        중국의 저작권관련분쟁 소송제도에 대한 소고

        중국은 최근 몇 년 동안 년 10%대의 높은 고도성장을 유지하면서 세계경제에 절대적 영향을 끼치고 있으며 1992년 한국과 정식으로 수교한 이후, 양국 간의 교류가 매우 활발히 이루어지고 있다. 21세기 중국과 한국과의 관계는 정치, 경제, 문화 등 모든 방면에서 수교직후와 비교할 수 없을 정도로 밀접한 관계가 될 것이라는 점은 어느 누구도 부정하지 못할 것이다. 양국관계의 지속적인 발전이 양국국민의 상호이해와 협력의 바탕 위에서 이루어진다는 점을 생각하면 상호간의 법률제도에 대한 이해는 필수적인 것이다. 이 글에서는 먼저 지적재산권에 대한 중국 특유의 소송제도를 고찰하고 지적재산권의 한 분야인 저작권에 대한 중국의 소송제도를 검토한 후 저작권분쟁에서 주요한 자리를 매김하고 있는 온라인저작권분쟁사건을 중심으로 살펴보았다. 한국은 이제 곧 추진하는 한 · 중 FTA에 대비하여 지적재산권분야 협상에서 높은 수준의 FTA 협상을 체결하도록 중국을 압박하기 위하여서는 비록 아직 낙후되어 있다고 평가되기도 하는 중국의 지적재산권제도에 대해 깊이 있는 연구를 하여야만 이 후의 한 · 중 FTA 협상에서 유리한 지위를 차지하여 높은 수준의 협상을 하도록 이끌어 나갈 수 있을 것이며 또한 이러한 시도는 중국법제에 대한 올바른 이해를 증진시켜 양국 사이의 지적재산권침해소송과 관련한 사법마찰을 줄일 수 있는 계기가 될 수 있을 것이다.

      • 저작운동시 전측두근과 교근의 근활성 및 활성시기에 관한 연구

        This study was performed to investigate the electromyographic(EMG) activity, firing time and sequence of the mandibular elevator muscle on gum chewing. For this study, 28 patients with temporomandibular disorders(TMD), especially internal derangement of TM joint, and 16 dental students without any signs and symptoms in the masticatory system were selected as the patients group and as the normal group, respectively. The patients group was composed of 14 right and 14 left side affected patients. For recording of EMG activity(㎶) of the anterior temporalis(TA) and the masseter muscle(MM), and measuring of firing time(millisecond) from the start of mandibular opening movement to the firing of the muscles, BioEMG, BioEGN, and Combo program integrated in the Biopak system(Bioresearch Inc., Milwaukee, USA) were used. Gum chewing stroke was performed in both right and left side for several times, and the first and the second chewing strokes were analysed and compared with regard to EMG activity, firing time, firing sequence, correlation between EMG activity and firing time. The data obtained were analysed by SPSS windows program and the results of this study were as follows 1. In the patients group, chewing on the affected side showed higher EMG activities in the masseter of the side than those of the contralateral side, but chewing on the unaffected side showed higher EMG activity in the masseter and in the anterior temporalis of the side than those of the contralateral side. 2. There were no difference of firing time between both sides on chewing on the affected side, but firing time in the chewing side were earlier than that of contralateral side on chewing on the unaffected side in patients group. 3. In the normal group, EMG activities in the masseter and in the anterior temporalis in the chewing side were always higher than those of the contralateral side, and there were no difference of firing time between the two sides. 4. In general, firing sequence of four muscles of both sides were ipsilateral TA, ipsilateral MM, contralateral TA, and contralateral MM in earlier order of time in both groups. Correlation coefficients between EMG activity and firing time were negative value, and more significant correlation were appeared in the normal group than in the patients group.

