balance and decreased during periods of macroeconomic strength.

Construction of High-Density Tissue Microarrays at Low Cost by Using Self-Made Manual Microarray Kits and Recipient Paraffin Blocks

Background: Advances of tissue microarray (TMA) technology have enabled simultaneous in situ ana lysis of biomarker expression in a large number of archived pathology specimens. However, the relatively high cost of TMA construction may hamper many researchers from using this essential tool of modern pathology research. We discuss methods for making TMA kits and recipient blocks for manual construction of high-density TMAs at lowcost. Methods: Ordinary cannula piercing needles, hypodermic needles, bone marrow biopsy needles, metallic ink cartridges of ballpoint pens, and disposable skin biopsy punches were used to construct self-made manual TMA kits. The recipient blocks were manufactured by boring holes in the conventional bare paraffin blocks. A mini electric hand drill and a microcompound table assembled on a drill stand were used to maximize the capacity of the recipient blocks. Results: By using TMA kits made from cannula piercing needles (16- and 18-gauge), it was possible to construct TMAs with 1 mm×140 cores, 0.6 mm×320 cores, 2 mm×70 cores, 3 mm×35 cores, and 5 mm×12 cores. The capacity of the recipient blocks could be dramatically increased by drilling holes. Conclusions: Construction of TMAs using self-made TMA kits is an inexpensive alternative to construction of TMAs using commercial devices.

This study is a thesis of series about the establishment of collective residence function through total dweller's life within collective residence place. From these viewpoints named a development of dweller's human relation, living time, living sphere and community consciousness on the Busan apartment site, this could be sought as a following conclusion on Busan apartment sites of white colour class on the purpose of continuous study for community site fixation. 1) District community of dweller's human relation has little proportion as against household but large proportion in the housewife. 2) District community by the street is related with environments on the same degree with internal district but still now, human relation before occupancy is greater than after occupancy. 3) There are some visitors in the home, and there are so many internal inter-neighbourhood visitors among them. In this viewpoint, housing becomes a social space so much. 4) Consciousness on meeting is affirmative or desiring the developmental side, especially this is notable on meeting of voluntary social sphere. 5) Structure of dweller's living time divides into householder and housewife of urban communing white colour class I guess. 6) On purchasing sphere, though daily provisions necessities are dependent upon internal district or district periphery is dependent on urban department.
