본 논문의 목적은 선진국 문턱에 올라선 한국이 평화와 공영을 선도하는 나라로 거듭나기 위한 헌법개혁의 필요성과 실천과제를 논의하는 것이다. 본 논문은 먼저 제국질서와 공화국질서 사이에 형성되는 세 가지 헌법질서 유형을 권위주의 체제와 빈약한 민주주의 및 강한 민주주의로 범주화하고, 강한 민주주의의 높은 정책성과를 증명하는 스위스와 노르딕 미러클을 점검하고 경험적 연구결과를 검토한다. 이어서 ‘87년 헌법질서의 결함을 빈약한 민주주의로 진단하고, 이를 강한 민주주의로 전환하는 분권화 헌법개혁의 방향과 과제를 소수보호 합의민주제 강화, 연방적 지방분권, 직접민주제 확충으로 나누어 제시한다. 아울러 지역대표형 상원의 논거와 양원제 개헌의 설계지침을 살펴본 다음, 최근 시도된 강한 민주주의 헌법개혁의 노력과 좌절을 일별하고 헌법개혁을 가로막는 요인과 그 극복 방안을 고찰한다. 끝으로 국민참여 헌법개혁의 필요성과 개헌 일정에 관해 언급한다. The study aims to explore and discuss the constitutional reform agenda for a strong democracy in Korea to cope with the defects of liberal democracy exposed in the midst of the transformation of civilization across the globe. To achieve this aim, the study begins with classifying three types of constitutional orders situated on the conceptual continuum between the Empire Order and the Republic Order: authoritarian regime, thin democracy, and strong democracy. Next, it identifies strong correlations between the constitutional orders and their policy performances based on previous empirical studies and demonstrates the prominent cases of Swiss and Nordic miracles. Third, it points out three types of constitutional faults in Korea’s thin democracy: winner-takes-all majoritarian democracy, hyper-centralized intergovernmental relations, and elitism in representative democracy. Fourth, the study suggests a set of constitutional reform agenda to include severely excluded minorities, localities, and citizens in the existing political system through power sharing with the majority, the center, and the elites, respectively. Fifth, the study particularly highlights the needs for introducing a bicameral legislature and offers design guidelines for creating a regionally representative upper chamber. Sixth, it examines the challenges and barriers encountered in the process of constitutional reforms. Finally, the study concludes with some suggestions on the participatory constitutional change and the future reform schedule related to the upcoming presidential election on March 9, 2022.