      • 제1경추골의 위치와 경추만곡도 간의 관계

        This study was performed to investigate the relationship between cervical curvature and the spatial position of the posterior part of the atlas imaged in the lateral cephalograph. Sixty six patients with temporomandibular disorders(TMD) and twenty dental students were selected for patients group and control goup, respectively. The average age of patients group was 26.3 years, and 24.9 years in control group. Measured variables were cervical depth, upper space between the atlas and the base of the occiput, lower space between the atlas and the spinous process of the axis, area of the posterior part of the atlas imaged in the lateral cephalograph, and the cervical curvature passing through the uppermost point in dorsal side of Dens of the Axis to the lowermost and rearmost point of the 5th cervical vertebra. The reliability of the method used for measuring cervical curvature with curved ruler was also tested. The results obtained were as follows 1. Cervical depth of patients group was 122.9㎜ and significantly shorter than that of control group, in which cervical depth was 131.9㎜, and cervical depth was significantly correlated with other variables in all subjects. 2. Upper space was greater in patients group, but total space including upper and lower space showed no difference between the two groups. The average value of total space was 26.5㎜. 3. Area of the posterior part of the atlas was 168.2㎜^2 in patients group, and 186.5㎜^2 in control group with significant difference between the two groups. 4. Average range of radius of cervical curvature were 33-40㎝ and there was no difference between the two groups. 5. There was no significant correlation between the cervical curvature and the area of the posterior arch of the atlas. 6. The method using curved ruler for measuring cervical curvature could be accepted as a reliable method.

        평면 배열 안테나에 의한 다중 빔 복사 패턴의 합성

        임의의 필드 분포를 갖는 단일 페치 안테나를 평면 배열하고 각 소자에 공급되는 급전 신호의 크기와 위상을 유전자 알고리즘으로 최적화하여, 여러 방향의 지향성과 널을 갖는 다중 빔 복사 패턴의 합성 방법을 제안하였다. 제안된 방법의 유효성을 확인하기 위해서, $2{\times}2$ 평면 배열 안테나를 제작하고 원거리 복사 패턴의 계산 결과와 측정 결과를 비교하여 동일한 특성을 확인하였으며, 다중 빔 복사 패턴의 합성은 $8{\times}8$ 배열 안테나 시스템을 이용하여, 시뮬레이션을 통해서 각 소자의 급전 신호의 크기와 위상을 최적화하였다. In this paper, the synthesis method of multibeam radiation pattern with multi-directional beams and nulls is proposed. Genetic algorithm is applied for the optimization of amplitude and phase of the feeding signal into each element that is structured in planar array of single patch antenna with an arbitrary field distribution. To verify the validity of the proposed method, $2{\times}2$ planar array antenna is used for the measurement and the measured far field radiation pattern is compared with the simulation result. As a result, the synthesis of multibeam radiation pattern is implemented by the optimization of amplitude and phase of the feeding signal into each element of $8{\times}8$ planar array antenna system.

        격자로 분할된 개구면을 갖는 혼 안테나의 이득 개선

        정사각형 혼 안테나의 개구면을 $3{\times}3$의 도체 격자로 분할하여 이득을 개선하였다. 개구면상의 균일한 필드 분포를 얻기 위해서, 중앙과 가장자리의 격자에 두께가 서로 다른 유전체 판을 삽입하여 위상을 보상하였다. 12.5GHz 대역의 혼 안테나를 설계하여 FDTD 방법으로 개구면의 필드 분포를 해석하였고, 이로부터 복사 패턴을 계산하였다. 실제 측정한 결과, 격자형 개구면을 갖는 안테나의 이득은 18 dBi로 일반적인 혼에 비해 이득이 약 2 dB 개선됨을 확인하였다. In this paper, the gain of the square hem antenna is enhanced with $3{\times}3$ latticed aperture. In order to get the uniform field distribution on the aperture, the different thicknesses of dielectric plates for the phase compensation are inserted into the center and the edge of the aperture respectively. The proposed horn antenna is designed at 12.5 GHz band, and then the analysis of the field distribution on the aperture is performed by using FDTD method. The radiation pattern is also calculated from the analysis. Based on the measured data, it is verified that the gain of a horn antenna with latticed aperture is 18 dBi and this is 2 dB gain enhancement compare with a normal horn antenna without latticed aperture.
