保險利益是近代保險法發展以來最突出的成就, 保險利益在控制保險合同效力方面起著不可忽視的作用, 但是對保險利益的擴張亦會帶來壹些困境。由於認定保險利益在實踐中有較大的困難, 在認定程序上多采用事後反推的方法, 卽非賭博、非不當得利就有保險利益。承認股東對公司財産的保險利益有壹定的合理性, 但這不幷意味著股東對保險金擁有確定的保持力。若因此造成了公司與股東之間的利益失衡, 在請求權基礎上通盤考慮, 可以從不當得利出發來調整利益失衡;若從立法論出發, 應修訂≪保險法≫第四十八條, 矯正該利益失衡。 The theory of insurable interest is the most prominent achievement in the development of modern insurance law. The theory of insurable interest incredibly contributes to controlling the validity of insurance contract. However, the expansion of it haunts the court and scholars. In light of the difficulty of recognition of insurable interest, judicial practice admits it in cases with hindsight; namely, there is insurable interest when no gamble or unjust enrichment. It is reasonable to admits the shareholder’s insurable interest of the corporation property, but it does not mean that shareholder could certainly retain the related insurance money. The corporation shall be compensated by the claim of unjust enrichment,or the modified Article 48 of Insurance Law, if that shareholder holding insurance money sacrifices the corporation interest.
Researches of Topologies and Dynamics of Molecular Agglomeration Network based on Complex Network

With appearance of small-world networks and scale-free networks, complex networks have provided natural theories to describe a variety of complex systems in many domains of science. In this paper, from the standpoint of Raman spectrum research aspect in material science, Raman spectrum analysis of graphite and diamond microcrystal retained by gallium phosphide nanoparticles is introduced. We found that molecular configuration of basic fuchsin adsorbed on gallium phosphide nanoparticles through experiments. Based on these, we adopt corresponding method of complex network to research some problems in Raman spectrum analysis and directly use complex network to convert real agglomerations into network model. With the intention of studying the topologies of agglomeration network, synchronizability behavior of agglomeration network are also discussed.

A new CDMA system which uses fractional chip shift expanded generalized complementary orthogonal code groups as spectrum spreading code sequences and offer high spectral efficiency is introduced in the paper. This new CDMA system is totally different with conventional CDMA system in access codes designing and spectrum spreading process. In this CDMA system, the access codes of different cells keep orthogonality, which eliminates inter cells interferences (ACI) by aperiodic cross-correlation function (CCF). The spreading process of new CDMA system introduces inter symbols interference like overlap time division multiplexing (OVTDM) deliberately so as to improve spectral efficiency. The construction of expanded generalized complementary orthogonal code groups, shift method, principle of new CDMA system are explained respectively. Analysis and simulation results verify the validity of this new CDMA system.
