대한민국의 해외철도건설은 2002년부터 2010년 누적액수로 42억불의 수주를 기록하였고, ′11년에는 약 8억 2천만불의 해외수주를 기록하였으며, 미래에 한국을 먹여살릴 수 있는 차세대의 성장동력으로 거론되고 있다. 하지만, 현재의 수주형태가 "경쟁 입찰 형태의 분할 발주"를 통해서는 가격경쟁력이 중국보다 낮아 해외에서 수주를 기대하기가 어려운 실정이다. 그러므로 본 연구에서는 국제금융 및 현지금융 활용 방안을 통한 해외철도 프로젝트 사업의 활성화를 위해 사례로 필리핀 도시철도사업의 사례를 살펴보았다. From 2002 to 2010 year, Korea railway industry awarded overseas railway contracts to accumulate $ 4.2 billions. In 2011 year, the total of oversea railway constructions and services records the amount of $820 millions. This figure means that Korea railway industry will be new Korea growth industry near future. However, our competitors such as France, Germany, China and Japan railway industries, will lead to global railway contracts to invest and make financial structure by international finance methods. In this thesis, we suggest that Korea railway industry must know and use several international fiance methods as like IFC and ADB so on. we analysed one case-study in philippine south-metro railway business to using intentional fiance by K-EXIM.

This study referred to the existing Global PM theory system such as P3M3 (2006) and PRINCE2 (2017) and prior research on PM Maturity by Professor Shin-Bong, Kang (2016). Basically, the global PPP theory system has been studied in advance. For example, I used the World Bank Group, ADB and IDB, which are the leading Multinational Development Bank (MDB), leading global PPP knowledge and experience. In addition, it was based on the Global PPP theory system that I used to develop government PPPs in developing countries, and created and constructed a PM maturity research model for PPP development in developing countries. In particular, the researcher's experience as a consultant and advisor at the World Bank Group and ADB in the past revealed that the following was important. Overseas business development promoted by Korean private companies and public institutions should utilize global financial and PPP systems in developing countries. Accordingly, there must be a sense of the problems that Korea faces in order to enter the global PPP market. In particular, after the Corona 19 pandemic, I wanted to look at the “PM Maturity” of “Project Development Business” necessary to advance to the PPP private development market in developing countries, which is the future market. In addition, Manpower reaffirmed the importance of “PPP, PM Participation”, which is the basis for "maturity of PPP and PM competency". This paper is intended for members of the construction, plant EPC, engineering, and project developer companies in Korea who are working on PPP development projects in developing countries.

미국의 철도산업의 경우에는 한국과는 다른 방향으로 철도구조개혁과 경쟁에 대한 체제를 도입하였다. 즉, 과거에 정책적인 변화를 위한 경제적인 동기를 위해서 탈규제화에 대한 방향으로 철도산업을 복원했다는 가장 큰 특징이 있다. 그러므로 본 논문에서 미국연방정부가 철도산업을 진흥하기 위해서 시행했던 정책적인 방법으로 탈규제를 중심으로 한 자율성의 강화가 가장 큰 특징이라고 할 수 있을 것이다. 본 미국의 사례를 바탕으로 한국철도의 규제완화가 되어야 할 사항에 대하여 보다 더 많은 연구가 진행되길 기대한다. American railway industry was very different organization restructuring policy methods for introduce railway competition to compared with Korea railway. So, US railway industry is willing to economic motivation for deregulation of competition for private railway operators to competing other transportation modes such as road and airlines. This is very different policy method to railway industry restructuring. In this reason, this thesis would like to introduce the US railway reform and reorganization to Korea, and this thesis will help to deregulate of Korean railway industry restructuring, and introducing private freight operation market in Korea.

