공제조합에서는 회원 자신들이 조합의 소유자이자 고객이기 때문에 도덕적 위험과 같은 불완전정보(imperfect information)의 효과를 연구하는데 대한 독특한 상황을 제공한다. 이 연구에서는 공제조합의 n-회원 모형을 제시하여 이원돈(2000)의 2-회원 모형의 연구결과를 검증하고, 회원수의 증가에 따른 도덕적 위험의 변화를 이론적으로 분석하여 도덕적 위럼이 존재할 때 각 회원의 최적 손실예방 노력수준은 회원수의 감소함수가 된다는 것을 보인다. 마지막으로, 도덕적 위험이 있을 때와 도덕적 위험이 없을 때 최적 손실예방 노력수준의 차이가 회원수의 증가에 따라 커짐으로 인한 도덕적 위험의 심각성을 보인다. Because of their equity stake in the risk pool, pool participants face different loss prevention incentives than purchasers of standard insurance contracts with equivalent expected benefits and premiums. This study examines moral hazard problems with a one-period and n-member risk pool model, in which each member's utility is represented by a strictly increasing von Neumann-Morgenstern utility function. When each member's preference shows non-increasing absolute risk aversion, moral hazard becomes more severe as the size of the pool increases. That is, moral hazard is an increasing function of the size of the pool. In addition, the author shows the distortion from moral hazard is getting bigger as the size of the pool increases.
상법 제 649 조 제 1 항 단서의 해석 : 타인을 위한 보험계약의 임의해지

상법 제649조 제1항의 단서는 타인을 위한 보험계약의 경우에 보험계약자의 사고발생전 임의해지권을 제한하기 위하여 1991년 상법 개정시 추가된 것이다. 동 단서는 타인을 위한 보험계약을 보험계약자가 임의로 해지하지 못하는 조건으로 '타인의 동의'를 얻지 아니하는 경우와 '보험증권을 소지'하지 아니하는 경우를 '가리지 않는다'는 뜻의 연결어미 '∼거나'를 사용하여 열거하였다. 기존의 모든 보험법 문헌은 동 단서의 해석을 입법취지에 따라 보험계약을 해지하기 위해서는 '타인의 동의' 와 '보험증권의 소지' 중 한 가지를 만족하면 되는 것으로 해석하고 있다. 본고에서는 동 단서가 입법취지에 따라 표현되지 않았고, 따라서 해석도 달라짐을 수학적 증명으로 보이고 그에 따른 문제점을 지적하고자 한다. 더불어 동 단서의 생명보험 보험수익자변경권에의 적용문제에 대해서도 언급하고자 한다. The proviso of Subsection 1 of Section 649 of the Commercial Code was added in the process of 1991 amendment to restrict a policyholder's right to cancel the insurance contract for an account of another person. For the restriction of policyholder's cancellation the proviso specifies two conditions, 'no another person's consent' or 'no possession of policy'. Complying with the reasoning of enactment the current literature of insurance law interprets the proviso as follows : it is required for a policyholder to cancel the contract that the policyholder gets 'another person's consent' or possesses 'an insurance policy'. This article shows by a mathematical proof that the proviso is not expressed after the reasoning of enactment, consequently interprets it as a different meaning, and pinpoints potential problems. In addition, the article mentions an application of the proviso to life insurance policyholder's right to change beneficiaries on the contract.
