Motivated by the Great Earthquake of the Eastern Japan on March 11, 2011, this paper looks after the cases of Roman law in which earthquakes are mentioned and dealt with as a legal issue. We can find out several cases in which earthquakes destroy buildings and fields and thus cause Roman lawyers to solve the legal problems rising out of that vis maior, irresistible force of nature. Especially jurists of the late Republic, Servius, Labeo, and Namusa set the criterium of distributing risk among persons concerned and thus put the foundation for later discussions by their successors in the Imperial period, Sabinus, Javolenus, Papinianus, Ulpianus, and Paulus. This criterium is: whether or not the damages are caused by earthquakes or by the inherent deficiency of the thing itself. The concrete legal consequences differ according to the constellation of the cases. Legal issues they treated concerned res sacra (temple), locatio conductio rei (field), locatio conductio operis (building contract), cautio damni infecti, actio aquae pluviae arcendae, pollicitatio, and usus fructus (destruction of objects). These cases also show clearly enough that Roman jurists practiced their famous disputatio fori over the generations to find out reasonable solutions. 이 촌고는 東日本 大地震을 계기로 고대 로마법에서 地震을 다룬 법사료를 일별해 본 것이다. 로마인들에게도 익숙했던 자연재해 중 하나였던 地震은 다양한 법적 맥락에서 논의의 대상이 되었다. 구체적으로는 神物, 농지임대차, 건축도급계약, 미발생손해 담보문답계약, 雨水防除訴權, 공공기부의 片約, 용익역권 등과 관련하여 논의되었다. 기본적으로는 불가항력이라는 그 특성으로 인하여 누구도 책임을 지지 않는다(a nullo praestari), 그래서 그 손해는 달리 정해지지 않는 한 결국은 소유자가 부담한다(Casum sentit dominus)는 원칙을 확인한 위에서 관계된 사안의 다양한 문맥에 따라서 적절한 법적 해결책을 모색했음을 살필 수 있었다. 몇 안 되는 사례들이었지만 로마의 법률가들이 시대와 공간을 초월한 공통의 법적 논변의 장에서 문제의 합리적인 해결을 위해 애썼다는 사실도 다시 한 번 확인할 수 있었다.

This article surveys the ancient Roman law to investigate whether or not the concept of intellectual property was known to it. The sources concerning the main objects of the survey, manuscripts for theatrical perfomances and pictures, show that the Romans had no idea of a legally protected right of intellectual property even though they also were, as a matter of fact, quite aware of the value of authorship and its honor. The evaluation was higher in case of the painting at all events, but no legal right was recognized either. The opinion that as a remedy the actio iniuriarum came into question is anachronistic. It is clear that the intellectual property has originated in the modern times.
