        민간조사업법 제정방향

        민간 조사업의 주체는 공익성의 확보라는 면에서 법인으로 해야 할 것이며 사업주에게는 허가제로 시행해야 한다. 민간조사업의 감독기관은 유럽, 일본 등 다수의 국가들이 경찰기관이 감독기관인 점과 경비업의 감독기관이 경찰청에서 수행하듯이 민간조사업도 감독기관은 경찰이 되어야 한다. 민간조사업이 개인의 정보를 취급하는 경우가 많으므로 별칙에 있어 개인정보의 관리를 명확히 하여 고객의 기본권 침해를 방지해야 한다. 또한 계약 시, 계약 후, 계약변경 하는 경우에 고객에게 해당내용을 서면으로 즉시 교부하는 등에 대한 고객의 의무사항을 강화해야 한다. The primary agent of civil investigation businesses must be a corporation to line up with public interests, and the government has to carry out the permit system on business owners. As many countries such as those of European and Japan supervise civil investigation business and the police agent supervises guarding businesses, so the police also has to supervise civil investigation business. In many cases, civil investigation businesses deal with private information, and the police has to prevent from infringing customers' basic right by clarifying private information management for punishment. In addition the police has to tighten up customers' obligations. For example the police has to deliver papers about the contents when they enter into or change contract, or after they enter into contract.

        온라인 민간경비 교육훈련의 현황 및 개선방안:

        2015년부터 도입된 온라인 민간경비 직무교육은 온라인 교육이 가지고 있는 특징인 교육의 편리성, 관리의 용이성 등의 장점으로 인하여 온라인 직무교육에 참가하는 경비원은 급격하게 증가하고 있다. 그러나 2016년 경찰청장의 감독명령에 의해 검정되지 않은 다수의 온라인교육기관이 참여함에 따라 직무교육의 문제점이 발생하고 있다. 따라서 본 연구에서는 현재의 온라인 민간경비 직무교육 현황을 살펴보고 개선방안을 제시하고자 하였다. 현재의 온라인 직무교육의 문제점으로는 첫째, 질적인 수준이 담보되지 않은 온라인 교육기관이 직무교육을 수행하여 직무교육의 효과성을 떨어뜨리고 있다. 둘째, 교육학습에 있어서 기술적 지원체계의 미흡으로 원활한 교육진행의 어렵다는 점이다. 이러한 교육현황은 기존의 집체교육의 문제점을 개선하고자 도입한 온라인 교육방법의 장점을 제대로 살리지 못하고 있다. 따라서 직무교육의 품질을 개선하고 직무교육의 효과성을 향상시키기 위하여 교육기관에 대한 일정한 규제가 필 요하다. 이에 대한 개선방안으로 첫째, 현재의 신임교육기관 선정과 유사하게 일정한 수준(교육과정, 전문가 보유, 모바일 교육지원 체제 등)을 유지하고 있는 교육기관을 평가하여 감독기관인 경찰청이 지정하여 관리함으로써 일정한 교육의 품질을 유지시키도록 하는 방안, 둘째, 온라인 민간경비 직무교육을 감독하는 경찰청의 관련 부서에서 검증위원회를 설치하여 위원회에서 일정한 수준의 교육기관을 검증하여 허용하는 방안 등을 제시하고자 한다. The on-line security training system has been introduced since 2015, and the number of security guards participating in on-line job training is rapidly due to the convenience of education and the ease of management. However, due to the fact that many non-certified on-line education institutions participated in the supervision order of the police chief in 2016, there is a problem in terms of quality of job education. Therefore, in this study, the current status of on-line private security professional education is suggested and suggested improvement plan. The present problems of on-line job education are as follows: First, online education institutions that are not guaranteed qualitative level are dropping the effectiveness of job education by carrying out job education. Second, it is difficult to proceed with smooth education due to lack of technical support system in educational learning. The current status of education does not fully utilize the advantages of the on-line education method introduced to improve the problems of the conventional education. Therefore, some regulations on educational institutions are needed to improve the quality of job education and to improve the effectiveness of job education. First, it evaluates educational institutions that maintain a certain level (curriculum, specialist holding, mobile education support system, etc.) similar to the current selection of the new educational institution, Second, the relevant department of the NPA, which oversees online private security job training, will set up a verification committee to propose ways for the committee to verify and allow a certain level of educational institutions.

