      • 최근 살인 사건의 살해도구에 관한 연구 - 칼을 중심으로 -

        최근 살인사건의 실태를 보면 칼을 이용한 살인사건이 가장 많다. 살인을 음모하고 예견된 살인도 있지만, 순간적인 분노로 인한 우발적으로 저질러지기도 한다. 우발적인 범행에서 주변 가까이에 있는 가정용 칼을 범행에 사용하는 경우가 많지만 일상생활에서 칼의 위험성을 인식하는 경우가 드물다. 이에 전국에서 발생하는 살인사건의 범행방법 중 칼에 의한 범행에서 동기 분석과 함께 살해에 사용한 칼의 종류를 분석하였다. 그리고 칼에 대한 인식을 알아보고자 성인 남녀 500명을 대상으로 가정용 칼에 대한 21항목의 설문조사를 실시하였다. 그 결과를 일반 가정에서 사용하는 칼의 대부분이 칼끝이 날카로워 사실상 범행에 사용하기가 용이하였다. 그렇기 때문에 범인들이 칼을 휴대하기보다는 범행 장소에서 칼을 쉽게 구하여 범행에 사용하는 경우가 많다. 그리고 우발적인 살인의 경우에도 주방이나 식탁 또는 거실에서 칼을 쉽게 구할 수 있기 때문에 살인 사건이 더욱 빈발할 수 있다. 일반인의 칼에 대한 인식에서 칼의 위험도를 낮추기 위하여 칼끝을 둥글게 하자는 여론은 매우 높은 결과로 나타나지만 실제로 칼의 위험성에 대한 인식이 낮았다. 따라서 가정이나 가까운 사이에서 우발적 충동적인 살인을 예방하기 위하여 생활도구로 사용하는 칼도 위험한 물건으로 분류하여 인식전환과 함께 칼의 제작과 판매에 있어서 적절한 규제가 필요하다고 생각한다. 칼에 대한 인식을 새롭게 하여 가정에서 칼의 보관과 잠금장치의 필요성에 대한 홍보가 절실하다고 생각한다. I searched the recent murder cases for other criminal methods of homicides the monthly statistics of the local police agencies of the whole country, I found that there are many criminal cases where knives were used. Based on this finding, I decided to conduct my survey about kitchen knives. The statistics indicated more than five hundread male and female adults were reported to have committed murders. Of the 500 people, 21 used a kitchen knife to commit murder. This study showed that when people have a conflict, the kitchen knife is as a tool that can be easily changed into a weapon. If the points of the knife is round, more homicides could be avoided. If regulations were established, as we have with dagger when producing, selling or purchasing, I would assume that the number of the crimes with knives will be remarkably diminished. It is our responsibility to create a bill concerning regulatory standards in understanding the dangers of kitchen knives. We must immediately participate in active publicity campaigns.

      • 폭발사고시 효과적인 과학수사 방법에 관한 연구

        Accidents and terrorist acts that utilize explosives have a great influence on society and thus require a prompt investigation for the arrest of the culprit. However, such investigations are often met with difficulties due to the vastness of the crime scene, restrictions on approaching the scene, fragility of the evidence, complexity of investigation, and the lack of expertise. In spite of such facts, scientific investigation regarding explosives have not been widely studied in Korea. Therefore, the focus of this research primarily concerns the effective scientific investigation methods in cases of accidents that involve chemical explosives. Although the a systematic investigation method is at the heart of scientific investigation in cases of explosive accidents, it is only at its rudimentary stage. Therefore, in this research, a systematic investigation method is put forth for the 'scene investigation, the documentation of the scene, and the collection and processing of evidence. Further, I have set forth a 'scene investigation check list' the ensure a thorough scene investigation and to promote an exhaustive evidence collection that would guarantee the admissibility of such evidence in court. The above efforts were aimed at simplifying the currently complicated investigation system. 1) In the future, a guidebook that can be generally applied to accidents involving explosives in Korea ught to be produced, a continual systematic education and integrated training excises for investigators ought to be established, laws that require additives in explosives ought to be instituted so that the type, components, and source of explosives can be identified, and lastly, a database that contain information on former explosion accidents, trends, and techniques of criminal activities that involve explosion accidents should be compiled.

