고용의 유연안정성(flexicurity)과 근로계약법의 법제화 방향

労働市場をめぐる環境変化により従属労働を理念とする伝統的な労働法体制にかわる新たな労使関係のパラダイムが議論されている. そして, その方向として勤労契約法制の導入, 事業場内での協力的な労使関係の強化, 国家の積極的な雇用政策の実施および雇用の柔軟性の向上などが提示されている. この論文では, 向後, 我が国が勤労契約法を制定するにおいて, 内ㆍ外部労働市場の全体的な観点からみて雇用の柔軟性と安定性の調和のある規制をするためには, どのような内容で法案を構成するのが望ましいか, その方向を提示する. 我が国は, 日本やドイツ及びアメリカなどに比べ, 解雇および非正規勤労に対する規制が厳しくて雇用の量的な調整が容易にならなく, 内部労働市場でも就業規則の不利益変更時の勤労者側の集団的な同意が法定の効力要件となっているなど雇用の質的な調整も困難である. また, 継続的な法律関係である勤労契約の成立ㆍ展開ㆍ終了に関して両当事者の対等な合意を可能とする民事的な法律の不在などの問題点がある. 日本やドイツの雇用ㆍ勤労条件決定制度は, 民法上の解雇の自由を労働法で制限するによって雇用保障の側面で我が国と類似した制度を備え, また, 勤労契約法を制定したか制定しようと努力している. アメリカの制度は, 勤労契約に関する別の法律は存在しなく, 普通法上の任意雇用の原則(employment-at-will doctrine)により外部労働市場を通じて雇用の量的ㆍ質的な調整がなされるのである. 両制度は, 雇用の安定性と柔軟性が調和を成す方向へ, 収斂されている. 勤労契約法の主な内容は, 総則, 勤労契約の成立ㆍ展開ㆍ終了, 及び企業変動時の雇用承継に関する問題であり, 関聯制度として勤労者代表制度と個別紛争解決制度をあげることができるが, その内容をどのように構成するかにより労働市場の柔軟安定性の程度が決定される. 雇用の安定性と柔軟性が調和を成す制度とは, 勤労契約の成立ㆍ展開ㆍ終了の全過程で, 勤労者たちの雇用と勤労条件を安定的に保障するとともに, 企業が経済変動によく適応できるように柔軟性を保障する制度である. 過渡期的な勤労関係と雇用終了過程などでの勤労者たちの雇用保障のための規定や, 就業規則の不利益変更法理の立法化など雇用の柔軟性を向上させる規定は, このような雇用の安定性と柔軟性の均衡という観点から理解できる.

Eines der wichtigsten Symbole in Rilkes Dichtung ist die Kindheit. Die vorliegende Arbeit geht davon aus, daB dieser Symbolik sein eigenes einmaliges Kindheitserlebnis zugrundeliegt and daB dieses Kindheitserlebnis auch fur seine Kunstauffassung von ausschlaggebender Bedeutung ist. Die fur sein games `Verk wesentliche Kunstauffassu.ng hat Rilke bereits 1898 in seinem Florenzer Tagebuch entwickelt; diese Auffassung von der Kunst als Selbstverwirklichung des Knnstlers, deren Quelle die Kindheitserinnerung ist, steht ir. ursachlichem Zusammenhang mit seinem Erlebnis der Entfremdung in der Militarschule. Im Verlauf der Betrachtung wird dann auch gezeigt, wie eindeutig and konsequeut der Dichter sich in seinem Werk and in seiner Lebensfuhrung zu dieser Welt der als Auftrag erfahrenen Kunst bekannt hat.

비쥬얼 텍스츄어(texture)를 활용한 브랜드 로고 타입에 관한 연구

현대는 다각화된 디자인 방법이 요구되는 시대지만 디자인 전개와 방법에 있어서는 유사성이 두드러지고 있다. 수많은 아이템들이 있는 슈퍼마켓에서 소비자의 시선을 끄는 것이 점점 더 어려워지고 있으며, 패키지 디자인에 있어서 단순한 시각적 임팩트와 튀는 그래픽은 차별화에 한계를 느끼게 한다. 브랜드는 구매 시점에서 소비자의 감성과 일치하여 감정적 요소를 자극하는 동시에 제품의 이미지를 효과적으로표현해야 한다. 브랜드에 있어서 경험이란, 제품과 메시지 뿐아니라 사람들이 오감으로 느끼는 것을 포함한 모든 것을 말한다. 브랜드를 인식하는 중요한 요소인 로고는 브랜드와 밀접한 관계를 갖는 시각적 표현을 창출함으로써 소비자의 뇌리에 긍정적 인상을 형성해야 한다. 그래픽(Graphic) 표현요소에 있어 대표적인 시각적 전달 요소인 텍스츄어(texture)를 브랜드 이미지의 핵심적인 요소인 로고타입에 효과적으로 적용하면 하나의 차별적 표현요소가 될 수 있다. 본 논문은 시각적으로 촉감을 유발하는 조형요인들의 관계를 살펴보고, 이를 토대로 패키지 디자인에 있어 브랜드 로고타입을 활용한 효과적인 시각적 촉감 전달에 대해 연구 하였다. 우선, 표면적 질감을 느낄 수 있는 4개의 형용사인 매끄러운(Sooth), 거친(rough) 재질감, 가벼운(Light), 무거운(Heavy)을 활용하여 패키지 디자인에서의 브랜드 로고를 이미지 맵을 통해 분석하였다. 그 결과, 국내 패키지 디자인에서 브랜드 로고의 사례를 보면 장식체를 주로 사용하였고 유연한 붓터치와 복합된 선의 형태가 주를 이루고 있다. 조사 된 국내 패키지 디자인의 브랜드 로고에는 한정된 촉감의 표현이 나타나는데 주로 손끝에 느껴지는 거칠기와 결감이었다. 마지막으로 제품의 속성과 컨셉을 분명히 하여 촉감적 표현을 활용한다면 제품 이미지에 더욱 효과적일 것이다. 로고를 통한 시각적 촉감의 성공적인 표현은 별도의 마케팅 노력을 통하지 않고도 소비자에게 강력한 브랜드 인지도를 형성하게 될 것이다. Today diversified methods of design are required, it has progressed similarly. Accordingly it is getting more difficult to arrest attention consumers' eyes in the market where is lots of items, package design can be expressed for visual impact on depending an attractive graphic. Thus, it is well expressed products' image for changing brand to image together with stimulating consumers' emotional parts effectively at this point in purchasing. Brand is not only a message and company's products but also all experience including that people feel them by the senses. The logo, one of important factors to recognize the brand, has to make positive impression to consumers' memory by creating visual expression relating to brand. Texture which is a typical visual factor in a graphic could be a discriminative factor by utilizing it to logo types effectively. We research focusing on visual tactility the connection with formative factors giving occasion for tactility. On the basis of the relationship among formative factors, we make a study about the visual tactility methods utilizing brand logo types at the package design.

In this paper, design and analysis of permanent magnet synchronous generator for ocean thermal energy conversion (OTEC) considering magnetically coupled turbine-rotor system is discussed. In particular, the rotor dynamics considering bearing span and journal shaft diameter is highlighted. The two topologies of permanent magnet synchronous generator with magnetic coupling are employed for comparison of computed rotor dynamics and generating characteristics. The analysis results show that the critical speed of the turbine-rotor system is higher when the rotor is coupled by magnetically coupling. Finally, the experimental results confirmed the validity of the proposed design and analysis scheme and successful development.