        탐정제도 도입에 관한 연구 : 21대 국회 .탐정업 관리에 관한 법률안’을 중심으로

        본 연구에서는 탐정업 도입 법안 제정 시 쟁점이 될 수 있는 등록과 사생활침해 방지 두 가지 사안에 대하여 사회적 규제와 경제적 규제관점에서 21대 국회에서 발의 중인 ‘탐정업 관리에 관한 법률안’(이명수 의원 안)과 ‘탐정업의 관리에 관한 법률안’(윤재옥 의원 안)을 비교하고 개선방안을 제시하고자 하였다. 첫째, 일정한 질적인 수준을 요구하는 경제적 규제관점에서 탐정업은 등록제로 운영되어야 한다. 등록과 관련한 조항으로서는 결격사유, 시험제도, 자격관리에 대한 조항을 구체적으로 제시하여야 한다. 또한 정부의 개입을 최소화하고 시장의 자율성을 확대한다는 측면에서 시험관리는 공인된 협회 또는 민간단체에게 자격시험에 관한 사항을 위탁하고 감독은 주무부서가 관리하여 작은정부 및 민영화를 반영하고 있는 ‘이명수 의원 안’으로 하는 것이 적절하다. 사생활 침해 방지와 관련한 손해배상의 책임과 보험가입에 대한 규정 두 의원 안에 차이가 없음으로 어느 안을 선택해도 될 것이다. 둘째, 사회적 규제 관점에서 현재의 개별법령으로 규제를 하고 비밀준수 등과 관련한 조항은 사생활 침해와 밀접한 관계를 가짐으로 법령 내에서 구체적으로 규제할 필요가 있다(‘이명수 의원 안’이 적합하다). 또한 드론의 불법촬영 등에 있어서는 개별법률이 반영되지 않은 점을 고려하여 이 부분에 대한 구체적인 벌칙조항을 법률 내에 신설하여야 하며, 이와 더불어 탐정업을 영위하면서 자주 위반할 수 있는 법령인 ‘위치정보의 보호 및 이용에 관한 법률 ‘개인정보보호법’, ‘통신비밀보호법’ 등과 관련해서는 상기법률을 3회 이상 위반하는 경우에 등록취소 또는 영업정지 등의 처벌규정을 첨부하여 사생활 침해를 방지해야 할 것이다. This study compared the Private Investigator Management Act (Lee Myung-soo s bill) and Private Investigator Management Act (Yoon Jae-ok s bill) proposed by the 21st National Assembly on two issues that could be controversial when enacting the detective industry. First, from an economic regulatory point of view that requires a certain qualitative level, the Private Investigator industry should be operated on a registration system. As provisions related to registration, specific provisions for disqualification, examination system, and qualification management should be presented. In addition, in terms of minimizing government intervention and expanding market autonomy, it is appropriate to entrust the management of qualification tests to authorized associations or private organizations, and supervise them as Lee Myung-soo, which reflects small government and privatization. Either plan may be selected as there is no difference between the two lawmakers liability for damages related to the prevention of privacy infringement and the regulations on insurance coverage. Second, from the perspective of social regulation, it is necessary to regulate it specifically within the law because it is regulated by the current individual laws and provisions related to confidentiality are closely related to privacy violations. Considering that illegal filming of drones does not reflect individual laws, specific penalties should be newly established within the law, and privacy violations should be prevented by violating the Location Information Protection Act and Communication Secret Protection Act three or more times.

        지역사회 범죄예방활동의 활성화에 관한 연구 -지방자치단체를 중심으로-

        Local government have to develop and perform the policies on crimes and fears influencing greatly on the quality of living. Today, security matters getting worse and worse demand collaboration among many entities such as Local government, citizens, businesses, and public organizations which may have an influence on police as well as circumstances surrounding regions. Local government, rather than any other entities, have a great role in establishing security policy. Local government can enact ordinances and establish and support the policies about security by using self-governing legislation rights, contents of self-governing rights. On the basis of this thesis, concrete security policies are as followings. First, to install street lighting. Local government must make an effort to install, maintain, and manage street lights to decrease crimes and fears of communities. Second, to install CCTV in vulnerable areas. Discussions on the effect of crime decrease are going on, but it is clear that crimes and fears can be decreased. Senseless installment will lead to loading governments with maintaining and management excessively, so prudent installment is necessary after examining effectiveness. Regional traits, demographic characteristics, and suitability of location have to be considered at the time of installment of CCTV. So Local government have to let expert groups perform pre-assessment. Third, to support voluntary Citizen Patrol activities. Local government have to activate citizens` participation in guard activities. The most general participation of inhabitants is voluntary Citizen Patrol activities. Voluntary Citizen Patrol activities are helpful not only to prevention and check of crimes actually but also banding inhabitants and strengthening trust. Local government have to exempt from voluntary guard corps` civil defense duties positively, give commendation for excellent cases(self-governing bodies), join injury insurance for their safe activities, and offer their education sites and patrol devices. Fourth, to improve community circumstances(disorders). Local government have to let inhabitants participate in improving physical circumstances and surroundings of the regions which are necessary for inhabitants, but neglected. In addition Local government have to improve community recognition and various businesses and systems. Local government can not get maximum effectiveness by enforcing the security policies respectively, but by enforcing the securities together with voluntary guard activities, street lighting improvement, regional circumstance improvement businesses(improvement of non-order situation), and CCTV. In addition, Local government have to make an effort for regional safety with concernments on safety policy continuously.

