학교폭력법에 의한 징계절차에 관한 연구 -가해학생에 대한 교육적 접근을 중심으로-

「학교폭력 예방 및 대책에 관한 법률」(이하에서는 ``학교폭력법``이라고 한다)이 2004년 제정·시행된 이후 크고 작은 개정이 있었지만, 교육현장에서는 여전히 학교폭력법이 학교폭력을 예방하거나, 학교폭력이 발생하였을 때 교육적으로 대처할 수 있는 적절한 법률인지에 대해 많은 의문을 제기하고 있다. 학교폭력은 가해학생과 피해학생 모두에게 돌이킬 수 없는 정신적·육체적 상처를 남겨 개인의 삶과 학교공동체의 건전한 발전을 파괴하는 반사회적 범죄이다. 그럼에도 불구하고 이 연구에서 학교폭력 사건의 가해학생에 대한 조사와 징계 절차에서 인권과 적정절차를 기본으로 한 교육적인 고려를 주장하고 있다. 이는 학교폭력의 가해자라고는 하지만 아직은 교육을 받고 있는 미성년자이고, 다른 관점에서 보면 여전히 보호 받아야 하는 학생이기 때문이다. 학교폭력 법이나 초·중등교육법은 학생을 징계할 때에는 가해학생이나 그 보호자에게 진술할 수 있는 기회를 주도록 규정하고 있을 뿐, 어떠한 절차에 따라 어떻게 진술하여야 하는가에 대한 구체적인 절차와 방법에 대한 규정이 없다. 따라서 이 글에서는 징계절차에서 가해학생이 자신의 입장을 충분히 변명할 수 있도록 하는 교육적 입장에서 그 구체적인 절차에 대해 대안을 제시하고자 하였다. 그리고 비록 가해학생이지만 인격을 고려한 적절한 조사와 징계가 이루어 졌을 때에 비로소 자신의 행위에 대한 반성과 함께 피해학생에게 용서를 구할 수 있을 것이라고 생각한다. 학교는 교육의 장이다. 학생징계절차의 민주화와 투명성 보장은 무엇보다 올바른 교육과 교육제도의 수립으로 이루어져야 한다. School is a place of education. First and foremost the democratization and the guaranty of transparency in student disciplinary process should be based on the establishment of correct education and education system.

복합운동이 비만 중년여성의 신체조성, 혈중 지질변인 및 HOMA-IR과 HOMA β-cell에 미치는 효과

This study aimed to analyze the effects of combined exercise on body composition, blood lipid profile, HOMA-IR and HOMA β-cell in obese middle-aged women. A total of 40 female subjects were participated in this study, and they were randomly divided into 2 groups such as control group(n=20) and combined exercise group(n=20). With respect to body composition, combined exercise group indicated the significant reduction effect in weight, body mass index(BMI), body fat and percent body fat values after combined exercise program(p<.05). Also, this group showed the significant increase in blood HDL-cholesterol level as well as the significant reduction in blood triglyceride(TG) level and blood LDL-cholesterol level after combined exercise program, suggesting the beneficial blood lipid profile(p<.05). In the case of blood glucose metabolism, the combined exercise group showed the slight reduction in blood insulin level and HOMA-IR as well as the significant reduction in blood glucose level after combined exercise program(p<.05). There were no significant increase in HOMA β-cell of combined exercise group after combined exercise program. In conclusion, data from this study suggest that combined exercise program may indicate useful effect on body composition, blood lipid profile and blood glucose metabolism of middle-aged women.