도시설공단-방글라데시 정부계약서와 FIDIC 계약과 비교연구

한국철도시설공단은 중국진출사업의 가시적 성과를 바탕으로 동남아, 서남아시아(네팔, 방글라데시), 중동(오만) 등 진출 가능한 해외철도 시장을 대상으로 활발한 시장개척 및 수주 활동을 전개하고 있다. 그러나 서로 다른 법과 제도, 관습, 언어, 문화의 차이가 존재하는 국제적 비즈니스 환경에서는 상호간에 계약서를 공정하고 정확하게 작성하는 것이 무엇보다 중요한 요건이다. 그러므로 본 논문에서는 2014년 12월 철도시설공단에서 방글라데시 정부와 체결한 국제계약서(이하 계약서라 칭한다)를 국제계약의 표준계약서인 FIDIC International Contract (Red Book)과 비교 분석하였다. 향후 철도시설공단에서 진행할 글로벌 해외사업에 대한 공사비 초과, 공기지연, 계약클레임 등 계약실패에 대한 리스크를 사전에 방지하고, 향후 철도시설공단이 시행 할 국제계약시의 대두되는 문제점 비교사례 연구를 통해 도출하고, 향후 개선방안에 따른 시사점을 도출하여 철도시설공단의 해외사업에 보다 기여하고자 한다. KR network has activated the vigorous development of markets and won contracts in overseas railway markets such as Southeast Asia, Southwest Asia (Nepal, Bangladesh), Middle East (Oman) that are based on tangible results of the successive performance of China Railway construction. However, it is essential that KR network makes fair and precise contracts with each other in global construction business, though there are differences among the different laws, regulations, customs, language, and culture. Thus, we will have the comparative analysis between ‘Contract for KR consortium with Bangladesh in December 2013’ and FIDIC international Contract (Red Book), the international construction and engineering field agreement standard contract. It can prevent potential risks such as construction expenses, construction period delay, contract claims in business. This FIDIC contract will make the KR network more progress in the future, it can draw implications of improvement and problem solutions in international contract.

FIDIC Red Book 과 공정위 표준하도급 계약과의 비교 연구

논문은 국제적인 계약조건인 FIDIC Red Book과 한국에서 활용되는 일반적인 단순시공 계약인 공정거래위원회의 전기공사업종 표준하도급 계약을 비교 분석하여, 이를 통해 한국의 하도급 거래질서가 Global Standard에 부합하는 계약으로 확립되도록 하고, 불공정한 하도급 관행 개선에 도움이 될 수 있도록 향후에 개정이 필요한 계약의 조건들을 살펴보았다. 이를 통해 본 논문은 공정거래위원회의 전기공사업종 표준하도급 계약서를 중심으로 계약내용을 분석하고, 이를 FIDIC Red Book과 비교 검토하여 국제계약과 다른 사항을 도출하고, 계약 실무적으로 내용을 보완할 수 있도록 개선방안을 제시하였다. This paper is to comparison study of FIDIC Red book and Korea government agency, Korea Fair Trade commission (FTC)’s standard subcontract. This paper researches comparison study method to compare all of the terms and conditions of two contracts. So this paper suggest to Korea Trade commission (FTC) will be change FIDIC red book’s reasonable subcontract trade practice to improve the subcontract for the compliance with global standard contract in Korea.

국내 민간투자사업계약과 FIDIC 국제계약간의 비교연구

본 논문은 한국의 철도관련 민간투자사업의 계약과 FIDIC 국제계약(Red book)의 각각의 조항을 비교하고자 하였다. 두 개의 계약의 비교연구를 통해서, 우리는 한국의 민간투자사업의 문제점을 분석하였고, 이를 향후에 어떻게 개선하여 글로벌 스탠더드 수준으로 향상 할 수 있을지를 논하였다. 마지막으로 본 논문은 6개의 세부 결론으로 한국의 민간투자사업의 계약과 실제의 관행이 FIDIC에서 이야기하고 있는 국제적인 관행으로 변화해야 함을 논하였다. This paper study on the comparison study of contract point of each parties by clause in details between Korea’s PPP and FIDIC International Red Book. In the review of two contracts, we analyzed the status of Korean PPP problems and how to improve to Korea contract to international standards in the future. In the final result, we suggest 6 points that Korea PPP contracts and real practice must to change by FIDIC international standards.
