        교섭단위 분리 제도의 법적 쟁점

        Trade Union and Labor Relations Adjustment Act designates one business or one place of business as a bargaining unit, and, in principle, the unit determines a representative bargaining trade union of their accord, referred to as procedures for simplification of bargaining windows. This unified trade union bargains and makes a collective agreement. However, Article 29.3.2 exceptionally allows a division of the bargaining units and to negotiate separately with each individual union. As it is a significant exception to the simplification of bargaining windows, it should be limited to conditions in which the enforcement of a statutory bargaining unit would make it difficult to expect a substantial collective autonomy. Labor Relations Commission(LRC) has a legal authority to decide a division of the bargaining units at its discretion, and the concerned parties can apply for review on its decision only when it is inconsistent with any Act or subordinate statue or ultra vires. Therefore, LRC should carefully decide whether to divide a bargaining unit, taking into consideration all reasonable grounds, and once it is determined, it needs to be fully respected. However, several recent cases interpreted the necessity to divide a bargaining unit in the narrow sense, so that judged LRC’s decision is inconsistent with the laws or ultra vires. In cases, there is a legitimate concern in their strict interpretation in allowing for the division of bargaining unit, which is an exception to the simplification of bargaining windows. However, in other aspect, it can excessively restrict the discretion of LRC to decide. Through clarifying factors and their contents in deciding the need for a division, the Act should present predictable criteria to the concerned parties, and impose judicial control over decisions of LRC, only which deviate from this requirement.

        Purpose: The most feared complication of gastrointestinal tract operations is anastomotic leakage, not only because of the presumed individual surgeon's culpability but also because of the assumption that this event is often fatal. We have experienced 32 cases of anastomotic leakage after elective gastric resection during 8 years. The purpose of this study was to evaluate the result of their treatment. Materials and Methods: We evaluated the records of 1335 patients who had undergone elective gastric resection for an adenocarcinoma of stomach from January 1995 to October 2003 and conducted a retrospective, multivariate analysis. Results: Of the 1335 patients, 32 ($2.4\%$) sustained an anastomotic leakage. Anastomotic leakages usually developed on mean postoperative day $9.1\pm3.2$ (range:$1\∼18$ days).Overall, $31.3\%$ (10/32) of patients who sustained an anastomotic leakage died. The anastomotic leakages were identifed by radiological study or by operative finding at the site of the duodenal stump (20 patients), the esophagojejunostomy (7), the gastroduodenostomy (4), and the gastrojejunostomy (1). Fourteen patients ($43.8\%$) underwent a relaparotomy, a drainage procedure in the main, and 18 patients ($56.3\%$) were treated conservatively. The mortality rates were $42.9\%$ (6/14) and $22.2\%$ (4/18), respectively, but this difference was not statistically significant. A cox's proportional hazard analysis showed that a body-mass Index < 24 kg/m2 (odds ratio 5.55, $95\%$ CI: $0.69\∼44.82$) and non-enteral feeding (odds ratio 18.27, $95\%$ CI 2.22.150.69) were independent factors of mortality due to anastomotic leakage. Conclusion: Our observations show that anastomotic leakage after an elective gastric resection has a high risk of being fatal. Moreover, for a patient with a body-mass index lower than $24\;kg/m^{2}$ and/or non-enteral feeding, an anastomotic leakage after an elective gastric resection has a higher risk of being fatal.

        In this paper, electrical simulations of electric shock accidents at voltages of 220V have been carried out using an Andred s body model underwater. First, we construct a circuit fitting Andred s body model. Then, we compare voltage measurementsat a hand, breast, and the waist, and current measurementsat the same locations, with safety limits of electric current flowing through a body. We conclude from our results that the magnitude and wave of an electric currentpassing through a body mimics the effect ofa heart control signal. It also hasa direct impact on the ventricle of the heart in detailed motion. The simulations have been performed with the ATP-Draw program. Furthermore, this study finds safety issues for an electric angle limit when taking measurements of a flooded body resistance, and the voltage and current passing through each part.

        수중인체모델의 충전전원설비 촉수시 전기적 특성에 관한 연구

        In this study, the electrical simulation of electric shock accidents at a voltage of 220 V was investigated using Andrew s body model in water. The constructed circuit consisted of Andrew s body model. The voltages measured on a hand, breast, waist, were compared with the electric currents measured on the hand, breast, and waist considering the safety limit of an electric current passing through the body. From the results, it can be understood that the magnitude and wave of electric current passing through the body affect the heart s control of a signal, which directly affects the ventricle of the heart in detail. It comes from the simulation through the ATP -Draw program. This study could be useful in solving safety issues for the electric angle limit by measuring flooding body resistance, as well as the voltage and current passing through each part.