        비콘과 딥러닝 기술을 활용한 전자출입명부 자동등록시스템

        In order to prevent the national wide spread of the COVID-19 virus, the government enforces to use an electronic access registration system for public facilities to effectively track and manage the spread. Initially, there was a lot of hassle to write a directory, but recently a system for creating an electronic access list using QR codes, what is called KI-Pass, is mainly used. However, the procedure for generating a QR code is somewhat cumbersome. In this paper, we propose a new electronic access registration system that does not require QR code. This system effectively controls the suspicious visitor by using a mask wearing discriminator which has been implemented using deep learning technology, and a non-contact thermometer package. In addition, by linking the beacon, a short-range wireless communication technology, and the visitor's smartphone application, basic information of the facility visitor is automatically registered to KDCA through the server. On the other hand, the user access information registered in the server is encrypted and stored, and is automatically destroyed after up to 4 weeks. This system is expected to be very effective in preventing the spread of other new infectious diseases as well as responding to the coronavirus which is recording a high spread worldwide. 전 세계적으로 감염이 확산되고 있는 코로나19 바이러스의 확산 방지 및 효과적인 추적 관리를 위해 정부에서는 공공시설에 대한 전자출입명부 시스템 도입을 의무화하고 있다. 초기에는 수기로 명부를 작성하는 불편함이 컸으나, 최근에는 QR 코드를 활용한 전자출입명부 작성 시스템이 주로 사용되고 있다. 하지만, QR 코드 생성을 위한 절차가 다소 번거로운 측면이 있다. 본 논문에서는 QR 코드 생성이 불필요한 새로운 방식의 전자출입명부 작성 시스템을 제안한다. 제안된 시스템에서는 딥러닝 기술로 구현된 마스크 착용 판별기와 비접촉 온도계를 활용하여 감염 의심방문자를 효과적으로 통제한다. 또한 근거리 무선통신 기술인 비콘과 방문자의 스마트폰 앱을 연동하여 시설 출입자의 기본 정보를 서버를 통해 질병관리청에 자동 등록되도록 한다. 한편, 개인정보 보호를 위해 서버에 등록된 방문자출입 정보는 암호화되어 보관되며, 최대 4주 후 자동 폐기된다. 제안된 시스템은 전 세계적으로 높은 확산세를 기록하고 있는 코로나 바이러스에 대한 대응은 물론 기타 신종감염병 확산 방지 및 대응에도 매우 효과적으로 활용될 수있을 것으로 기대된다.

        The reform necessity of medicolegal death investigation system is continuously issued. The problems from the current death investigation system are discussed, specially on the professionalism of the involved personnel such as policemen, doctors, prosecutors. Death investigation exists not only to prosecute the criminals but also primarily to protect the general public's health, safety, and welfare. The reform proposals of death investigation system are followed as below. Statutes require that the prosecutor be notified of certain deaths. All deaths that may reasonably result from anything other than natural disease should be investigated. A death certificate is a legal document which authenticate a death, therefore it is issued by the doctor. The postmortem examination must be rearranged on the university base and performed by the qualified doctors who are trained at least in pathology. The police officer specified in death investigation and forensic identification should be encouraged to keep doing their special work in many ways.

      • 화재조사 실태 분석과 개선방안에 관한 연구

        The purposes of fire investigation are to identify and analyze the causes of fire and, using the results in promoting fire fighting policies, ultimately to prevent fires caused by similar causes and to protect people's life and properties from fire. However, although the patterns of fire are getting more diverse and complicated with the rapid development of industry, complicated with the rapid development of industry, fire fighting organizations are continuing traditional superficial fire investigation without operating a fire investigation department for the reason of insufficient manpower, equipment and budget, losing public confidence. Thus, the present study purposed to propose plans to improve the technicality of fire investigation and win public confidence in fire investigation. First, the technicality of fire investigation should be improved by operating a department and personnel exclusively for fire investigation. Second, fire investigation should be more scientific and precise using high tech fire investigation equipment. Lastly, responsible fire fighting administration should be realized through statistical analysis of the causes of fire and computerization. The results of this study are expected to contribute to the safety and security of our society.

      • 반(反)성폭력 관점에서 본 친고죄

        The definition of Crime Indictable Upon Complaint (CIC) is crimes which can be prosecuted only with complaints from the victim or his/her direct parents. Sex crimes are the representative examples, rapes and indecent assaults. According to the research referenced in this paper, 74% of sex crimes which had been penalized based on Republic of Korea (ROK) Criminal Code amounts rape and indecent assault are CIC. However, only 20% of perpetrators were confined, and the rest received non-confinement or non-prosecution determination. The review of criminal history checks reveals that 67% of the perpetrators had criminal histories and 39% of them had more than three documented offenses. The CIC was established in order to protect the victim's rights and dignity, respecting the victim's opinion regarding the incident. All kinds of sex crimes then should have been the CIC, but those crimes such as Injury Resulting from Rape, Special Rape, Rape by Special Modus Operandi, Sexual Assault among Relatives and Domestic Violence which have to guarantee the opinion of the victims are prescribed as non-CIC. We therefore conclude that the CIC should be abolished. The abolition of CIC will play an important role in crime prevention because severe penalties for sex crimes will be imposed on the perpetrators. In addition, it will help the sex crime victims retrieve their dignity by spreading recognition widely through the community that sexual assault is not only a social assault but an infringement against human rights.

      • 우리나라 해상에서 발생한 사망사고 유형에 관한 연구

        The nature of deaths occurred at sea may be revealed the differences from that in the land, but there is no comprehensive statistical analysis of deaths occurred at Korean Sea so far. Therefore, the cases of deaths or missing in the period 1993 - 2006 were analyzed by the cause, place of death, and results of preliminary investigation. In the period from 1993 to 2006, over 1000 peoples were died or missing every year. The cases of marine safety accidents including self-carelessness and mishap were approached over 60% and cases of homicide were less than 1%. The closure cases of preliminary investigation were reached over 70% and the most of deaths occurred in fishing vessels (the range of 20 ~ 99 tonnage). The suspension cases of preliminary investigation were reached to 70% of all missing and drowning cases. The results showed that the most of deaths occurred at sea could be prevented by the safety regulations including mandatory report of accidents, marine safety education and training, punishment the people responsible for the accidents. For the unidentified bodies, data should be collected and recorded for the future identification. The crime scene investigators should be trained to ensure the quality of their professional skills regularly.