        지방자치단체의 재정위기 현황과 대응방안

        한국에서 지방자치단체들은 중앙정부의 지원을 통해 부족한 재원을 조달할 수 있었기 때문에 재정위기를 경험한 지방자치단체는 없었다. 그러나 현재에 나타나는 지방세입, 지방채 , 사회복지비의 지출, 지방채무 현황 등을 살펴볼 때 경제가 어려워 질 경우 재정여건이 더욱 악화되면서 재정위기를 겪게 되는 지방자치단체가 발생할 가능성은 있다. 따라서 이러한 지방자치단체의 재정위기를 예방하기 위해서는 지방재정위기에 대한 대응방안을 구축해야 한다. 첫째, 지방세입 구조의 개선이 필요하다. 현재의 지방세입 구조를 개편하여 지방세의 수입을 증가할 수 있는 세입항목으로 변경하고 세외수입을 확보할 수 있도록 하여 자체재원의 비중을 높이는 구조로 변경해야 한다. 둘째, 지방과 중앙정부간 재정부담의 구체화가 필요하다. 즉 지방과 중앙정부 간 재정부담을 구체화하기 위한 세출사무 조정이 필요하다. 셋째, 지방채의 발행 시에 주민투표를 통하여 승인을 얻도록 하는 방안이다. 지방재정에 대한 책임성을 확보하고 자율성을 강화하기 위하여 지방채를 발행 시 주민투표를 통하여 승인을 얻게 해야 한다. 넷째, 한국에 재정위기관리제도를 도입해야 한다. 재정위기관리제도로는 재정위기관리시스템의 구축과 재정파산제도의 도입이다. No local government ever experienced fiscal crisis so many times, for the they could procure insufficient sources through the central government. But, local tax revenue, local bonds, expenditure in social welfare expense, and local debts considered on, it is possible for some local governments to go through a fiscal crisis due to worse finance, if economy gets worse. So, it is necessary to construct a response strategy to local fiscal crisis in order to prevent from the local governments’ fiscal crisis. First, it is necessary to improve the structure of local tax revenues. The organization concerned has to modify the current local revenue structure, laying an emphasis on revenue items, to increase local tax incomes and secure extra-tax earnings as well as to modify into the structure enhancing self-financial resources. Second, it is necessary to give body to financial burden between the local government and the central government. The organization concerned has to arbitrate expenditure affairs to concrete financial loads between regions and central governments. The organizations concerned has to get inhabitants’ approval through a referendum when they issue municipal bonds to secure liability and enhance. Third, the local government has to issue local bonds through civil votes. Fourth, Korea has to introduce the institution of fiscal crisis management. The institutions of managing financial crises are constructing financial crisis management system and introducing financial bankruptcy.

        지역의 시설환경과 강력범죄발생의 관계에 대한 탐색적 연구

        This study, on the basis of official governmental statistic method, aims at selecting high-rate violent crime generating city and low-rate violent crime generating city, at analyzing the effect on violent crime generation of facility circumstances in the point of view of circumstance crime science, spatial regional traits, and at offering suggestions. As a summary of analysis result, in the case of crime generating facilities, accommodations and entertainment facilities etc. had a positive (+) relationship violent crime generation, and in the case of crime control facility, school facility and sports facility etc. had a negative (-) relationship violent crime generation. On the basis of the analysis result, this study presents some political suggestions as followings. First, it is necessary to forbid establishing accommodations and entertainment etc. ,within residence region, having positive (+) relationship violent crime generation. So, The need to strengthen the police and the citizens of the patrol and surveillance. Second, Law Article 30 states, concerning on land plan and use, that on concluding city, gun (town) management plan, the city and gun has to go through city plan deliberation of City Plan Committee. City Plan Committee has to count police officials and public order expert to access constructing safe cities from planning it. Third, it is necessary, in political aspect, to make a regional autonomous body’s political support over school facility and sports facility having a negative effect on violent crime of crime restricting facility. As a passive method, it is necessary to alleviate permission of sports facility etc. and support a variety of sports facility in school facility. As an active method, it is necessary for regional autonomous body to supply school facility and sports facility.

