The purpose of this study is to grasp the origin of the conflicts between the institution for preservation and the motives of modification applications around the cultural properties, based on the analysis of the administrative appeal cases on designations and modifications of cultural property-protective-review zone. The data were collected from the web database of Korean Ministry of Government Legislation. Among 211 search results related to "cultural property", the 41 cases relevant to the subject of this study has been analysed. According to the analysis, the claim that modification deliberation decision was against equity is the common insistence besides the issues about the uncertainty of sanction criteria, excessive repression of private need and interest from the use of the space, and restriction on the use of the land. Overall, conflicts were due to the role of standard and its administrative procedures. In order to reduce the conflicts, this study suggests that the modification deliberation decision process is to be supplemented with the prior management plan including guidelines and the consultation proceedings.

The physical standard of school location is getting lost its critical power on the location decision making procedure. The restructuring of school facilities and their rearrangement, the agent who is responsible for facilities’ installation expense and negative externality are the conglomerate social issues that consequently delivering the deterioration of physical condition. This study points out those issues by the result of analysing preceding studies’ research subjects and apprehends their contextual effects on the conflicts cases between schools and their adjacent communities. As for the cases, externality, the complexity of interest bounded to the communities’ specific context, and the legal procedure of location adoption have the latent conflict-causing institutional features. The Analysis of interactions between stakeholders implies the flexible approach to the coordinative social decision making of school location, which means the necessity of preliminary opinion gathering and its definite responsible institution’s role.

보행자우선도로의 디자인 요소에 대한 운전자 인지 및 운전 행태에 관한 연구

최근 관련 법률 개정을 포함하여 보행권 확보와 쾌적한 보행환경을 실제 조성하기 위한 다양한 사업들이 진행되고 있다. 특히 서울시에서는 주거지 이면도로에서의 보행우선권 확보를 위해 보행자우선도로 설치 시범사업을 2013년부터 시행해왔고, 2017년 현재까지 60여 개 이상의 사업이 실행되었다. 이 사업들은 도로 노면 등에 시각적 디자인 요소를 구성하여 운전자의 차량감속을 유도하도록 하는 것을 주요한 방법 중의 하나로 사용하고 있다. 또한 사례에 따라서 다른 디자인 요소도 병행되어 활용되고 있으나, 어떤 디자인 요소가 운전자의 행태 변화에 효과를 가지는 지에 대해서는 경험적으로 검증된 바는 없다. 본 연구는 보행자우선도로 디자인의 시각적 요소가 운전자에게 인지 되고 행동결정요인으로서 운전 행태에 영향을 미치는 지를 운전자 차량주행 실험과 설문을 통해 살펴보았다. 연구 결과의 시사점은 보행자우선도로의 디자인은 운전자가 보행자우선도로와 일반도로의 차이를 인지하는데 기여하지만, 세부 디자인 요소가 운전자의 순간적인 운전 행태에 영향을 줄만큼 인지되기는 어려운 것으로 나타났다. 본 연구의 결과는 향후 확대 시행될 보행자우선도로의 디자인 구성에 대한 다른 관점을 제시할 것으로 기대한다. Recent, statute and various projects for pedestrian right and pleasant walk environment are ongoing as a result. Especially, Seoul Metropolitan Government has implemented the pilot project of Pedestrian Priority Road to secure the pedestrian right on side roads of residential area since 2013, and more than 60 projects are completed currently as of 2017. The project seeks the inducement of speed reduction of vehicle as its major solution through visual design elements on the surface of side roads. Different design elements are used in the current projects, but its effects on the driver’s behavior haven’t been investigated on the basis of empirical research. This study examines how visual elements of design on pedestrian priority roads are recognized by the driver, and how these elements affect on the driving behavior. Consequentially, differentiation of design of the road is proved to contribute to the driver’s recognition between pedestrian priority roads and other normal roads, but the detailed design elements are difficult to recognize enough to affect the driver’s momentary driving behavior.
