On May 15, 2004, the Constitutional Court ruled that while President Roh Moo-hyun had violated election laws, that was insufficient ground for his impeachment. The court said that Mr. Roh had violated Article 9 of the Act on the Election of Public Officials and the Prevention of Election Malpractices on two occasions in February 2004. The article compels both elected and career government employees to maintain political neutrality. The Constitutional Court decided that the president had violated Articles 66 and 69 of the Constitution by expressing regret over the National Election Commission's warning to him. The two articles stipulate that a president should abide by and uphold the Constitution. The Court said the third violation was Mr. Roh's Oct. 13 proposal for a national referendum on his presidency, interpreting Article 72 of the Constitution as stipulating that a national referendum can be held only on important policy issues involving foreign affairs, defense and reunification. The court dismissed two other charges: implication of Mr. Roh's aides in corruption cases, and economic mismanagement. I think that the Court's ruling does not have persuasive argument in that following points of view. First, is the president a civil servant who falls into the category of civil servants-who need to be politically neutral as defined in the act? The president is the head of the executive branch and hence bears the responsibility of stable policy fulfillment. In order to execute this kind of responsibility, the president, as a political civil servant, needs the support of legislative majority. Hence the president can give his support to a specific political party and ask for support from the people to get legislative majority by expressing his political opinion. Second, the Constitutional Court sentenced that the president's reaction to the National Election Commission ruling on the violation of election laws was not in line with his duty to abide by the Constitution and election law. But even if his remark was intended to express his discontent over the National Election Commission ruling, it is just expression of his political opinion on the possibility of new interpretation of election laws and on the direction of an amendment of current laws. Thus his remark is neither against the principles of law-governed country nor a violation of his duty to protect the Constitution. Third, article 72 of the Constitution states, “The president can put issues related to national security such as diplomatic, defense and unification issues to a national referendum if necessary.” A national referendum applies to making decisions on specific national policies. Thus, a national referendum for confidence vote cannot be regarded as issues related to national security. It means that the president is not endowed with exercising the power to call a national referendum for confidence vote. But the president only suggested a national referendum and did not enforce it. Making the suggestion itself is not against the Constitution until making an announcement of a national referendum for confidence vote and of the date of a national referendum.

Acute hydrops of the gallbladder has been reported in Kawasaki disease as a major component of abdominal crises. Certain abdominal symptoms and signs such as abdominal pain, vomiting, diarrhea and abnormal liver function test were correlated with the development of hydrops. Ultrasonography provides a simple, rapid and noninvasive prccedure, which is helpful for the evaluation and diagnosis of gallbladder disease and other abdominal organic abnormality. Abdominal ultrasonography were done on 51 cases of Kawaski disease which were admitted to Pediatric department of Dong San hospital, Keimyung University, during the period of four years and three months from March 1983 through June 1987 and observed the abnormal findings. Out of 51 tested cases, abnormal ultrasonographic findings were observed on 10 cases(19.6%), showing gallbladder distention in 8 cases(15.6%), gallbladder hydrops in 1 case(2.0%) and splenomegaly in 1 case(2.0%) Gastrointestinal symptoms such as abdominal pain, vomiting and diarrhea were noted in 5 abnormal ultrasonographic cases(50%). Authors suggest that abdominal ultrasonography is necessary for those Kawasaki disease patients who complained of gastrointestinal symptoms.

체육철학 : 기독교적 인간 이해의 관점에서 본 인간 복제의 문제점과 그것이 체육 · 스포츠에 주는 영향

이 연구는 성경을 중심으로 기독교적 인간 이해의 관점에서 본 인간 복제의 문제점과 체육·스포츠에 초점을 맞추어 고찰한 결과 다음과 같은 결론을 얻었다.□□□(네페쉬)는 곧 인간이며 인간이 □□□다. 그리고 □□□는 파괴될 수 없는 영적 실체일 뿐만 아니라 욕구를 느끼는 구체적인 육체적인 삶이라는 의미에서 살아있는 인간인 동시에 신체인 것이다. 이 인간은 하나님의 형상으로 왕 같은 최고의 존재로 창조되었다.인간이 복제됨으로써 나타나게 될 문제점들은 다음과 같다.첫째, 하나님의 창조 질서를 파괴함으로써 육체적 삶의 질서 즉, 신체 문화를 파괴하게 된다. 그리고 인간 존재에 관한 이원론적 사상은 신체를 경시하는 결과를 초래하게 하여 체육·스포츠의 발전에 악영향을 미치게 할 뿐 아니라 사회 질서를 와해시킬 수 있는 위험한 사상이다.둘째, 인간의 가장 근본적인 상호의존성이 파괴될 것이다. 그 결과 스포츠에서의 페어 플레이, 규칙 존중, 인격적 교제 그리고 예의 등이 사라짐으로써 체육·스포츠 윤리 교육의 목적을 달성할 수 없을 것이다.셋째, 하나님의 영광을 위한 인간 즉, 신체는 스포츠 활동을 비롯한 각종 신체 활동에서 최선을 다하도록 창조된 존재이다. 체육·스포츠의 궁극적인 목적은 승리가 아니라 최선의 노력을 다함으로써 행복을 찾는데 있다. 그런데 우생학적으로 가장 탁월한 사람을 대량 복제하여 상품화함으로써 승리만을 추구하는 인간이 우선시 될 것이다. 그리고 하나님의 형상 즉, 왕 같은 존재인 인간을 상품으로 취급함으로써 인간을 경시하는 사회 풍토를 조성하게 될 것이다. 또한 체육·스포츠의 질서를 파괴함으로써 진정한 스포츠가 지닌 아름다움이 상실 될 것이다.체육학은 하나님의 형상대로 창조된 왕 같은 존재인 인간 즉, 신체를 근본으로 하는 학문이기에, 신체를 가장 존귀한 것으로 여기는 학문으로 계속 남기 위해서는 인간 복제와 관련된 모든 행위들은 금지되어야 할 것으로 사료된다. This study focused on the problems of human cloning in the sights of christian understanding about human being and physical education ·sports. The following is the result we have achieved.□□□ is a human being and a human being is □□□. □□□ is a undestructible spiritual being and also a giving being and a body as well in terms of specific physical life which has a desire. This human being is the most valuable being crested in God’s own image, the best creature like a king.The problems of human cloning are as follows.1. It destroys God’s creation order and the order of physical life, that is, physical culture. The dualistic idea about a human being brings upon the contempt of a human body and as a result, has an evil influence on the development of physical education ·sports and social order as well.2. It destroys mutual dependence among men, the most fundamental principle of human lives. That makes fair play, respect of rules, personality, and politeness in sports disappear and the ethical goals of physical education and sports cannot be achieved.3. A human being for the glory of God, that is, a body was created to do his best in every physical activity including sports. What matters in sports is not victory but happiness of doing his best. Cloning of the best man in terms of eugenics give a preference to a man who pursues victory itself. It, by treating a human being in God’s image, the best creature like a king as goods, produces a trend to make light of a human being. It causes the true beauty of sports to disappear by destroying the orders of physical education·sports.Physical education is a study which is based on a human being created in God’s own image. In order to remain as a valuable study which treats a body as a the most valuable being crowned with glory and honor, all sorts of actions concerned with human cloning should be prohibited.
