        운송인과 복합운송인의 책임에 대한 우리 상법과 국제협약상의 비교 및 개선방법

        오늘날의 국제화물운송서비스는 각 운송인들이 협력하는 복합운송을 통해 누가 더 빠르고 안전하게 수하인에게 화물을 운송하는가 라는 것이 중요한 이슈가 되었다. 우리나라는 해상운송과 항공운송에 관해서 헤이그-비스비협약과 몬트리올협약을 차용하여 이들과 유사한 국내법(상법)을 규정하였다. 본 논문에서는 우리 상법 뿐만 아니라 2019년 개정된 일본 해상법과 국제조약들을 연구한다. 특히 책임의 원칙과 개별적 책임제한 제도, 연착에 대한 배상책임의 비교, 운송인 책임감면 특약의 허용 여부, 책임의 소멸시효, 히말라야약관의 적용 여부를 조사하고 각 운송인들의 책임제도의 개선방안을 강구한다. 복합운송인의 책임을 규정한 유일한 상법 제816조에 대해서 살펴본다. 현행 법규가 해상운송을 중심으로 규정되어 육상·해상·항공운송을 포함하는 복합운송에서 발생하는 모든 법률문제에 적용할 수 없으므로 복합운송에 관한 입법이 필요하다. 새로운 복합운송의 법률개정안에는 복합운송계약에 관한 정의와 각 운송인들의 책임체계가 규정되어야 함을 제안한다. Today’s International freight transportation services have become an important issue for whom to transport cargo to consignee faster and safer through multimodal transportation in which carriers of each stages cooperate. In the areas of Maritime and Air transportation, Korea applies domestic law (Korean Commercial Code) that most closely resembles the Hague-Visby Convention and Montreal Convention. In this paper, I research not only Korean Commercial Code but also 2019 revised Japanese Maritime Law and International Conventions. Especially, we review the principles of responsibility, the limitation of liability, comparative study of compensation for delays, reduction of liability for carrier, statute of limitation, application of Himalaya Clause, Article 816 of Korean Commercial Code which is Responsibility of consolidated Carriers, and seek to find the improvement methods for each carrier’s responsibility systems. Regarding the liability of multimodal transport operator, Article 816 of the Commercial Code is only one relevant article in Korea. However, since the said article’s primary concern is with maritime transportation, it is inappropriate to govern for all the legal matters and cases as to land, maritime and air transportation. As such, the legislation needs on multimodal transportation is inevitable. I suggest that legislation should stipulate at least the definition and limitation of liability system on multimodal transportation.

      • 경쟁 분광 분석법에 의한 Aminopeptidase M 기질의 속도상수 결정

        Aminopeptidase M(Am M ; EC 3.4.11.2) is an exopeptidase hydrolyging the peptide bond adjacent to a free amino group. Am M is called differently by its origins, namely, microsomal alanine aminopeptidase M, aminopeptidase N and peptidase E. Kinetic studies were peformed on di-, tripeptides using aminopeptidase M (Am M) derived in porcine kidney by competitive spectrophotometric method. The equation for the progress cuwe was obtained, which characterige the kinetic behavior of the engyme acting simultaneously on two alternative substrates. By the addition of a competition term to the integrated Michaelis-Menten equation, the kinetic constants of an alternative substrate can be evaluated by measuring the competition with a substrate of known kinetic constants in single experiment. The competitive equations, Bo/vo[1- (So-y/So)"]= △t and n=Ka X vb/kb X va, were used for determining the kinetic constants an peptide substrates. Of the 4 di- and tripeptides tested, Leu-Leu-Leu(Km= 0.19mM) had the highest affnity for Am M, followed by Ala-Ala-Ala(Km=0.76mM). In contrast, Ala-Ala(Vmax= 4.O㎛mol.sec) had the highest maximal velocity of hydrolysis.

      • Saccharomyces cerevisiae 펩티드 페로몬의 [Trp^1,3] 아마이드 유사체 합성

        Amide analogs of sex pheromone of yeast Saccharomyces cerevisiae, a-factor, L Trp-His-LTrp-Leu-Gln-Leu-Lys-Pro-Gly-Gln-Pro-Met-Tyr, were synthesized by solid phase method using Knorr amide resin : [D TrP1,D TrP3] α-factor amide, [D Trp3] α-factor amide. The elongation of amide analogs on resin was accomplished with 9-fluorenylmethoxycarbonyl (Fmoc) amino acids which were esterified with pentafluorophenyl groups. 1-hydroxybenzotriazole( HOBT) was used for every coupling steps as racemization suppressor. The reaction completeness was confirmed by Kaiser test. The synthesized peptides were purified by HPLC with Vydac Cl8 preparative column. The final products were found to be homogeneous (>96% ) by HPLC and yielded correct amino acid ratios.