        경찰학의 성격 및 학문적 위상에 관한 탐색적 고찰: 한국공안행정학회보 및 한국경찰학회보 학술지를 중심으로

        This dissertation, targeting at the academic journals reflecting learning situation, grasped the characteristic and Academic Position of police science through the analysis of police science citation from other learnings. The concrete contents are as followings. First, concerning on the learning characteristic of police science through academic journal analysis, it means that police science has the relation with law and public administrative science etc. closely. Police science has certain relations with studies among academic systems and with a variety of learnings such as physical education and engineering. This result is drawn from multi-learning characteristic of police science. Second, this dissertation analyzed the Academic Position, centering on the journals. Concerning on Academic Position of journals, the journal had an influence on public administrative science (relative inferiority -5.3times), law (relative inferiority -2.2times), police science, and others (relative superiority +2.0 times). The Academic Position, based on the frequency of all citations, was high in the order of public administrative science, law, and police science. Judged in summary, the characteristic of police shows complex learning trait with law, public administrative science, social science, study among academic systems, physical education, engineering. Based on the Academic Position analysis, centered on citation appearing at the journals representative of public administrative science, law, and police science having close relation with police, the learning status was high in the order of public administrative science, law, and police science relatively.

        자치경찰제 도입에 대한 차기정부의 과제 -자치경찰제 도입실패를 중심으로-

        Korea must introduce self-governing police system in the aspect of promoting inhabitants` responses and securing public order services as well as coming true regional decentralization. So, this study presents some political implications on self-governing police system introduction at the next government through the failure cases of the past governments` introduction helpful to the self-governing police system introduction. First, self-police system introduction must be the major subject. Korea must recognize that one of the important polices for coming true regional right division concretely is self-governing police system introduction and must promote self-governing police system. Second, the president must strengthen the wills and negotiation abilities to introduce self-governing police system. The president must promote police continuously with firm wills to introduce the system. The independence of investigation rights and the reversion policy of local administration system must be discriminated from the self-governing police system introduction. The negotiation ability must be strengthened, with policy participants (national police, governing party, national assembly, self-governing body chief), related with self-governing policy system introduction. Third, a plan of exquisite models is essential to self-governing police system introduction. Concerning on introduction units, participants in policies (national assembly member, self-governing body, national policy) must establish an exquisite plan for self-governing police system about assets and personnels. The self-governing police system introduction was discussed on for a long time comparatively, but recently the government makes an effort to carry out introduced self-governing police system. All of the participants sympathize the recognition on the necessity of the system introduction, but there are sharp conflicts on how to introduce the system, because it is related to organization reduction and enlargement. The participants in policies must convert their recognitions to access it in view of organizations and inhabitants about self-governing systems.

        문재인 정부의 지방분권 정책추진에 대한 시사점-역대 정부의 지방분권 정책성과 평가를 중심으로-

        In this study, to examine the development plan of local autonomy through decentralization in Korea, the results of decentralization policy promoted from Kim Dae-jung government to Moon Jae-in government were evaluated, focusing on the Finance autonomy, Organization autonomy, and Administration autonomy, which are the core concepts of local autonomy. When evaluating the policy performance of the past governments decentralization, the Administration autonomy was high in the Roh Moo-hyun government, the Organization autonomy in the Roh Moo-hyun government, the Finance autonomy in the Kim Dae-jung· Roh Moo-hyun governments. In addition, In the inter-governmental relationship, the inclusive authority model in the Kim Dae Jung and Park Geun Hye governments is considered to be an attempt to shift from the comprehensive authority model to the overlapping authority model in the Roh Moo-hyun and Lee Myung-bak governments. Based on this performance evaluation, the following are the suggestions for the development of local autonomy through the decentralization policy of the Moon Jae-in government. First, the priority of decentralization policy should be selected and focused. Second, the president needs a strong will to promote decentralization. Third, continuous persuasion and agreement between the parties concerned are needed. Fourth, it is necessary to revise and establish laws related to autonomy(local autonomy law).The guarantee of autonomy based on the Local Autonomy Law means the transition from the vertical relationship to the horizontal and cooperative relationship between the central and the local.
